The following action was taken by the Board of Trustees at their
regular meeting of November 17, 1994:
RESOLVED that the ~muthold Town Board of Trustees grant a waiver
to construct a 10' X 62' deck to attach to an existing single
family dwelling. Said deck will be located a minimum of 19'3"
on the north end and 51 1/2' on the south end from the existing
bulkhead. Application also includes a 15' wide buffer planting
area seaward of the proposed deck as required by NYSDEC.

APPROVAL WITH A STIPULATION EDWARD S. KONDAK 30-2-5a, to
construct wood stairs from top of bluff on sound to base of bluff to gain
access to beach. Construction to consist of 32' x 3~ walkway with hand
rails on top of bluff connected with three sections of railed stairs 3~ in
width and ~oined with two intermediate level sections.
The CAC recommends approval with the stipulation ~hat the walkway
be elevated at least 44 above the face of the bluff.

RESOLVED to recommend to the Southold Town Board of Trustees
APPROVAL WITH PROVISIONS of the Wetland Application of JOHANNA
SMITH 10o,-7-5 to resheath (on landward side) 478 +/- I.f. of existing
timber bul'khead. Remove 96 +/- I.f. of existing timber bulkhead and
construct 30 +/- I.f. of new timber bulkhead to expand existing
irregularly shaped boat basin. Maintenance dredge and 20~ of its mouth to
a maximum depth of -4 ALW. Approximately 100 c.y. of resultant spoil to
be dep0sl+,ed on owner's upland.
Excavate upland area adjacent to existing basin (approximately 27~ x
L~0~) to expand boat ~basin. Approximately 150 c.¥. of resultant soll and
sand to be used as backfill.
The Council recommends approval provided the applicant maintains a
20~ buffer as stipulated in the Town Code. Also, the CAC recommends
that the excess spoil be used to build a berm along the outside edge of
the buJkhead.

Inspect ions
1.. The permitted site or facility, including relevant records, is sub~aet to in-
inspection at reasonable hours and intervals by an authorized representative of
the Depar~'l'unt of Envirorrrental Conservation (the Deparb~nt) to determine
v~ether the permittee is co'l'plying with this permit and the ECL. Such represen-
tative rray order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). A
copy of this permit, including all referenced traps, drivings and speeial
conditions, trust be available for nspection by the Deparl~rent at all tirres at
the project site. Failure to produce a copy of the permit upon request by a
Depari~nt representative is a violation of this permit.
Permit C~anges and Re~e~ls
2. The Depart'lent reserves the right to m3dify, suspend or revoke this permit when:
a) the scope of the permitted activity is exceeded or a violation of any
condition of the permit or provisions of the ECL and pertinent regula-
tions is found;
b) the permit was obtained by misrepresentation or failure to disclose
re revant facts;
c) n~vrraterial infom'ation is discovered; or
d} enviro.[untal conditions, relevant technology, or applicable lan or
regulation have material ly changed since the permit ~s issued.
The permittee rrust sul~nit a separatewritten application to the Deparb,unt for
rene¢~l, rred ifJcation or transfer of this permit. Such application trust include
any foiH~, fees or supplu~untal infomution the DeparlzTent requires. Any
renewal, rrod ification or transfer granted by the Deparl~rentrrust be in writing.
4. The permitteerrust sub-nit a renewal application at least:
a) 180 days before expiration of permits for State PolJutant Discharge
Elimination Syste-n (S~:CES), Hazardous V~ste IV~nagulunt Facilities
(F{~VF), rrajor Air Pollution Control (APC) and Solid V~ste Managu~unt
Facilities (DIX/F); and does
b) 30days before expiration of all other permit types.
5. Unless expressly provided for by the Depar~¥ent, issuance of this permit
herr r edify, supersede or rescind any order or determination previous y issued by
the Deparu'rent or any of the te,~, conditions or requiruiunts conta ned in such
order or determination.

The permittee has accepted expressly, by the execution of the application, the
full legal responsibility for all da~uges, direct or indirect, of ~J~atever
nature and by whaTever suffered, arising out of the project described in this
permit and has agreed to inde.,ify and save harmless the State frcrn suits,
actions, damages and costs of every naru and description resulting frem this
project.
This permit does not convey to the permittee any right to trespass upon the
lands or interfere with the riparian rights of others in order to perform the
permitted v~rk nor does it authorize the irrpaim'unt of any rights, title, or
interest in real or personal property held or vested in a person not a party to
the permit.
8. The permittee is responsible for obtaining any other permits, approvals, lands
ease[unts and rights-of-v~ay that may be required for this project.

SPECIAL CONDITIONS
The permittee shall install a drywell in the front (road) or
side yard a maximum of 45 feet west of the eastern property
boundary. Roof runoff from the house shall be'directed to
the drywei1 for on-site recharge.
Prior to the ultimate expiration of this permit the
permittee will cause all fill and exposed faces to be
vegetated to prevent erosion.
There shall be no disturbance to vegetated tidal wetlands as
a result of the permitted activity.
Any debris or excess material from construction of this
project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for
disposal. No debris is permitted in tida~-~wet~a~ds.

SU~PLEMENT~-RY SPECIAJ5 CONDITIONS
The Following Conditions Apply To Ail TIDAL WETLANDS;
FRESh-WATER WETLA=NDS; COASTAL F--ROSiON MANAGEMENT; and WILD,
SCENIC, and P~ECt~EATION'~_L RIVERS PERMITS:
A copy of ~his permit, including all conditions and approved
plans, shall be available at t_he project sits whenever
aut~horizad work is in progress. The permit sign enclosed
with the pal-mit shall be protected from the weather and
posted in a conspicuous location at the work site until all
authorized work has been completed.
The permittee shall require that any contractor, projec=
engineer, or other person responsible for the overall
supervision of this project reads, understands, and complies
with this permit and all its general, special, and
supplementary special conditions. Any failure to comply
precisely with ali of the ter~s and conditions of this
permit, unless authorized in writing, shall be treated as a
viola=ion of the Environmental Conservation Law. if any of
the permit conditions are unclear, the permittee shall
contact the Division of Re~u!atory Affairs at the address on
page one cr telephone (5!6) 444-0365.
If project design modifications become necessa_~y after
permit issuance, t-he perm~ttee shall submit the appropriate
p!~n changes for approval by the Regional Permit
Administrator prior to undertaking any such modifications.
The~ permittee is advised t-hat s-~bstantia! modification may
reqn/ira submission of a new application for permit.
At least 48 hours prior to co~encement of the project,
pe!-mittee and contractor shall sign and return the top
por+_ion of ~he enclosed notification form certifying that
+--~ey are fully aware of and u=nderstand all terms and
conditions of this permit. Within 30 days of completion of
the permitto--d work, ~he bottom portion of that form shall
also be signed and returned, along with photographs of the
completed work and, if required, a survey.
For projects involving activities to be undertaken in phases
over a period of more than one year, the permittee shall
notify ~he Regional Permit Administrator in writing at least
48 hours prior to recommencing work in subsequent years
The .granting of this permit does not relieve the permittee
of the responsibility of obtaining a grant, easement, or
other necessary approval from t--he Division of Land
Utilization, Office of General Sez-¢ices, Tower Building,
~.-hnpire State Plaza, Albany, lqSf-12242 (516) 474-2195, which
may be required for any encroachment upon State-owned lands
underwater.
