Dear Mr. Fitzgerald:
The following action was taken by the Board of Town Trustees during
its regular meeting held on April 25, 1990 regarding the above
matter:
WHEREAS, Proper-T Services IN BEHALF OF Agnes M. Dunn applied to
the Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town o~ Southold, application dated March 7,
1990 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on April 25, 1990 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT Proper-T Services IN BEHALF OF Agnes M. Dunn BE AND
HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
Demolish existing house; construct new house and regrade property.
Location of property is SE corner of Queen Street and CR 48,
Greenport, NY.
This permit will expire two years from the date it is signed if work
has not commenced by said date. Fees must be paid, if aDDlicable,
and permit issued within six months of the date of this
notification. Two inspections are required and the Trustees are to
be notified upon completion of said project.
Please return to the Building Department for a determination on the
need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for work to
be done below Mean High Water Mark:

RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law, State Environmental Quality Review and 6NYCRR Part 617,
Section 617.10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that the Southold Town Trustees, as Lead
Agency for the action described below, has determined that the
project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other~department or agency
which may also have an application pending for the same or similar
project.

REASONS SUPPORTING THIS DETERMINATION:
1. An on site inspection has been conducted by the Board of
Trustees.

reviewed and completed by the Board of Trustees, has indicated that
no significant adverse effects to the environment are likely to occur
should the project be implemented as planned.
3. Because there has been a response from the Southold Town
Conservation Advisory Council indicating that this projectwould not
have a significant effect on the environment.

The followin§ recommendations were made by the CAC at its meeting
held Monday, March 19, 1990:
On a motion by Bruce Loucka, seconded by Margaret Feeney it
was
RESOLVED to recommend to the Southotd Town Trustees APPROVAL
WITH STIPULATIONS of Wetland Application No. 1-18-90-53-5-12.2
submitted by Gall Schlegel to reconstruct an existing single
family dwelling, solid fill pier, and boat ramp. After recon-
struction, removal of concrete surfacing and installation of
native seaside planting. The CAC approves with the stipulation
that all runoff is contained on property: no runoff from house,
driveway or boat ramp (suggest drywells); hay bales and filter
cloth be used during construction; the concrete debris be removed
from the parcel; and no lawn within 75' of wetlands.

On a motion by John Holzapfel~ seconded by Margaret Feeney it
was
RESOLVED to recommend to the Southol~ Town Trustees APPROVAL
~f Wetland Application No. 2-3-90-98-t-11.1 submitted by En-
Consultants Inc. on behalf of Martin Kosmynka to construct a
timber dock consisting of a fixed elevated walk; hinged ramp;
and floats secured by pilings. Concerning the Letter of No JurisL
diction, the CAC recommends the TrusEees deny the request because
the construction envelope is within 75' of the wetlands.

RESOLVED to recommend to the Southold Town Trustees ~DT~/~P~RQVAL
of Wetland Application No. ~3-1-90-40-3-93 submitted by Proper-
T Services on behalf of ~gnes M~ Dunn to demolish an existing
house and construct a new house. The CAC recommends disapproval
because the new house would be within 75' of the wetlands; no
contour map was submitted; applicant does not show where grading
will occur; and members are concerned about where the runoff
would go.

Re: Waiver Request of Paul Katz
The CAC is in receipt of a letter to Mr Katz from the Trustees,
dated March 15, 1990 stating that an application is required.
The Council will comment upon the project after receipt of the

Re: Chardonney Woods
The CAC made an inspection of the project and found several problems
existed. The project will definitely need a wetland application
The road goes through the wetlands; road runoff goes into the
wetlands; members believe that the south west corner of the marsh
(possibly lot 6 or 9) was filled along with the road.

I'm sorry for the delay in answering your 'phone inquiry of
last Friday, but I was out of town.
The Utilities Departmeng of the Village of Greenport has been
contacted, and they say~ that the propertyV which is the loca-
tion of the proposed project is served by both public sewer
and public water lines. They would be willing to provide a
sketch showing the location of these lines on the property if
you need that information.
