ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,

IState of New York, bounded and described as follows:-
BEGINNING at a point on the easterly line of Meadow Lane, 460. 23
feet northerly along said easterly line from New Suffolk Avenue, said
point of beginning being the northwesterly corner of land now or
formerly of Ruth Case; from said point of beginning running along
said easterly line of Meadow Lane North 13 degrees 01 minutes 40
seconds east 160. 22 feet;
THENCE along the southerly line of said Meadow Lane, north 76 degrees
51 minutes 40 seconds east 295 feet more or less to ordinary high water
mark of West Creek;
THENCE southerly along said high water mark 220 feet more or less
to said land now or formerly of Ruth Case;
THENCE along said land, south 89 degrees 56 minutes 40 seconds west,
300 feet more or less, to the point of beginning.
TOGETHER with a free and unobstructed use in common with the other
owners of a right-of-.way for passage on foot of a certain private road
2 rods in width running from New Suffolk Avenue in a southerly direction
to Peconic Bay, said right-of-way being bounded north by New Suffolk
Avenue, east by lands now or formerly of Beverly King, south by
Peconic Bay and west by lands now or formerly of G. H. Case estate.
SUBJECT to the covenants and restrictions as hereinafter set forth on
Schedule "A" attached hereto and made a part hereof.
BEING and intended to be the same premises conveyed to the party of
the first part by Clifford T. Case, Jr. and others by deed dated February
22, 1962 and recorded, or to be recorded, in Suffolk County Clerk's
office.

SCHEDULE "A"
COVENANTS AND RESTRICTIONS
1. There shall be no board fences or fences or hedge over
four (4) feet in height.
2 . That no dwelling building shall be erected on said premises
which shall cost less than $8,000 .00 . All roofs shall be of asbestos,
cedar or composition shingle and no roof shall be laid down with
rolled roofing .
3 . That no more than two (2) dwelling houses shall be erected
on the premises herein conveyed, and shall be not in excess of a one-
family dwelling.
4. That no dwelling house shall be compld:ed on the exterior
with other than new materials of a finishing nature, exclusive of
paint or brick and shall not be finished in imitation brick.
5 . That no building shall be erected within twenty-five (25)
feet of the highway line of Meadow Road. No building shall be erected
within ten ( 10) feet of any boundary line other than mentioned above,
no part of any cesspool shall be erected within ten ( 10) feet of any
boundary of said lot.
6 . Vat there shall be no outside toilets of any nature what-
soever and there must be no polution of the water table.
7 . No fowl and/or animals other than the usual type of household
pets are to be kept on said premises.
8. The said premises shall be used for residential purposes.
That neither the party of the second part nor their heirs, distributees
or assigns, shall or will manufacture, or sell or cause or permit to
be sold, on any portion of the premises hereby conveyed, any goods
or merchandise of any kind, and shall not carry on, or permit to be
carried on, on any part of said premises, any trade, business or
profession (except practice of law where no sign is displayed, what-
soeve4, or any boarding house, asylum or hospital.
9 . Without representation as to the availability of any
particular utility service, the premises shall be subject to electric,
electric light, gas and telephone easements above on and/or below
the surface along any roadway adjacent to said premises .
10. That neither the party of the second part nor their heiiso
distributees, or assigns, shall or will permit any nuisance or noise,
unwholesome and offensive to the person occupying adjoining premises.
No accumulations of rubbish, materials of any kind, or junk, shall be
permitted to remain on said premises,
11 . That no house trailers will be kept, used or allowed upon
said premises except when kept within an enclosed building or garage.
12. The foregoing covenants and restrictions shall be and are
hereby declared to be covenants attached to and running with the land,
but said covenants and restrictions Ehall cease and expire on January
1, 2000.
