TERMS and CONDITIONS
The Permittee Frank Curran
residing at Fishermans Beach Road, Cutchogue N. Y., as
pan of the consideration for the issuance of .the Permit does understand and prescribe to the fol-
lowing:
i. That the said Board of Trustees and the Town of Southold are released from any and
all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permittee will, at his or her own expense,
defend any and all such suits initiated by third parties, and the said Permittee assumes full liability
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold
Z. That this Permit is valid for a period.of ,2,1 mos. which is considered to be the
estimated time required to complete the work involved, but should circumstances warrant, request
for an extension may be made to the Board at a later date
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that auth-
orization was originally obtained
4. That the work involved will be subject to the inspection and approval of the Board or
its agents, .and non-compliance with the provisions.of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference .with navigation as a. result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,,the
work shall cause unreasonable obstruction to free navigation, the said Permittee will he required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.

The New York District, Corps of Engineers has received an application
for a Department of the Army permit pursuant to Section 10 of the
Rivers and Harbors Act of 1899 (33 U.S.C. 403.) and Section 404 of the
Clean Water Act (33 'U.S.C. 1344) .

enclosed to assist in your review.
The decision whether to issue--a.permit will_be_based on an evaluation
of therobable im act i
P p including cumulative impacts, of the activity..
on the public interest. That decision will reflect the national
concern for. both. protection and utilization of important resources.
The benefits which reasonably may be expected to accrue from the
activity must be balanced against its reasonably foreseeable
detriments. All factors which may be relevant to the activity will be
considered including the cumulative effects thereof; among those are
conservation, economics, aesthetics, general environmental concerns,
wetlands, cultural values, land use, navigation, shoreline erosion and
accretion, recreation, water Supply and conservation, water .:quality,
energy needs, safety, food production and, in general, the needs and
welfare ofthepeople.
The Corps of Engineers is soliciting comments from the public; Federal,
state, and local agencies and officials; Indian Tribes; and other
interested parties in order to consider and evaluate the impacts of
this proposed activity: Any comments received willbe considered by
the Corps of Engineers to determine whether to issue, modify, condition
or deny a permit for this proposal. To make this decision, comments
are used to, assess impacts on endangered species, historic. properties,
water quality, general environmental effects and the other public
interest factors listed above. Comments are used in the preparation of
an Environmental Assessment and/or an Environmental Impact Statement
pursuant to the National Environmental Policy Act (NEPA;) . Comments are
also used to determine ,the need for a, public hearing and to determine
the overall public interest of the proposed activity.

Any person may request, in writing, before this public notice expires,
that a public hearing be held to collect information necessary to
consider this application. Requests for public hearings shall state,
with particularity, the reasons why a public hearing should be held.
It should be noted that information submitted by mail is considered
just as carefully in the permit decision process and bears the same
weight as that furnished as a public hearing.
Pursuant to Section 7 of the Endangered Species Act (16 U.S.C. 1531)
and based upon a review of the latest published version of the
threatened and endangered species listing, a preliminary determination
is that the activity under consideration will not affect those species
listed or their critical habitat.
Based upon a review of the latest published version of the National
Register of Historic Places, there are no known sites eligible for, or
included in, the Register within the permit area. Presently unknown
archaeological, scientific, prehistorical or historical data may
lost by work accomplished under the required permit.
Reviews of activities pursuant to Section 404 of the Clean Water Act
will include application of the guidelines promulgated by the
Administrator, U.S. Environmental Protection Agency, under authority of
Section 404 (b) of the Clean Water Act and the applicant will obtain a
water quality certificate or waiver from the appropriate state agency
in accordance with Section 401 of the Clean Water Act prior to a permit
decision.
Pursuant to Section 307(c) of the Coastal Zone Management Act of 1972
as amended [16 U.S.C. 1456(c) ] , for activities under consideration that
are located within the coastal zone of a state which has a federally
approved coastal zone management program, the applicant has certified
in the permit application that the activity complies with, and will be
conducted in a manner that is consistent with, the approved state
coastal zone management program. By,this public notice, we are
requesting the state's concurrence with, objection to, or waiver of the
applicant's certification.. No permit decision will be made until one
of these actions occur. For activities within the coastal zone of New
York State, the applicant's certification and accompanying information
is available from the Consistency Coordinator, New York State
Department of State, Division of Coastal Resources and Waterfront
Revitalization, Coastal Zone Management Program, 162 Washington Avenue,

