TERMS end CONDITIONS

residing at Southold, N.Y., as
parr of the consideration for the issuance of the Permit does tmderstand and prescribe to the fol-
lowing: Permit must be prominently displayed on effected premises during
period of work.
1. That the said Board of Trustees and the Town of Southold are released from any and
all damages, or claims for darnag~ Of S11ig$ ll&'~ing t:]~dy or ind~r~y I!s a result of any oper-
ation performed pursuant to this permit, and the said Permittee will, at his or her own expeose,
defend any end all such suits initiated by third parries, and the said Permittee assumes full liability
with respect thereto, ro the complete exclusion of the Board of Tras~ees of the Town of Sour. hold
2. That this Permit is valid for a period of 24 mos. which is considered to be the
estimated rime required to complete the work involved, but should circumstences warfare, reques~
for an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permirree wishes
to maintain the srrucsure or projec~ involved, to provide evidence to anyone concerned that enth-
ocizadon was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or
it* agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authotized.
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high end Iow water marks.
7. That if furore operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Trustee% the
work shall cause ur~reasonable obstxucUon to free navigation, the said Permittee will be required,
upon due notice, to remove or alter this work or project herein stated wlthour expenses to the Town
of Southold.
8. That the said Board will be notified by the Permlttee os the completion of the work enth-
ox/zed.
9. That the Permittee will obtain all other pormlrs and consents that may be required sup-
plemental ro this permit which may be subject to revoke upon failure to' obr~ln same.

Re: Application No. 10-88-90-2-26 - Lew Edson
Dear :
The following action was taken by the Board of Town Trustees
during their regular meeting held on April 27, 1989 regarding the
above matter:
WHEREAS, En Consultants on behalf of Lew Edson applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated October
27, 1988, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on April 27, 1989 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED that En Consultants ON BEHALF OF Lew Edson BE AND HEREBY IS
GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
Construct single family dwelling on property located at Cedar Point
Drive West, Southold, N.Y., with associated sanitary system,
bluestone driveway, and with the condition that a 50' buffer between
wetlands and any activity be maintained.
This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid and permit
issued within six months of the date of this notification. Two
inspections are required and the Trustees are to be notified upon
completion of said project.
Please take notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.
Permit will be issued upon payment of the following fees:

Re: Wetland Application Recommendations
The following recommendations were made by the Southold Town
Conservation Advlsory Council at a meeting of the Council
held Tuesday, January 24, 1989:
RESOLVED to recommend to the Southold Town Trustee approval
with stipulations Wetland Application No. 11-88-104-13-5 of
En-Consultan~s, Inc. for Kenneth and Christine Rathgeber to remove
and replace (in same locations and configuration) 211± 1.f. of
retaining wall which is to connect to existing walls to north
and south. The figure includes sections around existing concrete
block "bath house" which is being undermined. Approximately
1,490 c.y. of clean sand and loam to be trucked in from an upland
source to be used for backfill and rehabilitation of existing
eroded slope. Following grading, slope to be planted with such
species as Rosa rugosa, bayberry, beachgrass, e~c. to stabilize.
The Council approves with the stipulation that applicant put
in retaining wall in line with neighbors', install drywells ~o
contain roof runoff, and suggest, if necessary, terrace the slopmn§
ground.
RESOLVED to recommend to the Southold Town Trustees approval
with stipulations of Wetland Application No. 11-88-104-8-1.1
Qf Connie Cross for Environmentals Nursery to install two 10'x
30' bermed areas, with natural rock outcroppings and appropriate
plantings at ennrance to Nassau Point. The Council approves
with the stipulation that applicant limit the height of the berm
to no higher than 2'.
RESOLVED to recommend to the Southold Town Trustees approval
of Wetland Application No. 11-88-136-1-41/42 of James E. Fitzgerald, Jr.
for Ira Wechterman to construct a wood deck attached to house,
extending ~o line of retaining wall; construct walkway 34' x 3'
and floating dock 12' x 4'; and install two piles to secure floJting
dock.
RESOLVED to recommend to the Southold Town Trustees approval
with stipulations of Wetland Application No. 680 of En-Consultants,
Inc. for Lew Edson to construct a one-family dwelling, sanitary
system, deck, bluestone driveway, and well, as shown on submitted
plans. (No additional fill to be required.) The Council approves
with the condition that no' clearing be done within 50' of the
water except for a pathway for access to water.
