Please be advised that the Bay Constable has inspected the
above referenced property and has determined that the property
is located more then 75' from any wetland area, and no permit
is required from the Board of'Trustees.

Determination on the need of a wetland permit
October 28, 1986
Don, please make an inspection of the property of John R, Dempsey
at Peconic, property located at Pine Tree Road, tax map no. 1000-104-1-6
to see if this would require a wetland permit. As far as I can tell
according to the tax map it does not look as though a wetland permit
would be required, however, this can not be ascertained until an
on site inspection is made.
Please report your written determination regarding this matter.

of your office and asked her to'advise this office when the above
property was properly staked so that an inspection could be made for
a determination on the need of a wetland permit from this office.
To date, we still have not been advised, We would appreciate
your attention to this matter mn an effort to help expedite this
request.

My client feels that the subject property is located over 75
feet from the nearest body of water or wetlands. Therefore,
he believes that your agency has no jurisdiction over the