The proposed work would involve the replacement of approximately 101
linear feet of existing timber bulkhead within 18 inches of the
existing bulkhead. A 21 foot by 25 foot boat basin would be dredged to
a depth of four feet 'below mean low water, removing approximately 25
cubic yards of sand. A portion of the dredged material would be used
as backfill behind the replacement bulkhead, with the remainder trucked
away to an upland disposal site where it would suitably retained to
prevent its reentry into the waterway. Also, one mooring pile would be
installed near the waterward edge of the boat basin.
The stated purpose of the proposed work is to prevent erosion of the
applicant's property and to provide safe navigation depths for two
outboards.

its regular meeting held on April 4, 1991 regarding the above matter:
WHEREAS, EN-CONSULTANTS ON BEHALF OF Frank Curran applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland ordinance of the Town of Southold, application dated January
18, 1991and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on April 4, 1991 at which time all interested
persons were given an opportunity to be heard, and,

recommends denial because of environmental concerns and to uphold zoning.

The following recommendations were made by the Council at its meeting held
Thrusday, February 7,1991 :
On a motion by Stephen Angell, seconded by Margaret Feeney, it was
RESOLVED to recommend to the Southold Town Trustees approval with limitations
on Wetland Application No. 111 - 1 of Thomas Samuels to maintenance dredge
a channel 30±' x 1440±' to maximum depth 6' below MLW with spoil to be
used as beach nourishment on southwest side of Fisherman's Beach. The
CAG approves if the dredging depth is limited to 4'. The Council feels
that 6' is too big, 4' is adequate for most pleasure crafts in the area and
the Council is concerned that the 6' depth would create potholes and problems
to the surrounding water and shellfish.
Vote of Council: Ayes: All
Motion carried.
Application No. 12-2-90-78-5-16 of James Grathwohl was tabled pending
receipt of the landscape plan, buffer zone and placement of a retaining
wall as requested by the Board of Trustees.
On a motion by Stephen Angell, seconded by Bruce Loucka, it was
RESOVLED to recommend to the Southold Town Trustees approval with suggestions
of Wetland Application No. 12-4-90-.123-10-1 of Panagiotis Gazouleas to construct
a single family dwelling, attached decking and associated sanitary system.
Construct a,4' x 30' fixed dock, 3' x 10' ramp and 6' x 20' float. The
Council approves the house as submitted with the stipulation that the applicant
follow the checklist the CAC submitted to the Trustees in a letter dated
February 9, 1990 which requires roof,gutters and drainpipes, no runoff
by grading, straw bales during construction, no planting requiring fertilization
and heavy watering within 75' of wetlands, etc. The Council approves
the dock with the suggestion that the two floats be turned 900 to plan
so it would be in line with the last adjacent dock.

Motion carried.
On a motion by John Holzapfel, seconded by Cynthia Sturner, it was
RESOLVED to recommend to the Southold Town Trustees approval, with stipulations
of Wetland Application No. 24-2-11 to remove existing dilapidated docking
facility and replace in-kind, in-place, a 4' x 28' fixed timber dock, 3' x 16'
aluminum, ramp, 6' x 20' float dock and two 2-pile float support'dolphins.
The Council approves provided the project does not interfere with the adjacent

Dear Mr. Haje:
As per our conversation this afternoon, the Southold Town
Trustees visited the site of the above referenced project this
date.
The Trustees would request that this application be amended to
construct his bulkhead in place and provide drywells for all
guttersandleaders and withdraw the request to dredge Trustee
lands.
The Trustees feel the site as presently developed affords the
owner water access for two large boats and that further
incursions on the bottom are not warranted particularly in light
of these existing attributes.
