Trustees on Wednesday, May 26, 1993:
RESOLVED that the Southold Town Board of Trustees grants an
extension to Permit ~3820 for one year to expire April 26, 1994.
to construct 215 1.f. of timber retaining wall at or above the
line of MHW, backfill with 15 +/- c.y. of clean sand and loam to
be =rucked in, wall will be built only along side where
shoreline is receding, construct a 4' X 16' hinged ramp secured
~o crest of bank by (2) 4" posts, and a6' X 20' float secured
by (2) 8" pilings.

Dear Mr. Haje:
The following action was taken by the Board of Town Trustees during
its regular meeting held on April 25, 1990 regarding the above
matter:
WHEREAS, Eh-Consultants, Inc. IN BEHALF OF Edward Deutsch applied
to the Southold Town Trustees for a permit under the provisions of
the Wetland Ordinance of the Town of Southold, application dated
December 18, 1989 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said applic'ation on April 25, 1990 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
-submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLyED THAT En-Consultants,Inc. IN BEHALF OF Edward Deutsch BE
AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
Construct 215 1.f. of timber retaining wall at or above the line of
MHW. Backfill with 15+ c.y. of clean sand and loam to be trucked
in. Wall will be built only along side where shoreline is receding.
Construct a 4' x 16' hinged ramp secured to crest of bank by (2) 4"
pests; and a 6' x 20' float secured by (2) 8" diameter pilings.
This permit will expire two years from the date it is signed if work
has not commenced by said date. Fees must be paid, if applicable,
and permit issued within six menths of the date of this
notification. Two inspections are required and the Trustees are to
be notified upon completion of said project.
Please return to the Building Department for a determination on the
need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for work to
be done below Mean High Water Mark:

The Board rescinded its Negative Declaration of 1/25/90 as it
was done ou~ of sequence of the SEQRA process.
Since there were no objections from other involved agencies,
Lead Agency Status was assumed by the Trustees.
The Board gave this project a Negative Declaration as of this
meeting (3/22/90), all in accordance with the previous (1/25/90)
declaration, copy enclosed.
A public hearing will be scheduled for April 25, 1990.

RESOLVED to recommend to the Southold Town Trustees APPROVAL of Wetland
Application No. 478 submitted by Costello Marine on behalf of JOHN VASSIL to
amend Wetland Permit no. 478 to extend existing 6' x 24' float dock 10' for a
total of 6' x 34'.

The CAC disapproves the construction of 215 l.f. of timber retaining wall at or
above the line of MH~. The Council feels this is actually bulkheading and
suggest the applicant plant native vegetation to stabilize the beach and bluff.
Regarding the construction of the single family dwelling with garage, deck, drive-
way, well and sanitary system the CAC feels the applicant move the house back
so there will be no disturbance within 75', i.e. trucks clearing the area for work.
All work should be at least 75' away.

to work out our water supply and other problems with the DEC and owners of the lot.
Therefore, I ask that you refund my $368 permit fee.

The proposed retaining wall is, for the most part, approvable, except
for the 25' and 18' sections; because the area is vegetated with'tidal
wetland vegetation. The re~aining wall should begin at the northern:terminus
of the 18! section and here also have a 5' southerly return. Therefore, the
entire ;length of the retaining wall will be 177'.
The single family dwelling and associated structures are approvable on a
setback basis. However, the datum submitted for the non-jurisdictional request
is inadequate since it is a S.C.D:P.WZ.aerial interpretation of contours and
not field verified. Additionally, the garage Footprint is..a~ the 10' contou~
and therefore will-definitely require work within the regulated adjacent area.
