The validity of this permit is or may be subiect to the approval of other governmental or municipal
au[norities. The Town accepts no responsibility in appIving for or obtaining such approval. In the
event that such approval is necessary, [ne holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure tc obtain such other approval when
reouire~ shall Subject this permit ~o immedia[e revocation by the Trustees upon rece.ipt by the
Trustees of written notme from such other governmental or municioal authorities of its refusal or
disaDoroval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, ano shall take all precautions for the prevention of injuries to aersons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
em 31oyees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give cc nsent to the Town, and
its officers and employees to enter u gon the premises where such operations are being cone ucted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit,

A, Adversely affect the wetlands of the town.
B, Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town,
D, Adversely affect fish, shellfish or other beneficial marine organisms, aqua~ic wildlife and vege-
tation or the natural habitat thereof.
E, Increase the danger of flood and storm-tide damage.
F, Adversely affect nawgation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.

NOTICE IS HEREBY GIVEN THAT A PUBLIC HEARING WILL BE HELD BY TEE TOWN
TRUSTEES OF THE TOWN OF SOUTHOLD, AT THE SOUTHOLD TOWN HALL, MAIN ROAD,
SOUTHOLD, NEW YORK, ON THURSDAY, MARCH 26, 1987 ON THE FOLLOWING A~PLICATION
FOR A PERMIT UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF
$OUTHOLD.
In the matter of the application of Eh-Consultants, Inc. on behalf of
Deep Hole Creek Association, James Small, President to maintenance dredge.
a channel 180±' x 75' to 6' below MLW. Approximately 2000~ cu. yds. of
spoil will be removed by dragline crane and deposited on the beach to the
west above MHW. Property is located on Deep Hole Creek, Mattituck.
Trustee Smith: That is the public notice on this application. Are there
any comments for or against this application?
Roy Haje, Eh-consultants, Inc. on behalf of Deep Hole Creek Association:
The project as proposed is quite necessary, as the inlet is closing down
very drastically with very little water at tidal stages to get through
at all. The project is a small segment of the County project, which has been
done mn the pasn. Hopefully it will be done in the future. We just don't know
that right now. We can't counn on that now. So we are proposing to do it
privately an the cost of the Association. The material will be placed along
the beach as stated in the application above the high water line. It is all
sand and similar with the material on the receiving area. We don't for see
any adverse effect there. Any questions, ~ will be happy to answer them.
Trustee Krupski: You didn't receive our commenns. Henry and I went to the D.E.C.
meeting. We thought that maybe a better spoil site would be on the east side
of the creek, like to build a dune above MtlW.
Trustee Larsen: With all of those groin fields?
_Mr. Samuels: The County in the past has attempted to get permission to put
island on the east side and to get the construction easements that you need and
~m were unsuccessful. The County permit which is still in force, which the D.E.C.
will not allow the Deep Hole Creek Association use, still has the spoil site on
the west side. It appears to me that thee is no way out. It would be nice to
put it on the down drift side. You have to have permission. It would be nice
to pun it on the east side. Hopefully the County will get permission from
Koppelman to do it this year.
Trustee Smith: If you get permission and you do do it, and you put the spoil
to the west, can it go above the HWM?
Mr. Samuels: It will go above the HWM. It will go in the groin compartments.
It will fill those compartments.
Trusee Krupski: Will this be adequate to provide navigation?
Mr. Samuels: After this summer. It is a band aid on a big problem.

Mr. Samuels: Last year people could not get in or out.
Trustee Larsen: It has really filled in.
Mr. Samuels: Five years ago we did it for the County and it cost $55,000.
on a contract basis. If it is done this year, hopefully, we're low bidder
again on the contract, we'll be able to do it. It is going to cost more.
Deep Hole Creek Association is up against the wall if they don't get Coumty
approval. They have to follow through with the permits in case. They can't
make it through another summer like last year.
Trustee Larsen: Why don't you dig as deep in that area. Take the point off.
Mr. Samuels: If you can get Charles Hamilton to agree to it we will be very
happy to do a deposition basin there. The problem is that from your lips
and the D.E.C.'s decision is a long step. We haven't been able to make that.
A letter came from the D.E.C. to .dig to A' instead of 6'. If it were to 4'
I know it would non last the summer. You know the conditions there. We'd
appreciate it greatly, and I know Mr. Small would, any lmput the Trustees could
give. We have m classical situation where we have an elected Board of Trustees
who have a knowledge of the area and situation then the D.E.C. who does not
have the time to make an inspection generally speaking. You have a copy of the
Tidal Wetlands Advisory Report. That spells it out very nicely. We would like
to gen some-imput on any projects like this. I assure you that the DPW will.
Trustee Larsen: I think we would like you to expedite the dredging. We wouldn't
like to see the dredging in the summer months.
Mr. Samuels: I agree, we would like to get the permits before the environmennal
windows that Mr. Hamilnon might create which would put the project off until
Labor Day.
Trustee Smith: You have the blessing of this Board to do this project.
Mr. Samuels: A letter from this Board stating that a minium of 6'should be
dredged to would be appreciated. Otherwise it will not hold this summer.
Trustee Smith: The reason we were concerned with the spoil area, we were trying co
have the spoil placed some place where the problem would not reoccur so quickly.
Mr. Samuels: Absolutely. It is a question of funding. The word I have been
getting is that the County Executive has placed sufficient funds in the County
Budge~ for this project. So I hope that it will go forward. I hope that
Broadwaters Creek will go forward also. It is a very complex problem, t don't
chink that the D.E.C. is being realistic with the depths. The shallow depths
that the D.E.C. approves precludes that you will be back again no dredge.
Trustee Smith: Are there any othe questions, no comment. Does anyone else have
any commenns. No commenns. Then I will close this public hea~ing. 8:05 P.M.

