TERMS a~cl CONDITIONS The Peen~ee Dr. James D'Wolf · , residing at Calves Neck Road, Southold N. ¥., lowing: 1. That the Trustee Permit r~)st be prominently displayed on the prer~ises effected thereby during the period Of work under the permit. I. That the said Board of Trustees and the Town of &)ut, hold are released from any and all damage% or claims for damages, of suits arising directly or indirectly as a result of any ope~- . ation performed pursuant ro thls permit, and the said Permittee will, at his or her own expeme, defend any and ail such suits initiated by third parries, and the said Permit-tee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold 2. That this Permit is valid for a period of' 12 mos. which is considered to be the estimated time required m complete the work involved, but should circumstances warrant, request ' for an extension may be made to the Board ar a later dat~ 3. That this Permit should be retained indefinitely, or as long as the said Permirtee wisbe~ to maintain the strucrore or project involved, to provide evidence to anyone concerned that anth- ,..-. orization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or --its ageuss, and non-compliance with the provisions of the originating application, may be e,,,~e for revocation of this Permit by resolution of the said Boasd. 5. That there will be no unreasonable interference with navigation as a result'of the work herein authorizeck 6. That there shall he no interference with the fight of the. public to pass and repass along the beach between high and Iow water marks. -- 7. That if future oberatioas of the Town of Southold require the cemoval and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, tim work shall cause unreasonable obstruclaon to free navigation, the said Permktee will be required, upon due notice, to remove or alter this work or project herein stated wlthour expenses to the Town of $outhuld. 8. That the said Board will be notified by the Permit-tee ox the completion of the work auth- orized. 9. Please note that there is a $5.00 filing fee, which is a one time fee, for this application. MEMO FOR THE FTT,E I spoke to Henry about the storm damage permit. I advised that there is Dx) permit on file for the structure. Henry advised that this structure is one that could be classified under the Grandfather Clause. Don Dzenkowski also confinued that the structure would come under this catagory. Henry advised that a grandfather application would be necesssry before he could obtain his storm permit to repair the existing structure.
