Dear Ms. Lachenmeyer:
The Department of Environmental Conservation has complected
review of the latest revision of the_DeGaudenzi application for a
Tidal Wetlands, Protection of Waters, Water. Quality Certification
permit'to install a "Geoweb't boat launching ramp on a parcel
adjacent to a canal off James Creek in Mattituck, Town of
Southold. The project now includes construction of a 20' x 20'
ramp through a fringe of intertidal and high marsh near the east
property line, with the relocation of wetland vegetation now
growing.in the area of the ramp, and planting of additional
vegetation to expand the tidal marsh fringe as mitigation.
The shoreline of the DeGaudenzi property contains a healthy
fringe of intertidal and high marsh vegetation backed with a band
of Phragmites communis, both of which extend a considerable
distance east along the shoreline. This naturally vegetated area
is at its wides~ a~ the ~outheast corner of the property, where
the bo~t launching ramp is now proposed. The waterway at the
site is more an arm of James Creek than a typical fully
bulkheeded canal, and contains significant areas of natural
shorel~e with tidal marsh along its north and south banks.
These vegetated tidal wetlands provide all of the tidal wetland
values listed in 6NYCRR Part 661.2 (Tidal Wetlands Land Use
Regulations), but.are particularly important for marine food
production, wildlife habltat, absorption of silt and organic
matter., and ecosystem cleansing. The high marsh, intertidal
marsh, and adjacent shoal/mudflat area contribute primary
prod?¢~n to ~ames Creek and nearby Peconi¢ Bay, as well as -
providing fe~ding, breeding, and resting areas for numerous
specie~i~f fish, birds and invertebrates. The~tidal wetland
vegetation and the stand of Phragmites just landward of it
provide~a screening buffer between the creek and the developed

portions of the residential lots along the shoreline. This
vegetation also functions as an effective filter of runoff from
the upland lawns.
Construction of the "Geoweb" boat ramp requires excavation,
grading, and removal of tidal wetland vegetation, and I have
classified this activity as presumptively incompatible under use
number 57 in section 661.5Ib) as.required in section 661.5(d).
The application and supporting material fail to demonstrate
tha-t this proposal meets the standards for issuance of permits of
section 661.9(b). Specifically, at least three of the standards
are not met:
Section 661.9(b~ (1) (i):
Constructing a boat launch ramp in a vegetated tidal wetland
is not compatible with the purpose and policy of the Tidal
Wetlands Act to preserve and protect tidal wetlands.
Construction and use of the ramp in intertidal marsh and high
marsh will have an undue adverse impact on the present and
potential value of the marsh and James Creek for marine food
production, wildlife habitat, absorption of sediment and organic
material, and ecosystem cleansing.
The ramp will eliminate at least a 20' x 20' area of wetland
vegetation. Even though the individual cells of the "Geoweb"
ramp are proposed to be planted with individual Spartina sp.
plants, we believe the vegetation will be difficult to maintain
as the ramp is used to launch boats and access the creek. It is
more likely that the disturbance in the ramp area from
construction, and the increase in stormwater runoff reaching the
ramp area will allow Phragmites to colonize the disturbed area,
despite the project specifications to restore and expand the
wetland vegetation. This reduction in the area vegetated with
Spartina alterniflora or Spartina patens is likely-to reduce the
value of the marsh for marine food production.
The installation of the ramp through the marsh fringe and
the band of Phragmites will interrupt an unbroken area of natural
vegetation which extends from the DeGuadenzi boat slip east along
the shoreline across several properties for several hundred feet.
This vegetated shoreline provides foraging opportunities and
cover for safe movement for the remaining species of terrestrial
animals which inhabit this rapidly surburbanizing area as well as
marine/wetland species. Interruption of this vegetated area with
the construction of the boat ramp, and the attendant increases in
human activity expected upon completion, will diminish the areas
value to wildlife by further fragmentating the remaining
naturally vegetated shoreline areas of the creek.

Likewise, the elimination of marsh vegetation expected to
result from the boat ramp, and the disturbance to the surrounding
vegetation which will probably occur from the construction
activity, will impair some of this fringe marsh's function as a
biological cleanser and absorber of sediment and organic
material. Elimination or disturbance of at least 400 square feet
of Spartina alterniflora, and Spartina patens, and adjacent
upland vegetation in an already narrow fringing marsh area will
diminish its ability to function biologically to bind pollutants
and other organic matter as well as capture sediment. The boat
ramp will also function to direct stormwater from the maintained
lawn, %~hich c.an contain fertilizers, herbicides and pesticides,
directly into the creek.
Section 661.9[b% ¢i) (iii):
This project is not reasonable or necessary taking into
account factors such as reasonable alternatives and the degree to
which the activity requires water access. The applicant has an
existing boat slip of approximate dimensions 50' x 32' which is
bulkheaded on the north and west sides and provides convenient
boat access. This boat slip already provides convenient water
access and mooring capabilities. We believe there are at least
two viable boat launching alternatives available to the
DeGaudenzis which can make use of the bulkheaded portion of the
boat slip rather than disturbing the remaining natural marsh area
on the property.
A boat launching ramp can be installed through the bulkhead
at the north end of the boat slip with no disturbance to the
existing tidal wetland vegetation. Being that the applicant's
boat is approximately 16 feet long, a pair of boat davits could
be installed landward of the bulkheading on either the north or
the west side of the boat slip. The davits provide easy, simple
launching of the boat directly into the boat slip, again with no
disturbance or impact to the wetland.
You previously indicated that the applicant launches the
boat once per boating season (put in in the spring, remove in the
fall). If that is the case, the applicant may wish to consider
launching at one of the nearby municipal or commercial facilities
to avoid the expense and trouble of installing and maintaining
their own launching facility.
Section
The proposal does not comply with the use guidelines of
section 661.5. As indicated above, I have classified the
construction of a "Geoweb" boat launch ramp in a high marsh or
intertidal marsh area as presumptively incompatible. Nothing
submitted to date overcomes the presumption that this project is
incompatible with the preservation and protection of tidal
wetlands, or demonstrates that the project will not have an

