Dear Ms. Duffner:
We have completed our review of Application No. 95-00430-L2.
Pursuant to Section 10 of the Rivers and Harbors Act of 1899
(33 USC 403), you are hereby authorized by the Secretary of the
Army:
ACTIVITY: To replace an existing fixed pier with a 4 foot by
34 foot fixed pier, elevated a minimum of 4 feet
above the grade of the intertidal marsh, and
reinstall an existing 3 foot by 12 foot hinged
ramp and 6 foot by 20 foot float.
WATERWAY: Deep Hole Creek, Great Peconio Bay
LOCATION: Mattituck, Town of Southold, Suffolk County, NY
Kindly display the enclosed notice of authorization sign at
the project site.
The activity authorized herein must be completed within
three years of the date of this permit. This authorization is
subject to the enclosed conditions. Please find enclosed two
forms to be used to submit to this office, as required, the dates
of commencement and completion for the authorized activity.
The authorized activity must be performed in accordance with
the enclosed plans. If any material changes in the location or
plans of the subject work are found necessary, revised plans
should be submitted to the District Engineer. These plans must
receive the approval required by law before work begins.
Notice is hereby given that the permittee should recognize
that a possibility exists that the structures permitted herein
may be subject to wavewash from passing vessels. Th~ issuance of
this permit does not relieve the permittee from taking all proper
steps to insure the integrity of the structures permitted herein
and the safety of boats moored thereto from damage by wavewash
and the permittee shall not hold the United States liable for any
such damage.

PERHIT CONDITIONS:
NOTE: The term !'you" and its derivatives, as used in this permit,
means the permittee or any ~utu~e transferee. The term "this office"
refers to the appropriate district or division office'of the Corps of
Engineers having jurisdiction over the permitted activity or
appropriate official of that office acting under the authority of the
commanding officer.
GENERAL CONDITIONS:
1. The time limit for completing the work authorized ends within three
years of the date of this permit. If you find that you need more time
tocomplete the authorized activity, submit your request for a time
extension to this office for consideration at least four months before
the date is reached.
2. You must maintain the activity authorized by this permit in good
condition and in conformance with the terms and conditions of this
permit. You are not relieved of this requirement if you abandon the
permitted activity,.although y?u mgy make a.good faith transfer'to a
third party upon written notiflcatzon to this office. Should you wish
to cease to maintain the authorized activity or should you desire to
abandon it without a good faith transfer, you must obtain a
modification of this permit from this office, which may require
restoration of the area.
3. If you discover any previously unknown historic or archeologicat
remains while accomplishing the activity authorized by this permit, you
must immediately notify this office of what ~ou have found. We will
initiate the Federal and state coordination required to determine of
the remains warrant a recovery effort or if the site is eligible for
listing in the National Register of Historic Places.
4. You must allow representatives from this office to inspect the
authorized activity at any time deemed necessary to ensure that it is
being or has been accomplished in accordance with the terms and
conditions of your permit.
Special Conditions:
Further Information:
1. Limits of authorization.
a. This permit does not obviate the need to obtain other Federal,
state, or local authorizations required by law.
b. This permit does not grant any property rights or exclusive
privileges.
c. This permit does not authorize any injury to .the property or
rights of others.

d. This permit does not authorize interference with any existing
or proposed Federal project.
2. Limits to Federal Liability. In issuing this permit,' the Federal
Government does not assume any liability for the following:
a. Damages to the permitted pro~e.c~..or uses thereof as a result
of other permitted or unpermitted activities or from natural causes.
b. Damages to .t~.e.p~rmitted project or uses thereof as result of
current or future actIvities undertaken by or on behalf of the United
States in the public interesT.
c. Damages to persons, propertyf or to other permitted or
unp%rmitted a6tivities or structures caused by the activity authorized
by this permit.
d. Design or construction deficiencies associated with the
permitted work.
e. Damage claims associated with any future modification,
suspension, or revocation of this permit.
3. Reliance on Applicant's Data: The determination of this office
that issuance of this permit is not contrary to the public interest was
made in reliance on the formation you provided.
4. Reevaluation of Permit Decision: This office may reevaluate its
decision on this permit at any-time the c'
lrcumstances warrant.
Circumstances that could require a reevaluation include but are not
limited to, the ~following: '
a. You fail to comply with'the terms and conditions of the
permit.
b. The information provided by you in support of your permit
application proves to have been false, incomplete or inaccurate (See 3
above). '
c. Significant new information surfaces which this office did not
consider in reaching the original public intgrest decision.
Such a reevaluation may result in a determination that it is
appropriate to use the suspension, modification, and revocation
procedures contained in 33 CFR 325.7 or enforcement procedures such as
those contained in 33 CFR 326.4 and-326.5. The referenced enforcement
procedures provide for the issuance of an administrative order
requiring you to comply with the terms and 'conditions of your permit
and for the initiation of legal action where appropriate. You will be
~equired to pay for any corrective measures ordered.by this office, and
f you fail to comply with such directive~ this offic~ may in certain
situations (such as those specified in 33 CFR 209.170) accomplish the
corrective measures by contract or otherwise and bill you for the cost.
5. Extensions. General condition 1 establishes a time limit for the
completion of the activity authorized by this permit. Unless there are
circumstances requiring either a promp~ c?mpletion of.t~e authorized
activity or a reevaluation of the public interest decisIon, the Corps
will normally give favorable consideration to a request for an
extension of this time limit.

