As you can see from the enclosure the Crisp dock will be no closer than 80 feet to the Van Oosten dock and 120 feet to the Bartow dock. At no point does the permitted structure extend beyond an extension of the neighboring docks or provide a navigation hazard. For your information the Town Wetland ordinance does not require neighbor notification . I see nothing amiss in this file or anything to justify revisiting the permit conditions already adopted by this Board. The measurements Mrs. Bartow questions are typically made at the point where the dock enters the water and are indeed accurate from this point. It is unfortunate Mrs. Bartow seemingly impugns the integrity of this Board in her otherwise pleasant note we received January 8, 1991. I consider this matter concluded unless you wish to submiu an engineers report to this office. Very truly yours, John M. You stated that no one spoke in opposition to the structllre ~t th~ pu~!ic he~ring. I would note that Woolston Associates, owner of the adjacent land, did not receive notice of the hea~ing and, therefore, made no arrangements to have its position heard. We had written letters expressing our opposition. The principal concern we have is that, based on our measurements, the distances on the plans filed by the Crisps in connection with their application appear to be grossly inaccurate. I think that a meeting next summer on Fishers Island is too late to consider this fact, as the dock may well be built by then. I request that a member of your staff be sent over to F~shers Island as soon as possible to measure the distance between the two existing docks, Mrs. van Ostrom's and that owned by Woolston Associates. Said permit was issued after a public hearing at which no one spoke in opposition to the structure. We believe the structure is environmentally, navigationally and physically well planned and should not pose a threat to anyone. I'm terribly sorry we did not connect last weekend and ~ex_-wee--end will be too late for the Army Corps. of Engineers so I am putting my present thinking on paper to you both but hope we cah~djScuss this in person next weekend when you are on the island. As I originally told you I would not be in favor of your buil'ding a dock for environmental and aesthetic reasons but, wishing to be a good neighbor, would not stand in your way if doing so were legal and not dependentupon my feelings in the matter. Unfortunately, upon returning to Fishersand vie%~ng the area in person ~th the facts in hand as you had given them to me, I find my objections increasing--not dimintshinE. Specifically I have new Concerns about Your dock's effect on t-he valu~ and rights of my property. Looking at the cove, it didn't seem possible to me that your proposed dock could be 100 feet from mine and indeed, it cannot be. Fortunately, Mrs. Barrow was on the island so I was able to measure the distance between the tip of the Fenton's dock and mine. I had already measured the other distances per my map overlay onto your application map which I enclose with this letter. As you can see, Docko's measurements are far from accurate and though I could be off a few feet your dock at best will be no more than 60 feet from mine and could be as near as 23 feet. This woutd mmke us siamese twins compared to all other docks in the harbor which are generally more than 200 feet apart,excepting those ~mediately adjacent to the Fenton's which are about t00 feet apart. I therefore, cannot help but feel that my property would be adversely affected by your dock. As to Riparian rights, here again my information is at odds with yours. Namely that, absent any written agreement, riparian rights run with the land and remain valid and in farce. Moreover, the history of our two properties is actually not that long; for half the life of this house, there was no house on what is now your land. Your house on the road,as you may know, was originally in my dell and served as the caretaker cottage to my house; your house at the water's edge is of course less than ten years old. However, Peter, I am loath to focus on this aspect of the problem since the legal world is essentially adversarial and that is no -- nor do I ever wish it to be -- my relationship with you or any other neighbor (or come to think of it, with anyone period). I value our existing relationship too and feel that these latest concerns of mine would be yours too if our positions were reversed. For this~reason I repeat I hope we can gettogether this weekend for I want to ask you to reconsider the offer I made to you and Frank Bonsal last year to make use of my dock. I thought that was a go and was quite surprised by your phone call. The path cut last year between your property and my dock seems to be "well seasoned" and so is clearly convenient. It also remains true that my not having a boat would make your little sailboat lord of all it surveys. Above all, using what exists seems to me noy only environmentally sound(a concern extremely close tomy heart) but your so doing would retain the visual and physiczl tranquility of our cove which I so greatly value during my season on the island. Finally, I do want to add that if, anfter trying this arrangement out, problems arise which cannot be amicably resolved between us, my position would be different for I do appreciate your wanting to park your boat without having to also park your car. My home is directly adjacent to the area where Mr. Crisp proposes to construct a dock. In response to your inquiry, I am enclosing a copy of my letter to Mr. Crisp which reflects my present position on the proposed dock which application you have before you. As stated in this letter, I have measured the same distances set forth on the map enclosed with said permit request and as can be seen on my map overlay, the actual measurements are very different from those in the application.
