par~ of the consideration for the issuance of the Permit does understand and prescribe to the fol-
lowing: 1. The Southold Town Trustees Permit must be prominently
displayed on premises effected during period of work.
1. That the said Board of Trustees and the Town of Southold are released frown any and
al/ damages, or claims for damages~ of suits arising diracfly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permiteee will, at his or her own ex'pcosn,
defend any and all such suits initiated by third parties, and the said Permlttee assumes full liability
with respect thereto, to the.complete exdusion of the Board of Trustees of the Town of Sonthold
2. That this Permit is valid for a period of 24 . mo~ which is considered to be the
estimated time required to complete the work involved, but should circom~ances warrang request
for an exxension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Petmittee wishes
to maintain the structure or .project involved, to provide evidence to anyone concerned that auth-
orization was originally obtained.
4. That the work involved will be subject to the inspeceion and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be ea,,~ for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high and low water mar~.
7. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Trastee~ the
work shall cause unreasonable obstrucnon to free navigation, the said Permit-tee will be requlre~
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
8. That the said Board will be notified by the Permittee ot the completion of the work anth-
orized.
9. That the Permirtee will obtain all other permits and conselats .that may be required sup-
plemantal to this permit which may be subject to revoke upon iailure to obtain same~

Dear Mr. Donadic:
The following action was taken by the Board of Town Trustees
during their regular meeting held on May 31, 1989 regarding the
above matter:
WHEREAS, Steve Donadic applied to the Southold Town Trustees for a
permit under the provisions of the Wetland Ordinance of the Town of
Southold, application dated April 5, 1989, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on May 31, 1989 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED that Steve Donadic BE AND HEREBY IS GRANTED PERMISSION UNDER
THE WETLAND ORDINANCE TO: Construct a 5'x'20' floating dock with the
condition that dock will not interfere with navigation and does not
project to more than 1/3 distance to channel.
This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid and permit
issued within six months of the date of thisnotification. Two
inspections are required and the Trustees are to be notified upon
completion of said project.
Please returnto the Building Department for a determination on
the need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees:
5 x 20' floating dock 150.00
2 pilings 50.00
Total fees due .................... 200.00

Dear Mr. Bowman:
Pursuant to 15 CFR 930.58, the following data and informa=ion is necessary uo
enable the Department of State to adequately assess the coastal zone effects
of this proposed project.
Thank you for your letter of April 2, 1991 which responded to mine of March 4,
1991. A few more things need =o be clarified:
1) In your Letter, one alternative is discussed. Please discuss additional
alternatives to the destruction of intertidal marsh as proposed. It
appears from the plan view drawing that additional space along the
shoreline to the south of the existing docks may be available for dock
placement without necessitating the dredging of wetland vegetation.
2) Please submit a few photographs that will indeed show the presence of
naturally-occurring spartina alterniflora a= the wetland creation site.
What plans are there for monitoring the planting effort? Have you been Ln
touch with the Town or with NYSDEC regarding the proposed mitigation?
Pursuant to 15 CFR 930.60[a), the review of your consistency certification
will begin after we receive and determine that the necessary data and
information is adequa=e to assess coastal zone effects.
Any additional information which you believe will facilitate our consistency
review of this project would be appreciated.
A copy of this letter has been sent to the U.S. Army Corps of Engineers.
