Dear Mr. Geideman:
The following action was taken by the Board of Town Trustees
during its regular meeting held on March 27, 1996 regarding, the
above matter:
WHEREAS, J.H. Geideman on behalf of N. Charles ~eLuca applied to
the Southold Town T~-estees for a permit under the provisions of
the Wetland Ordinance of the Town of So~thold, applicatio~ dated
December 19, 1995, and,
WHEREAS, said application was referred to the Southold Tow~
Conservation Advisory Council f~r their findings and
recommendations, and
WHEREAS, a Public 5earing was held b~ the Tc~4n Trustees with
respect to said application on March 27, I996, at which time all
interested persons were given an opportunit~ to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in q~estion and the surrounding area,
a~d,
WHEREAS, the Board has considered all the testi~on~ a/id
documentation s~, ~hmitted concernLug this application, and.
WHEREAS. the structure complies with the stand~ se= forth in
Chapter 37-18 of the $outhold Town COde.
WHEREAS. the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town.

Section 617.10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that the Southotd Town Trustees, as Lead
Agency for the action described below, has determined that the
project will not have a significant effect on the environment.
Please take further notice that this declaration should not-be
c~sidered a determination made for any other department or agency
which may also have an application pending for the same or similar
pro~ect.
TYPE OF ACTION: Type I
DESCRIPTION OF ACTION: Applicant requests a Wetland Permit to
construct a 4' X 265' catwalk over heavy growth of Phragmites for
beach access. Located 3525 Paradise Point Road, Southold.

REASONS SUPPORTING THIS DETERMINATION:
1. An on site inspection has been conducted by the Board of
Trustees.
2. An environmental assessment, submitted by the applicant and
reviewed and completed by the Board of Trustees, has indicated that
no significant adverse effects to the environment are iikel~to occur
should the p~cject be implemented as planned.

A representative of the Southold Trustees inspected your
property at the above referenced location on June 24, 1993.
Provided no. disturbance to the soils and vegetation is made
within the 75t of the body of water as marked on the amended
June 22, 1993 survey of Roderick Van Tuyl there is no
jurisdiction under Chapter 97 Southold Town Code.
Please take note that any disturbance to the rear of the house
as proposed would constitute a violation of the Southold Town
wetland ordinance.

CONSERVATION ADVISORY COUNCIL
At the meeting of the Southold Town Conservation Advisory Council held
Monday, January,22, 1996, the following recommendation was made:

Moved by Allan Connell, seconded by Scott Hilary, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Application of N. CHARLES DeLUCA 81-1-15.8
and 15.9 to construct a it' x 265' catwalk over heavy growth of Phragmites for
beach availability.
The CAC recommends disapproval because tl~'e project would allow
degradation of a wildlife habitat and infringe on a wildlife corridor.
The Council suggests that. since the applicant has a foot access, that he
continue with the 4' wide access in the present location along the property
line and continue (with Trustee approval) to keep the phragmites cut along the
pathway for access.
