The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Trustees upon receipt by the Trustees- of written notice from such other governmental or municipal authorities of its refusal or disapproval The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take ail precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by this permit are being conducted,do, by the acceptance of this permit, give consent to the Town, and its officers and employees to enter upon the premises where such operations are being conducted to make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. This operation will not substantially: A. Adversely affect the wetlands of the town. B. Cause damage from erosion, turbidity or siltation. C. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege- tation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of any waters. H. Weaken or undermine the lateral support of other lands in the vicinity. I. Otherwise adversely affect the health, safety and general welfare of the people of the town. WHEREAS, Zan and Effie Diakos applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated July 16, 1986 , and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings andrecommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on September 25, 1986 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the Town, NOW, THEREFORE, BE IT RESOLVED that Zan and Effie Diakos BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF. She asked if the Town Permit would allow her to leave the shed there? I.advised her that she would be in violation of the D.E.C. if she did that. They review their own applications. She asked me about a sun room that they want to construct on top of their patio on the property. She said that she has a building permit,for this work. I asked her if it was within 75 ft. from the Wetlands or water? She said she thought, that it was about 150 ft. from the water. I told her that the Building Dept. would have sent them here_ ifthey needed a i wetland permit, however, if she wanted to submit a letter, she could and request determination on the need of a permit. The East Marion Stars Road Beach Association would like to request a postponement of any deliberation of this issue to allow counsel retained by the Association adequate time to prepare for this case. Unfortunately he could not be here this evening, as he is a representative at the meeting of. the New York State Bay Association being held this week in upstate New York. Based upon preliminary review of surveys and the Trustees file and other preliminary research, our legal counsel is of the opinion that the information supplied to the Trustees is not fully accurate and their determination at the previous Trustees meeting would be changed if sufficient facts would be supplied to you. Our Attorney, between now and the next meeting, is contemplating retaining an appropriate professional to run an environmental impact study to see what effect the stairs, shed and deck have upon the face of the bluff, and therefore we need additional time. It has come to our attention that a property owner living at Aquaview Extension off Stars Road in East Marion has built a staircase and shed, and has installed electricity and a water supply to the bluff which is adjacent to the East Marion Stars Beach (a private beach). We believe that this constitutes a violation of building regulations', environmental regulations and the rights of all members of the East Marion Stars Beach Association. i As of July 7, 1986, no application has been made or .building permit issued re- garding the aforementioned structure. In addition, no application has been made to the Town Trustees to build within 75 feet of the shorefront. Also, a variance has not;been gr4nted<to build the structure so proximal to the property line of the beach. The owners of the property are Effie and Zan Diakos of fast Marion, and the builder, we believe, of the structure is Tom Crowley of East Marion. Furthermore, we have been informed that a Bay Constable has been sent to inspect the premises and to determine in whose jurisdiction this issue belongs. Southold Town Hall to inquire about the alleged permits applied for by the Diakos family for the stairway, electrical and water installation during Spring of 1986. As per the secretary to the Board of Trustees, Eileen Pfifferling, absoluetly no permit application has been ,filed with the Town of Southold. The process will then be as follows: 1. The Bay Constable will inspect the site by Wednesday, July 9th. (Bay Constable will determine whose jurisdiction) . 2. A warning will then be issued to Mr. and Mrs. Diakos as they have not followed appropriate procedure previously indicated to us . 3. Should they not comply with the town directives, (if under town jurisdication) , further legal action might he forthcoming. 4 . The next step (if the board wishes) is to contact the Department of Environment and Conservation regarding property violations or permits.
