RESOLVED that the Town Trustees Approve the request of J.M.Q~-. C.onsulting to amend permit number 302 to reflect construction of 150'~ timber bulkhead with a 15' return at the eastern terminus, and backfill with approximately 400 cu. yds. clean sand to be trucked in from an upland source. The DEC permit expires on ~/88, bu~ the Town Trustee's p~rmit expires on 6/87~ and this presents a serious problem to our family~ My h~band was hospitalized in October 1986~ and is still ill and under medical care at present. Moved by Trustee Goubeaud seconded by Trustee Bredemeyer WHEREAS, the Land Use Company on behalf of Mary DeMartino aBplied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold application dated March 10, 1986 , and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on June 26, 1986 at which time all interested persons were given an opportununity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area; and WHEREAS, the Board considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the Town, NOW, THEREFORE, BE IT RESOLVED, that the Land Use Company on behalf of Mary DeMartino BE AND HEREBY ARE GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF TOWN OF SOUTHOLD, NEW YORK TO construct a single family dwelling a minimum of 80' above the MHW mark and associated sanitary system approximately 140' above the HWM. The applicant had originally been permitted to install approximately 150' of rip-rap above the MHW line at her property fronting Orient Harbor. The problem thaz has arisen is that one of the covenants in the deed of the property from the original landowner is that the original owner has final say in what type of erosion control device may be constructed or installed at said property. The original ewner will not however approve the installation of rip-rap at the site but will give the approval for construction o~ bulkheading.
