Dear Mr. Albert:
The following action was taken by the Board of Town Trustees during
their regular meeting held on December 12, 1991 regarding your
request to amend the above permit.
RESOLVED that the Town Trustees Approve the request of James Volney
Righter Architects on behalf of George DeMenil to amend permit
number 3875 to state the following:
to allow the addition to the existing garage/apartment to be on
a conventional poured concrete foundation instead of sonotube
piers.
All other terms and conditions in the original permit granted shall
remain.
The amended permit shall take effect upon receipt of payment of the
following fees:

The following action was taken by the Board of Town Trustees during
its regular meeting held on October 25, 1990 regarding the above
matter:
WHEREAS, Jk~ES VOLNEY RIGHTER, ARCH. IN BEHALF OF GEORGE DE MENIL
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated June 6, 1989, 1990 and,
WHEREAS said application was referredto the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on October 25, 1990 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will

SPECIAL CONDITIONS
1. The permittee shall require that any contractor, project engineer, or other person~
responsible for the overall supervision of this project reads, understands, and
complies with this permit and all its special conditions.
2. A copy of this permit, including all maps and drawings mentioned in special
conditions, is to be available, for inspection by dEC at all times of active work
at the project site. Failure to produce a copy of the permit upon request by a DEC
representative is a violation of this permit and is sufficient ground for an order
to immediately cease all work on the project.
3. Markers delineating the boundary of the wetland shall be left in p.lace and shall
remain undisturbed for 1. year following completion of the project.
4. Hay bales shall be staked end to enid on the downslope edge of any areas of filling,
'grading or excavation. They shall be maintained in place until all disturbed areas
are permanently vegetate.d. Trapepd sediments shall be removed to a suitable upland
site before the bales themselves are removed.
5. All areas of soil disturbance resulting from this. project shall be seeded with an
appropTiate perennial grass and mulched with hay or straw within two days of f%nal
grading. Mulch shall be maintained until a suitable vegetative cover is established.
6. Disturbance to the wetland adjacent area shall be strictly limited to the work area
identified in the approved plan as shown on Chandler, Palmer & King/Righter Arch.

7. The storage of construction equipment and materials shall be confined to within the
project work site and/or to upland (non-wetland) areas more than ]00 feet distant
from the wetland boundary.

8. Ail excavated material shall be disposed of on an upland site and be suitably
stabilized so that it cannot reenter any water body, wetland, or wetland
adjmcent area.
9. No fill, excavated material, or sediment from runoff shall enter the wetland
or its protected adjacent area.
10. Use of wood treated with pentachlorophenol or creosote is strictly prohibited.
I1. Any debris or excess materials from construction shall be immediately and
completely removed from the wetland and adjacent area to an approved upland site
for disposal.
12.'Heavy equipment, including bulldozers, backhoes, payloaders, etc., shall not be
oeprated in the w&tland.