~ ~ ~ GENERAL CONDITIONS ~
'~nstructions
1. The permitted si.te or facility, including relevant records, is subject to in-
spection at reasonable hours and intervals by an authorized representative of
the Department of Environmental Conservation {the Department} to determine
whether the permittee is complying with this permit and the ECL. Such represen-
tative may order the work suspended pursuant to ECL 7t-0301 aqd SAPA 401{3). A
copy of this permit, including all referenced maps, drawings and special
conditions, must be available for inspection by the Department at all times at
the project site. Failure to produce a copy of the permit upon request by a
Department representative is a violation of this permit.
Permit Changes and Renewals :-
2. The Department reserves the right to modify, suspend or r~voke this permit when:
· a} the scope of the permitted activity is exceeded or_a violation of any
condition of the permit or provisions of the ECL and pertinent regula-
tions is found;
b) the permit was obtained by misrepresentation or failure to disclose
relevant facts;
c) new material information is discovered; or
d) environmental conditions, relevant technology, or applicable law or
regulation have materially changed since the permit was issued.
3. The permittee ~ust submit a separate written application to the Department for
renewal, modification or transfer of this permit. Such application must include
any forms, fees or supplemental information the Department requires. Any
renewal, modification or transfer granted by the Department must be in writing.
4. The permittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge
Elimination System (SPDES), Hazardous Waste Management Facilities
(HWMF), major Air Pollution Control (APC) and Solid Waste Management
Facilities (SWMF); and
b) 30 days before expiration of all other permit types.
5. Unless expressly provided for by the Department, issuance of this permit does
not modify, supersede or rescind any order or determination perviously issued by
the Department or any of the terms, conditions or requirements contained in such
order or determination.
Other Legal Obligations of Permittee
6. The permittee has accepted expressly, by the execution of the ~pplication, the
full legal responsibility for all damages, direct or indirect, of whatever
nature and by whomever suffered, arising out of the project described in this
permit and has agreed to indemnify and save harmless the State from suits,
actions, damages and costs of every name and description resulting from this
project.
7. This permit does not convey to the permittee any right to trespass upon the
lands or interfere with the riparian rights of others in order to perform the
permitted work nor does it authorize the impairment of any rights, title, or
interest in real or personal property held or vested in a person not a party to
the permit.
8. The permittee is responsible for obtaining any other ~ermits, approvals, lands,
easements and rights-of-way that may be required for this project.

SPECIAL CONDITIONS

1. The use of wood treated with pentachorophe~6~' in the constructio
of structures that will be in contact with tidal waters is
strictly prohibited.
2. Those portions of docks, catwalks and ramps which extend over
vegetated tidal wetlands shall have a maximum surface width of 4
feet and.shall be a minimum of 3 1/2 feet above grade, as'
measured from the ground surface to the bottom of the planking.
Floating docks shall not rest on vegetated tidal wetlands at any
tidal stagel
3. Docks and floats shall not: (a) extend laterally beyond propert5
lines, (b) be placed so that docked boats extend over adjacent
property lines, (c) interfere with navigation, (d) interfere
with other landowners' rzparian rights.
4. Dock reconstruction or replacement or seasonal installation shall
mot involve expansion or substantial modification of existing
s~ructures or facilities.
5. Installation of additional docks at marinas, boat basins, or
other commercial facilities is not authorized by this permit.
6. No dredging, excavating or other alteration of shoreline or
underwater areas is authorized by this permit, nor shall issuance
of this permit be construed to suggest that the Department will
issue a permit for such activities in the future.
7. Any debris or excess materials from clearing or construction
activities performed under this permit must be immediately and
completely removed from the wetland adjacent area and.disposed o~
at an upland site. Disposed of-debris in tidal wetlands zs prohibit~ ~.

10. The ground area cleared for construction of a path or boardwalk
is limited to a maximum width of six (6) feet. The path or
boardwalk itself is limited to a maximum width of four (4) feet.
11. Cover material used for footpath is 'limited to natural wood/bark
chips, stone, gravel or sand.
The following conditions apply to all Tidal Wetlands;
Wetlands; Coastal Erosion ~anaqemeat; and Wild, Scenic,
Recreational Rivers Permits:
A. A copy of this permit, including all conditions and
approved plans, shall be available at the projec~ site
"- whenever authorized work is in progress. The permit
sign enclosed with the permit shall be protected from
the weather and posted in a conspicuous location at the
work site until all aunhorized work has been completed.
B. The permittee shall require that any contractor,
projecc engineer, or other person responsible for the
:overall supervision of this project reads, understands,
and complies with this permit and all its general,
~. special, and supplementary special conditions. Any
failuare to comply precisely with all of the terms and
c6nditions of ~his permit, unless authorized in
writing, shall be treated as a violation cf the
Environmental Conservation Law. If any of ~%e permit
conditions are unclear, the permittee shall contact the
Division of Requlatory Affairs a~ the address on page
one or telephone (516) 444-0365.
C. If pro3ecc desiqn modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications. The permittee is advised that
substantial modification may require submission of a
new application for permit.
D. At least 48 hours prior to commencement of the project,
the permittee and contractor shall slgn and return the
top portion of tbs enclosed notification form
certifying that they are fully aware of and understand
all ~erms and conditions of this permit. Wig%in 30
days of completion of the pel-mitted work, ~%e bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
required, a survey.
E. For projects involving activln~es =o be undertaken in
phases over a period of more than one year, the
pe-~mittee shall notify the Regional Permit
Administrator in writing a~ least 48 hours prior to
reccmmencinq wcrk in subsequenn years.
F. The granting of nhis pei~min does non relieve the perTaittee
of ~he respcnsibi!ity of obtaining a grann, easement, or
onher necessary approval from nhe Division of Land
Utilizauion, cfr!ce of General Services~ Tower Building,
~pire State Plaza. Albany, ~f 12242 (516} 474-2!95,
may be required for any encrcacrnnenn upon Stata-o~ed lands
underwater.
