ob APPF.ALSBOARD MEMBERS Gerard P. Goehringer, Chairman James Dinizio, Jr. Lydia A. Tortora Lora S. Collins George Horning gUFFOJ/r , o Gyp N = BOARD OF APPEALS TOWN OF SOUTHOLD Southold Town Hall 53095 Main Road P.O. Box 1179 Southold, New York 11971 ZBA Fax (516) 765-9064 Telephone (516) 765-1809 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF OCTOBER 27, 1998 Appl. No. 4614 — RICHARD BOARDMAN PARCEL 1000-25-1-13 STREET & LOCALITY: 690 Village Lane, Orient DATE OF PUBLIC HEARING: October 15, 1998 FINDINGS OF FACT PROPERTY FACTS/ DESCRIPTION: The above -referenced property is located in the R-40 Residential Zone district, being situate on the westerly side of Village Lane (76.30 ft. in width). this lot contains a total area of 9,626 sq. ft. and is improved with an existing house of 1079 sq. ft., existing shed 50 sf, garage 240 sf, bath addition 36 sf, bedroom addition 136 sf, living room addition 320 sf for a total of 2,046 square feet. BASIS OF APPEAL: Building Inspector's August 25, 1998 Notice of Disapproval, disapproving an application to expand a recently -built deck by 85 sq. ft. because such addition will exceed the allowable lot coverage. AREA VARIANCE RELIEF REOUESTED BY APPLICANT: In May 1997, this Board granted a variance (under Application No. 4472) authorizing lot coverage of 21.26%, or 2046 square feet to accommodate an improvement project that included a new garage, additions to the house, and a new deck. Applicant has carried out these improvements, but has concluded that an additional 85 square feet is needed at the north end of the deck in order to have a rational traffic flow between the house and the deck. this request is for a variance allowing total lot coverage of 2,131 sq. ft., or 22.1%. The deck is proposed to be located at the westerly corner of the dwelling maintaining the existing 9.5 ft. nonconforming setback which exists for the dwelling. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented and personal inspection, the Board makes the following findings: 1. Applicant's neighborhood is densely built on small lots, with relatively high lot coverage. The small size of applicant's lot is typical of the neighborhood. This Board concluded in May 1997 that lot coverage of 2046 square feet, or 21.26% would not Page 2 — October 27, 1998 Z9A Appl: No. 4614 — R. Boardman Parcel 1000-25-1-13 produce an undesirable change in character of neighborhood or a detriment to nearby properties because applicant's improvements would be consistent with the architecture and character of the neighborhood. The additional 85 sq. ft. (0.9%) of coverage requested by applicant is not substantial and does not alter the prior findings of the Board. 2. Because of the floor plan of the house, the benefit of a rational traffic flow sought by applicant cannot be achieved by some method, feasible for applicant to pursue, other than the proposed deck expansion. 3. The requested area variance will not have an adverse effect or impact on physical or environmental conditions in the neighborhood. 4. The grant of the requested variance is the minimum action necessary and adequate to enable applicant to obtain the benefit of a deck rationally related to the house while preserving and protecting the character of the neighborhood, and the health, safety, welfare of the community. RESOLUTION: On motion by Member Collins, seconded by Member Dinizio, it was RESOLVED, to GRANT the variance, as applied for, subject to the CONDITION that the entire deck, including both the section already built and the proposed addition, remain permanently open to the sky. VOTE OF THE BOARD: AYES: MEMBERS GOEHRINGER, DINIZIO, HORNING, COLLINS. (Member Totora was absent.) This Resolution was duly adopted 4-0). ******************************** Boardman/1000-25-1-13 RECEIVED AND FILED BY THE SOUTHCLD TOWN CLE1,1K TcwL Clerk. No. 4472 - RICHARD BOARDMAN PARCEL 1000-25-1-13 STREET & LOCALITY: 690 Village Lane, Orient DATE OF PUBLIC HEARING: May 7, 1997 FINDINGS (PROPERTY FACTS) : DESCRIPTION: This property is located in an R-40 Residential Zone District, being situate on the westerly side of Village Lane with 76.30 ft. road frontage. This lot contains a total area of 9626 sq. ft. and contains an existing house of 1079 sq. ft. -and shed (50 sq. ft.). BASIS OF APPEAL: Request for variance based upon three , Actions of Disapproval: (a) dated March 12, 1997 to construct an alteration and additions which Disapproval states: " ... Under . Article XXIV, Section 100-244B proposed construction will. have insufficient side yard setback ... minimum is 10 ft. and a combination .of 25 ft. total -side yard setbacks are required. *Note: any farther expansion of dwelling or accessory footprints may exceed 20% maximum lot coverage; and (b) Amendment dated March 31, 1997 to. construct an alteration, addition and accessory aaraf4e which states "... (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because addition to bathroom space cannot be created within the existing building without extensive reconstruction. (3) The requested area variance is not substantial in relation to the code requirement because total new construction will exceed the 20% allowed by 1.26% (total: 21.26%). (4) The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because relief sought will not interfere with the abutting properties and density limitations are exceeded in the area. (5) The situation has been preexisting because the house was built in the mid -1800s and additional space and alteration are needed for more comfortable living conditions. (6) This action is the minimum that the Board deems necessary and adequate and at the same time preserves and protects the character of the neighborhood, and the health, safety, welfare of the community. RESOLUTION/ACTION: On motion by Member Ostermann, seconded by Chairman Goehringer, it was RESOLVED, to GRANT the relief for lot coverage and a setback at not closer than 9.5 (916"), without further setback reduction on this side. It included a porch which was to be (and has been) demolished That number, 2148 Sq.Ft., was revised, at my request, to reflect the elimination of the porch. The Board acted in May' 97 on the corrected figure 2446 Sq. Ft. Please note that the new garage item in your column of figures on page I of your memo should be 240 not 249 as stated. No. 4614 Dear Mr. Boardman: We are having some difficulty with the data regarding the percentage coverage of your lot. The variance granted in May 1997 allowed 21.26% lot coverage, which amounts to 2,046 sq. ft. on your lot of 9,626 sq. ft. The ruling issued by the ZBA at that time does not specify all of the detail, but from the record we conclude that the 2,046 sq. ft. was made up as follows: House 1,079 Shed 50 New garage 249 New deck 287 Addition: Family Room 320 Addition: Bedroom 136 Addition: Bath 36 Less: Demolish Porch - 102 0-fiPiv Page 2 — October 19, 1998 To: Mr: Richard Boardman Re: Appl. No. 4614 Your submission dated October 14, 1998 (copy enclosed) states that the current coverage (including a deck of 287 sq. ft.) is 2148 sq. ft. That figure is made up of the items in the list above, but without deduction of 102 sq. ft. for the porch demolition. If the current coverage is 2046 sq. ft., which is what was authorized by the May 1997 variance, the additional 85 sq. ft. for your request will bring total coverage to 2,131 sq. ft., or 22.1%. If the current coverage is 2148 sq. ft., the additional 85 sq. ft. will bring total coverage to 2,233 sq, ft., or 23.2%. We need to know the correct figures before we can make a decision on your variance request. Our next meeting is October 27, 1998 at which time Board Members would like to commence deliberations for a decision. Please advise. Very truly yours, Gerard P. Goehringer Chairman Encl.