Dear Mr. Cole:
In response vo your ~rch 10, 1987 letter, I enclose four
copies of a plan showing the following:
1. Existing tidal wetlands areas.
2. Existing structures; house,s, groins, etc.
3. Direction of littoral drift.
4. Area of primary spoil disposal.
5. Cross section of spoil disposal area~ includi~

6. Distance off ~ixed structures for disposal area.
7o Area in which equipment will work.
The work plan provided is based upon an aerial photograph
taken in 1984, Suffolk County topograpb~ical map, Suffolk
Co~uaty project map for the dredging of Deep Hole Creek
and Tidal Wetlands Inventory Maps Nos. 708-538 and 708-
540. Due to the dynsmic nature of the area, it is not
possible ~o supply an entirely up-to-date sketch of the
proposal. However, we believe the information provided
is as accerave as can presently be supplied. Note that
the area to be dredged has been modified to an irPegularty
shaped Trapezoid. We estimate that the amount of spoil
To be removed from this area ay 2500 cu. yds. Also, nove
that we feel it is most i~or~anv vo dredge this area
To 6' below r~a~ low waver. Not only is this the depth
which was approved for the Suffolk County Deparsmenv of
Works projecv but it is also a depth which will provide
a reasonable time frame during which the Creek will
rent, in open. The Southold Trustees have approved
dredging To 6' and have supplied you with a letter re-
questing that you take similar action. We are of the
opinion that 2, will be inadequate.
The predominant direction of littoral drift would appear
To dictate that spoil be placed on the easterly side
of the inlet. However, permission canno~ be obtained
~o place spoil in that location. Placement above the
line of mean high waver, availability of access, and
adequate area combine to make the spoil site sho~
suitable.
Using this information, we trust you will be able to
proceed ~ith processing and issue a permit in the near
future.

The following action was taken by the Board of Trustees during their
regular meeting held on March 26, 1987 regarding the above matter.
WHEREAS, Eh-Consultants, Inc. on behalf of Deep Hole Creek Association c/o
James Small applied to the Southold To~n Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated January 22, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees wit~
respect to said application on March 26, 1987 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will

This permit will expire on March 26, 1988 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be'notified upon the completion of the work.
Prior no the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
insurance policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as a name insured. Please take further notice that
this declaration should not be considered a determination made for
any other department or agency which may also have an application
pending for the same or similar pro£ect.
A $10.00 KrETLAND INSPECTION FEE IS NOW DUE AND PAYABLE. Upon remittance

The following recommendations were made at the regular meeting of the
Southold Town Conservation Advisory::held March 20, 1987:
No. 489 - Geddes Parsons - Approval with stipulations as per let-ret from John Thatcher of Fishers Island.
No. 490 - Sal Prato - Recommend approval.
No. 491 - Nick Tsouris - Recommend approval but suggest that applicant
work with the Southold Town Kenney's Beach ErosioD
Committee.
Xlo. 492 - Ralph I]-evy - Approve application but suggest permit be withheld unti possible violations have been rectified.
(Upon inspection of property it was discovered that
a 4" diameter hose was being used to dram water from
driveway into the creek, also there is a deek being
constructi~d but no permit is displayed. In addition
there are questions as to whether the dock on premises
has been issued a permit.)

CONDITIONS: Dredge spoil is to be placed on the East side above MHW, amd the
fringe is not to be disturbed.

REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment form has been submitted which

Attached please find application and associated ir~ormation
relating ~o the proposed mintenance dzedging of the
entrance of Deep Hole Creek.
Work on a larger scale was formally conducted by the
Suffolk County Department of Public Works. Tidal Wet-
lands permit #15271-0051 included the dredging of Deep
Hole Creek as well as m~ other waterways within the
Town of Southold and was re-validated to December 31,
1988. Due to budgetary constraints, the County has
dropped Deep Hole Creek from its list of projects. It
has, therefore, become necessary for the residents of
the area to assume the r~sponsibility for maintenance .....
of the Creek.
I have contacted Mr. John Guldi of Suffolk County De-
partment of Public Works who has given me a letter
dicating their acquiescence for the Association to
dredge under the authority of the County permit if that
is agreeable to the DEC and other regulatory agencies. A
copy of that Ja~nua_ry 9, 1987 letter is enclosed.
Therefore, if possible, we requesv that the Association
be granted permission ~o conduct dredging under the
County permit. Should yom fee} that is nov p~ ssible,
kindly proceed with processir~ the application av~ached
hereto.
I am sutre your review of the situation will reveal the
necessity for the work if the waterway is vo be mintained
for boating and tidal exchange necessary for the well-
being of the flora and fauna of vhe Creek.

Please be advised that said project has been dropped from the
approved list of maintenance dredging projects for Suffolk County
due to the determination of the Suffolk County Planning Dept. that
the creek is in the private interest and does not provide a public
benefit to the people of Suffolk County.
Therefore, since we will not be maintaining this watercourse in
the future, we have no objection to the current Army and State
permits being converted to others provided of course that the
County has no liability or responsibilities due to or under said
conversion.

1. An environmental assessment form has been submitted which
indicated that there would be no adverse effect to the
environment should the project be imPlemented as planned.
2. Because there has been no response in the allotted time from
the Southold Town Building Dept. and the New York State D.E.C.
it is assumed that there are no objections nor comments from
those agencies.
