lowing:
1. That the said Board of Trustees and the Town of Southold oxe released fxom any and
aR damage% or dnlms for d~mages, of suits arising directly or indirectly as a z~mlt of any oper-
ation performed pursuant to this permig and the said Permittee will, at his or her own expense,
defend any and all such suits inithted by third parties, and the said Permittee assumes fur liability

2. That this Permit is valid for a period of 2,4 mos. which is considered to be the
es~ated time required to complete the work involved, bet should cizo~,~rancas warrant, request
for an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that autho
orization was originslly obtained.
4. That the work involved wlil be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the o~ginating application, may be cause for
revocarion of this Permit by resolution of the said Board.
5. That rhece wRl be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high and low water marks.
7. That if future operations of the Town of Southold 'require the ~emoval and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Tsu~ees, the
work shail cause unreasonable obstruanon to free navigation, the said Pemalttee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to .the Town
of $outhold.
8. That the said Board will be notified by the Petmittee o~ the completion of the work auth-
orized.
9. That the Permittee will obtain aR other permits and coments that may be required sup-
pIemental to this permit which may be subject to revoke upon failore to obrain same.

Dear Sir:
Enclosed is a revised drawing for the application already
submitted by Michael Liegey. It shows, as accurately as
possible, the docking facility which previously existed, as is
based ~pon the ~otograph in your file and discussions with
Steve Latson, a neighbor.
In addition, the same drawing shows the proposed facility for
which an amen~ent to the grandfather permit, when issued, is
sought.
It should be noted that the drawing shows a fixed walkway with
a length of 30', whereas the stakes which were in place when
Trustee ~mith inspected the site were placed for a walkway
length of 25'. This change was made at the owner's request to
ensure sufficient depth at low water.
Proper-T Services now represents Mrs. Curry in this matter,
and a letter of authorization is enclosed.

This is further to my 8/8/91 request for an amendment to the
grandfather permit.
You will recall that in our telephone conversation o~ 10/7/9t
you said that the Trustees would need, for the record, the
written non-objection of the $outhold Park District, and that
this was the only remaining impediment to your issuing the
amendment as requested.
The written non-objection, in the form of a letter from the
secretary of the Commissioners of the Southold Park District
was, finally, received today and a copy is attached.
I would very much appreciate your prompt approval, since you
will also recall that both the CoE and DOS were waiting for
Trustee approval before issuing their own permits.

Dear Mr. Bredemeyer:
The action of the Trustees at the 4/4/91 meeting granting a
grandfather permit and amendment in this case included the
condition that "the total structure shall be no further than
30' out from the HWM at the bulkhead".
In an effort to more nearly meet the needs of the owner, and
at Trustee Smith's suggestion, I met with Mr. Smith, together
with Mr. Dickerson and Mr. ~agerman of the Southold Park
District at the site on 6/4/91. It was agreed that if a boat
docked at the proposed structure could be kept landward of a
line of sight between two features on the ground (the most
northeasterly spile of the Park District facility and a pipe
marking the end of the ad]oining dock to the east), it would
be acceptable to all parties.
Enclosed is a revised drawing upon which I have drawn this
line of sight, and a photograph showing it. The leugth of the
fixed walkway has been reduced, and the floats have been
reduced in size (at the request of the Corps of Engineers).
This proposed size meets the agreed upon criterion, but it
exceeds the overall length stated in the condition of the
issued permit. I would appreciate it if you could provide
formal approval of the project as shown in the drawing
enclosedr which bears the revision date of 7/19/91.

Dear Mr. Corey:
This is in response to your letter of 7/22/9% requesting
additional information concerning the referenced application.
The question of navigational conflicts arising from the
implementation of the proposed project was discussed at the
site on 6/4/91 with representatives of both the Board of Town
Trustees and the Southold Park District.
The project plan submitted with the application depicts the
negotiated size, location, and configuration of the project as
agreed upon by the owner, the Trustees, and the Park District,
and is based upon knowledge of local conditions and customary
use patterns in the area.
A copy of the Project Plan drawing with water depths indicated
in the area of the project is enclosed.
Town Trustee operating procedures recognize, upon presentation
of suitable and acceptable documentation, the prior existence
of structures which were installed before such activities were
regulated by the Town. Upon satisfaction of the Trustee's
requirements, and "grandfather" permit is issued. This permit
may then be amended to allow modification and/or reconstruc-
tion of the pre-existing structure, as in this case.

Dear Mr. Fitzgerald:
Pursuant to 15 CFR 930.58, the following data and
information is necessary to enable the Department of State to
adequately assess the coastal zone effects of this proposed
pro3ect.
1. Although the proposed dock assembly is to be installed
in front of the applicant's property, it will also be
placed in front of the Town of Southold's park property
to the west. Judging from the photos and plan drawing,
is appears that there is potential for navigational
conflicts between the applicant's dock use and the
Town's park use. Please discuss the feasibility of
shifting the dock to the east to lessen the chances for
conflict.
2. Please indicate water depths at the project site. The
cross-section includes depths along the plane of the
proposed dock but not of areas around the dock. Please
describe what is meant by "grandfathered" dock as shown
on the plan drawing
Pursuant to 15 CFR 930.60(a), the review of your consistency
certification will begin after we receive and determine that the
necessary data and information is adequate to assess coastal
zone effects.

The following action was taken by the Board of Town Trustees
during its regular meeting held on Thursday, April 4, 1991:
RESOLVED that the Southold Town Trustees approve the request for
a grandfather permit to construct a fixed dock as shown on
survey dated April 17, 1991.
At the regular meeting on Thursday, May 2, 1991 the Trustees
discussed the the purposed amendment to the above permit. The
Trustees feel that the total structure shall be no further than
30' out from the HWM at the bulkhead.
Please note the above grandfather approval is only from this
agency and permits from other agencies might be required.
If you have any questions, please do not hesitate to contact
