Inspections
1.
The permitted site or facility, including relevant records, is subject to in-
inspect on at reasonable hours and intervals by an authorized representative of
the Deparb[unt of Enviromuntal Conservation (the Depart~'~'~nt) to determine
v~ether the permittee is cu~plying with this permit and the ECL. Such represen-
tat ~ve tray order the v~rk sus.p, ended pursuant to ECL 71-0301 and SAPA 401 (3). A
copy of this permit, including all referenced maps. draMnga and special
conditions, rmst be available for inspection by the Deper~[unt at all timas at
the project site. Failure to produce a copy of the permit upon request by
Deparl~,unt representative ~s a violation of this permit.
Permit Changes and P~ne~ls
2. The Depar~ent reserves the right to rr~Jify, suspend or revoke this permit v~hen
a) the scope of the permitted activity is exceeded or a violation of any
condition of the permit or provisions of the ECL and pertinent recjula-
tions is found;
b) the permit v~s obtained by misrepresentation or failure to disclose
relevant facts;
c) ne~vmaterial infmuution is discovered; or
d) enviromuntal conditions, relevant technology, or applicable la~v or
regulation have rraterial ly changed since the permit v~s issued.
The permittee rrust sub'nit a separate written appl i cat ion to the Depar ~,'~cnt for
renewal, rrodification or transfer of this permit. Such application rrust include
any fm,m, fees or supp u~unta information the Deparb~unt requires. Any
rene~val, rrodification or transfer granted by the Deparb~unt rrust be in writing.
The permittee must sul~nit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge
El imination Syste"n (Sf~ES), I~zardous V~ste Managu~nt Facilities
(FCl/VF), major Air Pollution Control (APC) and Solid V~ste Manage-rent
Facilities (~VF); and
b) 30 days before expiration of all other permit types.
Unless expressly provided for by the Depar~,unt, issuance of this permit does
not modify, supersede or rescind any order or determination previously issued by
the Deparl~¥ent or any of the te,~, conditions or requireYents contained ~n such
order or determination.

The permittee has accepted expressly, by the execution of the application, the
full legal responsibility for all dm~ges, direct or indirect, of Whatever
nature and by v~u~uver suffered, arising out of the project described in this
permit and has agreed to indumify and save harmless the State fr~n suits
actions, da'ragas and costs of every nacre and description resulting fro-n this
project.
This permit does not convey to the permittee any right to trespass upon the
lands or interfere with the riparian r ghts of others in order to perform the
permitted work nor does it authorize the irrpai.~unt of any rights, title, or
interest in real or personal property held or vested in a person not a party to
the permit.
8. The permittee is responsible for obtaining any other permits, approvals, lands
easu~unts and rights-of-way that may be required for this project.

Driveway and parking areas shall be constructed of pervious
material. (i.e. gravel)
There shall be no disturbance to the existing vegetation in
the area extending from 15' seaward of the southwest corner of
the house (no deck or stairs) to the bay. The existing
phragmites and beach grass is not to be cleared.
All necessary precautions shall be taken to prevent
contamination of the tidal wetlands and/or water sof New Yor
by silt, sediment, fuels, solvent, lubricants, epoxy coatings,
concrete leachate and any other pollutant associated with
project work.
Any debris or excess material from construction of this
project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for disposal.
No debris is permitted in tidal wetlands.
The storage of construction equipment and materials shall be
confined to within the project work site and/or upland areas
greater than linear feet distant from the tidal wetland
boundary.

SUPPLEMENTARY SPECIAL CONDITIONS
The fol!owmn~ conditions apply ~o all permits:
A. A co~v of this permit, including all conditions and approved
plans., shall be availabie au the project site whenever authorized

shall be protected from the weather and posted in a conspicuous

completed.
The pe=T~£btee shall require that any cennracnor, project engineer,
its general, special, and supplementary special conditions. Any
failure =o comply precisely with all of the terms and cenditions
of this pe_~mit, ~unless authorized in writing, shall be =reared as
a violation of thc 'Environmental Conservation Law. If any of the
pe-~mi~ conditions are unclear, the permi=nee mush connacn the
Division of Regulatory Affairs an the address on page one or

If project design modifications become necessary after permit
issuance, the psrmittse shall submit the appropriate plan changes
for approval by the Regional Permit Administrator prior no
undertaking any such modificauions. The permittee is advised that
substantial modification may require submission of a new
applicatien for permit.
At least =wo days prior uo ccmmencemenn of the project, the
permi~ee ~d con~racnor shall sign and re~urn the ~ou portion of
the enclosed notification form ce.=~ifying that they a~e fully
aware of and undersnand all terms and conditions of this permit.
Wi=bin 30 days of completion of the aunhorizcd work, the bottom
portion of that for~ shall also be signed and returned, along with
photographs of the completed work and, if required, a survey.
For projecns involving activities to he undertaken in phases over
a period of more than one year, the permittee shall notify the
Regional Permit Administranor in writing a= least 48 hours prior
~o reccmmencing work in subsequent years.

Enclosed please find a licensed survey, location map and owner's
authorization for the above-referenced application. The applicant
proposes to reconstruct an existing single f~iiy dwelling
(interior/exterior) and construct minor additions.
As all work will be conducted beyond 75' of the apparent high water
mark/tidal wetland boundary (distance of 78'+;, kindly use this
letter and the enclosed survey as a request fo~ a waiver under the
Town Wetland Ordinance. A check for $40.00 has also been enclosed.
