EDWARD ROSS and GERTRUDE HOLMBLAD ROSS, his wife, both residing at 65 Shadylawn Drive, Madison, New Jersey, party of the second part, WITNESSETH,that the party of the first part,in consideration of Ten ($10.00)------------------------------------------------- dollars, lawful money of the United States,and other good and valuable consideration paid by the party of the second part,does hereby grant and release onto the party of the second part,the heirs or successors and assigns of the party of the second part forever, ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,situate, lying and being iltattlaac at Cutchogue, in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows-- PARCEL I BEGINNING at the Northwest corner of said premises at the point of intersection of the Easterly side of a certain Private Road herein- after described with the southerly line of lands of Jeremiah Soper and another, said point of beginning being distant South 88 degrees 27 minutes 00 seconds East, 465.86 feet from the Easterly side of Little Neck Road, running thence along the Southerly line of said land of Jeremiah Soper and another South 88 degrees 27 minutes 00 seconds Rest 155 feet, more or less, to the line between the upland and meadow of Sheep Pen Channel, running thence in a general Southerly direction along said line between the upland and meadow 128 feet to a point and corner of the land herein conveyed, running thence in s Northwesterly ✓ direction along a straight line 178 feet, more or less, to the Easterly aide of the aforesaid private road; running thence North 5 degrees 05 minutes 40 seconds East along the Easterly side of said private road 80 feet to the point.or place of beginning. TOGETHER with a`.night ofway fon-the-.purpose z:of ingress and egress from theabove described premises to Little Neck Road over and upon the aforementioned Private Road, 33 feet wide throughout. Said premises above described for the purpose of identification only being known and designated as Lots 14, 15 and 16 on a certain map entitled, "Map of Little Neck Park situate at Cutchogue, Suffolk Lw5347 me 17 County, N.Y. Scale 40 ft.= 1 in. made from actual surveys completed May:31, 1927, by Otto W. Van Tuyl, Engineer 0 Surveyor, Greenport, 'r N.Y. ei r ` Together with all the .righty title and interest, if any, of the..parties of the first pert, of.in and to the meadowlying in front of and adjoining the abovedescribed premises on the east and also. all the right, titleand interest,::if any, .of said parties of the fisat. part of. in and to the waters and land under the waters of Sheep Pen Channel lying in front of and adjacent to the afore- said meadow. -This conveyance Is made subject to the following f restrictionet -1. Said premises shall not be used except for residential purposes, that party of the second part will not erect, carry on, .,maintain, .suffer or permitOn, the said plot or any part thereof any brewery, distillery, or other place for the manufacture or sale of intoxicating liquors, nor for the:.sale of gasoline, nor any 'dangerous, offensive or noxious trade business or occupation, nor any nuisance whatever, nor any trading or manufacturing businese, trade or occupation,. nor shall' any fowl be kept on said premises. 2. No residence shall be erected upon said premises or any .part thereof which shall cost leas than $1$00. nor shall any other building be erected or maintained thereon, excepting a private garage and necessary outbuildings, which shall. be inoffensively located and sightly. 3. No residence shall be erected on said: premises within 6 ft. or any road or roadways adjacent thereto, nor within 10 ft. of any side line, nor within 25 ft and 6 inches from the top of the bank. 4. Said premises together with the buildings shall be kept in wholesome, healthful and sanitary condition by party of the second part. 5. The foregoing restrictions are hereby declared to be and - shall be covenants to and running with the land. BEING and intended to be the same premises conveyed to the i'! grantor herein by deed from Albert B. Stroheon and Alice E. Strohson, his wife, dated November 5th, 1938 and recorded in the Suffolk County Clerk's office on November 10, 1938 in Liber 2013 at page 404 and �P by deed from Albert B. Stroheon and Alice E.
