The validity of this permit is or may be subject to the approval of other governmenta or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-'
uneer until such approval has been obtained in writing, The failure to obtain such other approval when
required shal subject this 0ermit to ~mmediaze revocation by the Trustees upon receipt by the
Trustees of written notice from such otb ar governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume a~l responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and al claims arising
from operations under this permit and any and al acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give ce nsent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation. - ~ ....
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege'
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely' affect the health, safety and general welfare of the people of the town.

Pursuant to Section 7 of the Endangered Species Act (16 U.$.C. 1531) and
based upon a review of ~he latest published version of the threatened and
endangered species listing, a preliminary determination is that the
activity under consideration will not affect those species listed or their
critical habitat.
Based upon a review of the latest published version of the National
R~gister of Historic Places, there are no known sites eligible for or
included in the Register within the permit area. Presently unknown
archeological, scientific, prehistorical or historical data may be lost by
work accomplished under the required permit.
Reviews of activities pursuant to Section 404 of the Clean Water Act will
include application of the ~uidelines promulgated by the Administrator,
U.S, Environmental Protection Agency, under authority of Section 404[b) of
the Clean Water Act and the applicant will obtain a wager quality
certificate or waiver from the appropriate state agency in accordance with
Section 401 of the Clean Water Act prior to s permit decision.
Pursuant to Section 307(c) of the Coastal Zone Management Act of 1972 as
amended (16 U,S.C. 1456(c)), for activities under consideration that are
located within the coastal zone of a state which has a federally approved
coastal zone management program, the applicant has certified in the permit
application that the activity complies with and will be conducted in a
manner that is consistent with the approved state coastal zone management
program. By this pablic notice, we are requesting the state's concurrence
with, objection to, or waiver of the applicant's certification. No permit
decision will be made until one of these actions occur. For activities
within the coastal zone of New York State, the applicant's certification
and accompanying information is available from, and any comments on, should

The following action was taken by the Board of Trustees
on January 23, 1986 regarding the above referenced matter:
Moved by Trustee Smith seconded by Trustee Bredemeyer
WHEREAS, Costello Marine Contracting Corp. on behalf of J. Lane
Curry applied %o the Southold Town Trustees for a permit under
the provisions of the Wetland Ordinance of the Town of Southold,
application dated October 25, 1985, and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations and,
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on January 23, 1986 at which time
all interested persons were given an opportunity to be heard,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surroun~in~ area;
and
WHEREAS, the Board considered all testimony and documentation
submitted concerning this application; and it is noted for the
record that there has been no public opposition; and
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety, and general welfare of the
people of the Town,
NOW, THEREFORE, BE IT
RESOLVED, that Costello Marine Construction Corp. on behalf of
J. Lane Curry be granted permission under the provisions of the
Wetland Ordinance of the Town of Southold, New York all in accordance
with the application submitted. This permit will expire on
January 23, 1987 if work is nor complete by same. The Trustees
are to be notified upon completion of the work.

Mr. Newman's Wetland Application No. 335 was'then discussed.

to create two 3 acre lots and construct a single family dwelling
and sa'nitary system on each. Approximately 2500 c.y. of fill will be
installe~ a~ the sites to raise the grade for flood plain and
Suffolk County DeparTment of Health Service requirements. Also
planned is installation of two fixed docks leading to ramps and
floaT.
The Council's disapproval is based on a letter from Suffolk
County Department of Health Services to the Planning Board stating
ground water conditions are not conductive to the proper functioning
of individual sewage systems.

Southold Town Trustees, as lead agency for the action described
below has determined that the project will not have a significant
effect to the environment.
TYPE OF ACTION: Unlisted
DESCRIPTION OF ACTION: To construct a 60' low profile groin to
extend seaward from existing bulkhead. Pre-fill with 60 cu. yds.
of trucked in sand of same granulation.
LOCATION OF PROJECT: Paradise Point Road, Southold, Town of
Southold, County of Suffolk or more particularly known as
Suffolk County Tax Map. No. 1000-081-03-1.1.
REASONS SUPPORTING THIS DETERMINATION:
1. An Environmental Assessment form in the short form has
been submitted and reviewed and indicated that there
would he no adverse effect to the environment should the
project be implemented as planned.
2. The Conservation Acvisory Council has reviewed the proposal
and conducted and inspection of the subject property and
indicated that the project would not have an adverse effect
to the environment.
3. The project will not adversely effect the health, safety
and general welfare of the people of the Town.

a wetland permit for Hallenbeck and we have no file on record.
Also called Costello Marine, who advised that Rambo had dons
the work. I called Rambo's offics to ask if they have a
record of a town wetland permit. The secretary advised that
they had no file at all for this person.
