MILTAKIS APRT 1460 STROHSON ROAD, CUTCHOGUE SCTM# 1000-103-10-29.1 Dear Mr. Patanjo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, August 14, 2019 regarding the above matter: WHEREAS, Jeffrey'Patanjo on behalf of D. CANNIZZARO QPRT & B. MILTAKIS APRT applied to the Southold Town Trustees to request a Transfer of Wetland Permit #334 from Frank Curran to D. Cannizzaro QPRT & B. Miltakis APRT, as issued on September 25, 1986; and for an Amendment to Wetland Permit#334 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated September 13, 2018, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of a permit for the structures; WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 14, 2019, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the'town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, BE IT FURTHER RESOLVED, that the Board of Trustees APPROVE the Transfer of Wefland Permit #334 from Frank Curran to D. Cannizzaro QPRT & B. Miltakis APRT, as issued on September 25, 1986; and APPROVES the Amendment to Wetland Permit#334 for the as-built 6'x20' floating dock situated in an "I" configuration as opposed to the permitted "T" configuration; and as depicted on the site plan prepared by Jeffrey Patanjo, last dated March 4, 2019, and stamped approved on August 14, 2019. SCTM# 1000-103-10-29.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP Policy 6, specifically 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 9. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The as-built float does not comply with the Wetlands Permit 334. The length of the dock also does not comply. The as-built dock is 47' long (excluding float). The permitted dock is 38'± in length'(excluding float). Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. There is one item in question regarding the revised plans, the existing adjustable ramp does not contain a dimension. Please revise the plan accordingly in order for the office to determine if the existing ramp is already permitted, or if that needs to be part of the application. The project has two components, an as-built floating dock off of a fixed dock and as-built/proposed decking/paver patio/etc. landward of bulkhead. Your application as submitted needs to be revised to which can be done in a couple of ways; 1) apply for all the landward structures (as-built/proposed decking/patios/etc. landward of bulkhead) in one application, and apply separately for a wetland permit transfer(already submitted) and a full amendment to permit #334 to add the floating dock to the existing fixed dock, or 2) apply for a wetland permit for everything, meaning you would have to include the existing fixed dock to the one application. As an FYI,your current application received on August 16, 2018 has a project description of the combined as-built work landward of bulkhead and the as-built floating dock. You also had submitted at the same time a request to transfer Wetland Permit#334 to the new owner's name which could not move forward due to the as-built floating dock.
