THIS INDENTURE, made the I"1 day of December 1958
BETWEEN: WILLIAM SCHAFFER and IRENE SCHAEFER, his wife,

and State of New Jersey, Party of the First Part
A N D: JOSEPH CIRIGLIANO and IRENE CIRIGLIANO, his wife
as Tenants by the entirety, of the Town of West
p New York, County of Hudson and State of New

WITNESSETH, that the party of the first part, in
consideration of One ($1.00) Dollar, lawful money of the
United States, and other good and valuable consideration
paid by the party of the second part, does hereby grant and
w u relBse unto the party of the second part, and the survivor o
such parties and his or her distributees and assigns forever
ALL that lot, piece or parcel of land situate at
Mattituck, Southold Town, Suffolk County, New York, and
designated on Amended Map of Mattituck Heights, Property of
Gustav Bayer at Mattituck, Suffolk County, New York, made
and surveyed by Otto W. Van Tuyl, Surveyor, of Greenport,
New York, and filed in Suffolk County Clerk's Office on July
24, 1935 as Map #1184, as Lot No. 48.
TOGETHER with the use in common with others of a right
of way 8 feet wide to and from Wickham Avenue to Long Creek,
a branch of Mattituck Bay to pass and repass on foot only,
said right of way commencing at the northerly junction of
Middle Road and Wickham Avenue at a concrete monument, run-
ning in a westerly direction eight (8) feet; thence running
in a northerly direction 130 feet parallelwitb the boundary
of Hubert W. Klein and Gustav Bayer, to mean highwater mark
of Long Creek; thence running in an easterly direction 8
feet along Long Creek to land of Hubert Klein; thence conn ig
in a southerly direction along the western boundary line of
Hubert W. Klein 130 feet to a concrete monument, the norther y
junction of Middle Road and Wickbam Avenue, .the point or
place of beginning.
AND the parties of the second part for themselves,
their heirs and assigns, do hereby covenant to and with the
party of the first part, their executors, administrators,
distributees and assigns, that the parties of the second
part, their heirs and assigns, will not at any time erect
any house on said premises costing less than $3,500.00, except
the usual garage, and that not more than one such house
shall be erected on said lot.
BEING AND INTENDED TO BE the same premises described
in a deed dated February 21, 1952 from William Bayer to the
party of the first part and recorded in Suffolk County
Clerk's Office in Liber 3323 of Deeds, at Page 595 on
February 26, 1952.