adverse impact to the values of the tidal wetlands of James
Creek. You have not met the required burden of proof, nor have
you shown that the need for this project is so compelling that
the burden of proof requirements of this standard should be
waived.
The project fails to meet at least three of the five permit
issuance standards for a regu~'ated activity proposed in a tidal
wetland. The proposal will unnecessarily damage or eliminate
vegetated tidal wetlands, even though there are several
reasonable, viable, alternatives available on site which will not
impact natural reSOurces. This project is an exampleof the
unnecessary, incremental loss of tidal wetlands which is
increasingly stressin~ the. P~conic Bay system. I must therefore,
deny this permit application.
Section 621.9(a)(1) (Uniform Procedures) provides that an
applicant has the right to a public hearing if a permit
application is denied. Any request for hearing must be submitted
to the undersigned in writing within 30 days of the date of this
letter. A request for a hearing should also include a
substantive, ~rit~en attempt to demonstrate how this proposal
meets the standards for permit issuance of s~ction ~21.9(b),
including an evaluation of alternatives and explanation of how
the presumption of incompatibility is overcome. The applicant
bears all costs for a hearing.
Should the applicant decide to modify the project to include
one of the approvable alternatives described above, please submit
a new permit application to my attention.

during its regular meeting held on 3uly 21, 1994 regarding the
above matter:
WHEREAS, Land Use Co., on behalf of CARLO DE GAUDENZI
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated February 23, 1993,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
W/{EREAS, a Public Hearing was held b~ the Town Trustees with
respect to said application on July 21, 1994 at which time all
interested persons were given an opportunity to be heard, and,
W~EREAS, the Board members have personally viewed and are

Dear Mr. Krupski:
Thank you for the recent opportunity to discuss the above
referenced application. Understanding the boards reservations
towards this p~oject I am respectfully submitting a revised project
plan enclosed. This plan incorporates the expansion of the
existing marsh by creating optimum intertidal elevations,
stabilizing with GeoWeb and planting an additional 225 +/- square
feet of intertidal marsh. It will also require planting a high
marsh fringe further landward. I am hopeful that this mitigative
measure may allow the board to reconsider this application as a

At the December 6, 1993 regular meeting the Southold Board of
Trustees tabled your application's environmental assessment in
contemplation of a denial.
The Board feels that there is no need for a boat ramp in ~this
location and that the ramp would require the permission of the
underwater land owner.
The previous location is not considered practical discharging
boats at an angle to the bulkhead.
To proceed on this application the requisite permission of the
under water land owner would be required or the previously
requested alternative for marsh creation by removal of a section
of bulkhead should be re-considered.

GEOWEB Boat Ramps

In 1988, the Inyo National Forest constructed two light-duty boat ramps
using the GEOWEB Grid Confinement System. The advantages in using
GEOWEB for boat ramps are its low cost, its ease and speed of installation,
and the ease of transporting the requisite construction materials. See the
diagram in figure 1 for details.
Ramp construction began by building a reinforcing steel bar frame to s[retch
open the honeycomb cells of the web. The framing was attached to the web
with wire ties. The web and frame then were placed on a filter cloth, slid into
the water, and posttioned over a prepared grade (figure 2). The mass of the
frame gradually submerged the web and cloth. Round aggregate was placed
in the grid honeycombs and compacted {figure 3). The framing was removed.
and the ramp structure was complete (figure 4).
GEOWEB costs apprOximately $2 per square foot. As part ora larger con-
tract, ramp buildin~ required 6 person-days fora 20-foot by 40-foot ramp. A
20-foot by 45-foot ramp project took 20 person-days, including building a
temporary plastic fabric perimeter fence to mirgmize lake siltation, grading
out the site, importing fill material, constructing the ramp, and cleaning up.
The rfa~lmum depth of water during construction was 3 to 4 feet at both
ramps.
Both ramps are functioning well. A review showed that rounded aggregate
should not have been used to fill the web cells, The Forest intends to cap the
ramps with crushed angular material and specify the same for future ramps.
