GARBER, late of the Borough of Brooklyn, County of Kings, City and State of New York, the said Executrix residing at 901 Avenue H, Borough of Brooklyn County of Kings, City and State of New York, Party of the First Part, and LETTY GARBER residing at 901 Avenue H, 0 .° ,'. Borough of Brooklyn, County of Kings, City and State of New York, Party of the Second Part, W I T N E S 5 E T_ H: That the Party of the First Part, by virtue of the power and authority to her given by the said Last Wil and Testament dated December 23rd, 1958, which said Will was admitted to probate in the Kings County Surrogate's Court, on June 30th, 1961, [Index number P 3795-1961], and in con- sideration of One [$1.00] Dollar lawful money of the United States paid by the Party of the Second Part, does hereby grant and release *nnto the Party of the Second Part, her heirs and assigns forever, and undivided one-half interest in and to the certain lots, pieces or parcels of land with the buildings and improvements erected thereon, and therigh s of way thereunder, lying and being at Nassau Point, Suffolk County, New York, bounded and described as follows: PARCEL I ALL that certain lot, piece or parcel of land, situate and being at Nassau Point or Little Hog Neck, Suffolk County, New York .and known and designated as Lot #,222 on map entitled "Amended Map "A" of Nassau Point, owned by Nassau Point Club Properties, Inc., situate in the Town of Southold, L.I. N.Y.", surveyed June 28th, 1922, by Otto W. Van Tayl, C.E. and Surveyor, Greemport, N.Y. and filed in the office of the Clerk of Suffolk County j New York, on August 16th, 1922 as File #156. PARCEL II ALL that certain lot, piece or parcel of land situate, lying and being at Nassau Point or i sa r ti. 1_21 a;,E114 4 .} Little Hog Neck, County of Suffolk, State of New York, and known and designated as Lot #223 on map entitled ^Amended Map "A" of Nassau Point, owned by Nassau Point Club Properties, Inc., situate in the Town of Southold, L.I. N.Y.", surveyed June 28th, 1929, by Otto W. Van Tuyl, C.E. and Surveyor, Greenport, N.Y., and filed in the Office of the Clerk of Suffolk County, N.Y. on August 16th, 1922 as file #156. ' TOGETHER with all right, title and interest of the party of the first part of, in and to the land under water in Wunnew&ta Pond, abutting said premises. TOGETHER with all the right,title and interest that the party of the First Part has, or may havey- in and to the land or lands under water, adjoining the said premises; to the use of the body of water adjoining the premises for bathing, fishing, clamming, boat landing, and other legitimate purposes, including the right to erect a pier or other landing facilities in connection therewith, provided any of such uses are not prohibited by any municipal, state or other governmental authority having jurisdiction thereover. PARCEL III ALL that certain plot, piece or parcel of land, situate, lying and being at Cutchogue, in the Town of Southold, County of Suffolk and State of New York, known and designated as Lots numbered 224,225 and 226 on a certain map entitled "Amended Map "A" of Nassau Point, owned bt Nassau Point Club Properties, Inc.", filed in the Suffolk County Clerk's Office on August 16, 1922 as M4ep No. 156. TOGETHER with all the right, title and interest, if any, of the parties of the First part, in any and all rights of way, road, riparian, under, low or high water, or easements, or other rights, that they may have in the premises. PARCEL IV ALL those parcels or pi eces of Iand,YP/✓ATE, lying and being at Nassau Point, Suffolk County, New York, bounded and d8scribed as follows: ALL that portion of Bayberry Road northerly and easterly of Wunneweta Road as shown on a map, entitled, "Amended Map A of Nassau Point owned by Nassau Point Club Properties, Inc., situate in Town of Southold, Long Island, New York", dated June 28th, 1922 and filed in the Suffolk County Clerk's Office August 16th, 1922 as Map No. 156, said portion of Bayberry Road being bounded as follows: Westerly and Southerly by the easterly and northerly lines of Lot Number 222, westerly by the curved easterly line of Wunneweta Road, which is 50 feet easterly from the westerly line of said Road, easterly by lots consecutively numbered 140 to 132, southerly by the northerly line of Wunneweta Road, which is 50 feet northerly from theline of soothe fly said Road, all as shown on the map to which reference is made above. TOGETHER with the appurtenances, and also all the estate which the said Testator had at the time of his decease in said premises, and also the estate therein which the Party of the First Part has or has power to convey or dispose of, whether individually, or by virtue of the said Will or otherwise. TO HAVE AND TO HOLD the premises herein granted unto the Party of the Second Part, her heirs and assigns forever. And the Party of the First Part covenants that she has not done or suffered anything whereby the said premises have been encumbered in any way whatever.
