DISCUSSION AND RECOMMENDATION FOR REQUESTS OF NON-JURISDICTION NJ-9 Moved by Bruce Loucka, seconded by Jack Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees of the request of Non-Jurisdiction of NI~fIOLAS DiCFilARO 59~1-2~'.5 to construct a house. Krupski, Chairman Board of Trustees - Southold Town Main Read SOuthold, NY 11971 Re: File # 59-1-21.5 Application of Nicholas DeChiaro Lake Drive, Southold, NY Dear Mr. Krupski, The Kenney's Beach Civic Association has been informed that the above applicant seeks to obtain a building permit for construction in a D.E.C. designated wetland area, on Lake Drive, Southold. We are opposed to such proposed construction on wetlands. The survey presented to your office, dated July 1994, does not present a complete view of the extent of the wetlands. These waters are seasonal in nature and recede considerable during the summer, when the survey was performed. During '~,nter and spring there are surface waters that cover the entire area. We understand that the D.E.C. has classified the entire ama as a Typo One VVetland. The survey does not reveal that there are appurtenances to adjacent properties that could be adversely affected by the proposed septic tanks, The property of Serge Rozenbeum, directly across Lake Drive, has its fresh water supply, from a well !oeated on the front portion, or Lake Drive side, of his property. Another adjacent property may have a similar well. There are else sprinkler systems, supplied by fresh water wells, in the area of pt"oposed septic tanks. Lake Dr ve is composed of an impervious readway, the septic tanks are only five (5) feet from the road, a spillage across the road is a potential factor to be considered. Additionally, the septic tanks, as shown under the submitted survey, are only fifteen (15) feet from the wetlands noted in ;July by the surveyor. The Suffotk County Health Code requires a one hundred (100) foot margin of safety. Actually the septic tanks would be directly in wetlands for most of the year. The proposed dwelling is sited so that two walls, North and West, are only ten (10) feet from wetlands described in the ,July survey. Dudng the winter and spring months, the d..~!ing would be directly in wefla~.ds. Such proposed construction ~poses a serious and detrimenta] danger to the environment and could adversely affect the health and welfare of the residents in the area. Building such a proposed home would undoubtedly involve requiring thousands of yards of fill. for the house, septic tans, and driveway, as noted on the survey. Several thousand feet of wetland would be filled in. This proposed building site is directly in, and adjacent to an important designated fresh water wetland area. If permitted it would destroy irreplaceable wetlands, alter and damage topography, have an adverse visual impact, change vegetation, existing surface runoff would be destroyed, and it certainty would damage wildlife habitat. Addifienally, it would fill surface waters. It would degrade both sur[ace and grouna waters, and the uses of both such surface and ground waters would be seriously cempromised. The site now provides a habitat for a number of species, including various upland birds, animals and water fowl. It contains important species of wetland vegetation. Jt is part of a functioning and productive ecosystem, that provides a wild life nesting habitat and food production supply, it also serve to absorb excess nutrients in surface waters and is important in the control of ama flooding. ~n sho~, the environmental impact caused would be pe~anent and serious, it would severely compromise the entire area. Examining the survey submitted by the applicant, his intentions is to p~ace a dwelling on proFerty that is perhaps 90% wetland in the summer and the balance of the year is near t00% wetland. Our position is that utilizing this parcet for a dwelling wiii substantially violate section 97-28 of Chapter 97 of the Code of the Town of $outhold, as well as the Suffoid County Health Code. Utilizing suc, h a site for a building should not be permitted. We therefore ask that your office keep the Kenney's Beach Civic Association and its residents informed of any further developments concerning this matter.
