The dredging will be contain-ed to the mouth of the boat ramp and along the seaward side of the float. Approx- imately a total of 40 cubic yards will be removed. These modifications were primarily what was contained in our staff's recommendations. Therefore, rather than sending the file to Albany for a decision, a permit will be drafted from this office. Box 728 Southold, NY 11971 RE: Joseph Duggan TW 10-83-0256 Dear Ms. Pfefferling: The Department has objected to Mr. Duggan's proposal for the install- ation of a bulkhead 10' offshore of mean high water and the dredging of a 3' - 6' X 130' intertidal marsh. The destruction of intertidal marsh and littoral zone/coastal shoal, bars and mudflats is in vio- lation of 6NYCRR, 661.5(b) (30). The Applicant hca not demonstrated any necessity for the variances he has reqnested. The lot is approximately 130' deep, which allows for ample development without bulkheading offshore. The Department has recommended the placement of a bulkhead landward of the marsh with a fixed and floating dock away to allow for the mooring of a boat. A decision conference has been scheduled for December 27, 1983 at 9:30 a.m. at the DEC Regional Office to address impacts and possible mitigations.
