hundred and sixty-two, between ARTHUR N. PENNY, SIDNNEY W. OLMSTE
and CHARDS 0. BLRAZEE, all residing in the Village of Mattituck,
Town of Southold, County of Suffolk and State of New York,
Trustees in trust for the Mattituck Council No. 34, Junior Order
of United. American Mechanics, parties of the first part and the
North Fork Community Theatre, Inc., a membership corporation
duly organized and existing by virtue of the laws of the State
of New York, and having its principal office at Mattituck, New
York, party of the second part,
1,7\ . WITNESSETH, that the parties of the first part, in
consideration of One Dollar, lawful money of the United States,
and other valuable consideration paid by the party of the second
part, does hereby remise, release and quitclaim unto the party
of the second part, its successors and assigns forever,
ALL that certain plot, piece or parcel of land, with
the buildings and improvements thereon erected, situate, lying
and being in the Village of Mattituck, Town of Southold, County
of Suffolk and State of New York, bounded and described as
follows:
BEGINNING at a monument on the southerly side
of Sound Avenue distant 15.68 feet from the inter-
section formed by the southerly line of Sound
Avenue with the easterly line of lands now or
formerly owned by Sidney P. Tuthill;
Running thence north 77000' east 50.00 feet;
Running thence south 6058'30" east 130.00 feet;
Running thence south 77000' west 54.00 feet;
Running thence north 6058130" west 55.00 feet;
Running thence north 77000' east 4.00 feet;
Running thence north 6°58'30" west 75.00 feet
to the point or place of BEGINNING;
BEING AND INTENDED TO BE the same premises conveyed t
the Trustees in trust for the Mattituck Council No. 34, Junior
Order of American Mechanics by the Brooklyn and Long Island
Church Society of the Methodist Episcopal Church by quitclaim
deed dated the 5day of February, 1919, and recorded at the
'34171 PAGE174
Office of the Clerk of Suffolk County on February 8, 1919, in
liber 973, page 580.
TOGETHER with all right, title and interest of the parties
of the first part, in and to the land lying in the streets and
roads in front of and adjoining said premises.
TOGETHER with the appurtenances and all the estate and
rights of the parties of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, its successors and assigns forever.
The party of the first part covenants that it will receive
the consideration for this conveyance and will hold the right to `
receive such consideration as a trust fund to be applied first l
for the purpose of paying the cost of the improvement and will '
apply the same first to the payment of the cost of the improvemeit
I
before using any part of the total of the same for any other
purpose.
The parties mutually covenant that the covenants, terms
and provisions of paragraphs numbered SEVENTH and EIGHTH of the
contract of sale dated March 14, 1962, shall not in any event
or in any respect be merged with this deed but each and every
such covenant, term and provision shall survive this grant and
remain in full force and effect.
IN NITNESS AHE'REOF, the parties of the first part have
hereunto set their hands and seals the day and year first above
written.
