The validity of this permit is or may be subject to the approval of other governmental or municipal
· authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
" 'event that such approval ,is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Trustees upon receipt by the
Trustees- of written notice from such other governmental or municipal authorities of its refusal or
~.?¢\,t,~ disapproval.

The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pd~suant to this permit, and shall take ali precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
mis permit are being conducted, do, by the acceptance of this permit., give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
' ' 'D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. 'Increase the danger of flood and storm-tide damage. ' ....
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters ....
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety an, d general welfare of the people of the town.

Dear Mr. Haje:
As per the map of the property surveyed for John R. Dempsey
at Cutchogue, New York, the building envelope indicates that the
construction of the house is set back seventy-five (75') feet from
the wetland.
Please be further advised'that if this proposal is amended
to a distance closer than seventy-five (75') feet, a wetland
application would be necessary.

Please be advised that for any disturbance immediately
adjacent to a tidal wetland as defined in Subsection A (2)
and lying within seventy-five (75) feet landward of the most
landward edge of such a tidal wetland, a permit is.required
from the Board of Trustees. Attached for your convenience
is a copy of that section of Chapter 97 from the Code of
the Town of Southold.
If you have any questions regarding jurisdiction in
this area, please come in to the office or give a call at
the telephone number listed above so that a determination
can be made.

Dear Sirs:
I have applied for permits to install a dock on the pro-
perty referenced above.
I understand a recent change in the Town Ordinance extends
trustee jurisdiction 75' landward of the edge of wetlands. As
the home which we propose to construct is located 75' from the
wetland edge, I assume that no specific approval from your
Board is required. If that is not the case, would you please
treat this letter as a request to amend the application to
include construction of the house.
For your review, I enclose a survey indicating the pro-
posed house.' I look forward to receiving your explanation
of the situation.

NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT .
Dated: March 28, 1985.
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of.Southold, notice
is hereby given that the Southold Town Trustees, as lead agency
for the action described below, has determined that the project,
which is unlisted will not have a significant effect on the
environment.
DESCRIPTION OF ACTION
En-Consultants, Inc. for John Dempsey:
Application to con~struct a timber dock consisting of a 180' x 4'
fixed elevated walkway, 16' x 4' hinged ramp and'16' x 6' float
secured by two 8" x 20' pilings, on property located at'Haywaters
Drive, Cutchogue.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been a response from the Southold Town
Conservation Advisory Council indicating that this project would
not have a significant effect to the environment.
Because there has been no response in the alloted time from the
New York State Department of Environmental Conservation and the
Southold Town Building Department, it is assumed that there are no
objections nor comments from those agencies.

RESOLUTION - Number 7 - Environmental Assessment on the
Wetland Application of John Dempsey, submitted by En-Consultants.
RESOLVED that pursuant to Article 8.of the Environmental Conservatio~
Law State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that the Southold Town Trustees as lead agency for the
action described below, has determined that the project, which is
unlisted, will not have a significant effect on the environment.
DESCRIPTION OF ACTION
Application of John Dempsey, submitted by En-Consultants, Inc. to
construct a timber dock consisting of 180' x 4' fixed elevated
w~tkway, 16' x 4' hinged ramp and 16' x 6' float secured by two
8" x 20' pilings on property located at Haywaters Drive, Cutchogue.
The project' has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the project be .implemented as planned.
Because there has been a ~response from the Southold Town
Conservation Advisory Council indicating that this project would not
have a significant effect on the environment.
Because there has been no response in the allotted time from the
New York State Department of Environmental Cosnervation and the
Southold Town Building Department, it is assumed that %here are no
objections nor comments from those agencies.
RESOLUTION - No. 6 - To declare lead agency on the wetland
application of John Dempsey~ submitted by En-Consultants, Inc.
RESOLVED that the Southold Town Trustees declare itself lead
agency in regard to the State Environmental Quality Review
Act in the matter of the application of John Dempsey
submitted by En-consultants, Inc.
for a Wetland Permit on certain property located at Haywaters

ACTIVITY: Construction of a 180 foot by 4 foot open-pile supported pier
assembly elevated 4 feet above the grade of the marsh, a 16-foot by 4-foot
hinged walkramp and a 16-foot by 6-foot float secured by two 8-inch diameter
piles to extend approximately 35 feet seaward of the line of mean high
water;

As this work is minor in nature, authorization may be by Lettmc of
Permission. This is in accordance with current Federal Regulations
governing work in navigable waters of the United States. To accomplish
the coordination required, prior to the issuance of a Lettmcof Permission,
your review of the enclosed drawing is requested.
Pursuant to Section 307(c) of the Coastal Zone Management Act of
1972 as amended (16 U.S.C. 1456(c), the applicant has certified that the

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quodruolicate, accompanied by writter- permissior from the owner of the property if not
the same os the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, an~ a detailed description
of proposed project. (Note: Copras of the Pilot Plan may be made by o copy machine and attached
to the Permit App icafion)
C. No operation shall be initiated by the applicant until all permits that ore required are issued.
D. A detailed s~atement of the rehabilitation and proposed condition of the premises after the
work s completed must be g~ven, including o survey if required.
E. tf permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must r)e accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall ae based upon on approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must- accompany the application describing any known prior operations conducted
on the premmes in question and whether any prior Iicenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $~5.00 shall accompany the application. This filing fee includes one inspection:
there is o $5.00 fee for each additional inspection.
H. The Town Board upon requestoorf- t~ applicant for o permit, may waive in whole or in part,
the provismns of ArHcle tl, Section/ ~, /subdivisions (~ and ({~'where it finds that nature of the
proposed operations are such that the requirements of such provis~ons are not necessary for a
proper consideration ,f o permit application.
I Upon aeoroval of this, application the Town Clerk will issue a permit to the applicant. Such
permit shall be available for inspection at any time, upon request.
