That the said Board of Trustees and the Town of Southold axe released from any and all damages, or rialto, for damage, of snis$ arising dit~-'gly or indirectly as a result of any opur- ation performed pursuant to this permit, and the said Permiftee will, at his or her own expeme, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold 2. That this Permit is valid for a period of 2 4 mos. which is considered to be the esthnated time required to compIete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that auth- orization was originally obtained. 4. That .the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application, may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be ne interference with the right of the public to pass and repass along the beach between high and low water rnmrks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or fi, in the opinion of the Board of Trustees, the work shall cause unreasonable obstrucnon to free navigation, the said Permit-tee will be requlrecib upon due notice, to remove or alter this work or project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee et the completion of the work auth- orized. 9. Box 1179 Telephone (516) 765-1892 BOARD OF TOWN TRUSTEES Southold, New York 11971 Fax (516) 765-1823 TOWN OF SOUTHOLD April 10, 1991 Land Use Company 2576 Sound Avenue Baiting Hollow, NY 11933 Re: Steve Donadic 1000-56-5-28 Dear Mr. Bowman: The following action was taken by the Board of Town Trustees during its regular meeting held on April 4, 1991 regarding the above matter: WHEREAS, LAND USE ON BEHALF OF STEVE DONADIC applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated Februaryl3, 1991 and, WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on April 4, 1991 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED THAT LAND USE, CO. ON BEHALF OF STEVE DONADIC BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: install a 6' X 20' float and 3' X 18' ramp at Budd's Pond. Project will also entail dredging approximately 8 c.y. of sand from a 50 s.f. area to provide 3' depth of MLW, all dredged material will be trucked off site. 50 s.f. of S. atlerniflora will be disturbed. Mitigation for said loss will entail planting 500 s.f. of S. alterniflora in planting area of the Trustees approval. Property located at 200 Willow Point Road, Southold. This permit will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within slx months of the date of this notification. Two inspections are required and the Trustees are to be notified upon completion of said project. Please return to the Building Department for a determination on the need for any other permits which may be required for this project. Permit will be issued upon payment of the following fees for work to be done below Mean High Water Mark: 6 X 20 = 120.00 sq.ft. X $2.00/per s.f. = $240.00 3 X 18 = 54.00 sq.ft. Lachenmeyer: Pursuan= to 15 CFR 930.58, the following data and information is necessary to enable the Departmen= of State to adequately assess the coastal zone effects on this proposed project. 1) It is s=ated on the application nhat no alternatives have been discussed, but it appears that alternatives =o the proposal do exist. For instance, an open pile catwalk could be con~.tructed from shore to mean low wa~er, a~ which point a short ramp and fl.oat could be placed parallel =o shore. This would form a "T"-shaped doc];r and would possibly remove the need to destroy the vege=ated wetland. Please discuss this and other projec= alternatives. 2) Please provide a complete wetlan, mitigation and monitoring plan for the proposed projec=. Include a discussion of the survival potential for the 500 foot-square planted area, lven the fact that no natural stand of Spartina _alternifloa exists at :he si=e. chances are pretty good that there is a natural reason for This lack of marsh vegetation aE the proposed planting si=e. 3) It is not clear from the plans submitted exactly where the project is located on Budd's Pond. Is the foposed dock to be located on or near the Port of Egypt Island? The %tire island has been designated as a significant coastal fish and wildlife habitat.
