roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO

AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part wlll receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the salve for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indentpre so requires.

(Description of Premises)
PARCEL I
All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, County of Suffolk and State of New
York, known and designated as Lot No. 42 on a certain map entitled
"Subdivision Map of Cedar Beach Park situate at Bayview, Town of
Southold, New York, made by Otto w. Van Tuyl, Professional Engineer and
Surveyor, Greenport, New York" and filed in the Office of the Clerk of
the County of Suffolk as Map No. 90.
TOGETHER with the benefits of a reservation as set forth in Liber 5088
G/ page 432 and as set forth in Liber 4859 page

PARCEL II
ALL that certain plot, piece or parcel of land with the buildings and
improvements thereon erected, situate, lying and being at Bayview, near
Southold, in the Town of Southold, County of Suffolk and State of New
York, and being a strip of land 50 feet in width over portions of lot
51, 49, 46, and 47 on a certain map entitled "Subdivision Map of Cedar
Beach Park situate at Bayview, Town of Southold, New York" made by Otto
W. Van Tuyl, September 15, 1926 and filed in the Suffolk County Clerk's
Office as Map Number 90, and over a portion of Clear View Road as shown
on said map, and being more particularly bounded and described as
follows-
BEGINNING at a point marked by the intersection of the easterly line of
Cedar Point Drive with the northerly corner of lot no. 51 as shown on
said Map, and the westerly side or southwesterly corner of land
believed to be of Sutherland and designated as "reserved, Cedar Beach
Inn" on said Map;
RUNNING THENCE in a southeasterly direction along the northerly line of
said lot 51, South 66 degrees 52 minutes 20 seconds East across
Clearview Road and continuing in the same direction across lots 49 and
47, to the westerly line of a private road designated as Orchard Lane
on said Map;
RUNNING THENCE in a southerly direction along the westerly side of
Orchard Lane a distance of 60 feet, more or less, to a point which is
50 feet south of the extension easterly of the northerly line of the
premises herein described, measured at right angles thereto;
RUNNING THENCE North 66 degrees 52 minutes 20 seconds West, on a line
parallel to and at all points 50 feet distant from the northerly line
of the premises herein described, across a portion of Lot no. 49 on
said map, continuing across Clearview Road and continuing across a
portion of lot no. 51, on said map, to the easterly line of Cedar Point
Drive;
RUNNING THENCE in a northerly direction along the easterly line of
Cedar Point Drive a distance of 50 feet to the point or place of
BEGINNING.
THE GRANTOR is the same person described as grantee in deed recorded in
Liber 10888 Page 299.
PREMISES herein described are and intended to be the same as those
described in Liber 10888 Page 299.
This Deed is subject to a permit No. 08GP15046 of the Department
of the Army New York District Corps. of Engineers and to the
terms and conditions specified therein which permit is being
