Dear Gentlemen:
Wetlands permit ~163 is filed under the name of Chester
Dickerson. Since he filed for this permit, t purchased
this lot from him and is listed as such in the December
26, 1984 Board of Town Trustees M~nutes (xerox copy is
enclosed).
With this letter I am requesting from the Board an
additional extension of time. When I received the original
extension I was under the impression that I had all the
permits needed, but after I sat with the bulkhead contractor
to discuss getting started, I found out that a D.E.C. permit
was required. I hired Land Use Co., Chuck Bowman from Wading
River to handle the D.E.C application. To say the very
least it has been s long fustrating endeavor that resulted-
in the U.S. Army Corps of Engineers, finishing their paper
work and published their notice December 17, 1985 and expires
January 17, 1986 (xerox copy is enclosed). This ~s the
reason for my request of an extention of Permit ~163.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project, which
is unlisted will not have a significant effect on the environment.
DESCRIPTION OF ACTION
Application of Chester Dickerson for a wetland permit. Permission
is requested to repair and backfill existing bulkhead damaged by storm
on property located at west side of Watersedge Way, on Peconic Bay,
Southold, New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the projeot: be implemented as planned.
Because there has been a response from the Board of Southold
Town Trustees and Southold Town Conservation Advisory Council indicating
that this project would not have a significant effect to the environment.
Because there has been no response in the allotted time from the
New York StaTe Department of Environmental Conservation and the Southold
Town Building Department, it is assumed that there are no objections nor
comments from those agencies.

The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save ~iarmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
emlployees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
mis permit are being COnducted, do, by the acceptance of this permit, give consent to the Town. and

make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
:B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety an,-d general welfare of the people of the town.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by writter permission from the owner of the property if not
the same as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
ef property, the names and locations of owners of adjoining properties, end a det6iled description
of prcposed proiect. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
Io the Permit Application.)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the'
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and top~graphical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premJses in question and whether any prior licenses or permits have been issued to erect
Structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a gOvernmental agency.
G. A filing fee of $50.00 shall aCcompany the application. This filing fee includes one inspection.

H. The Town Board upon request of t~e applicant for a permit, may waive in whole or in part,
the provisions of ArHcle II, Section 97-27.subdivisions(D) and(C) where it finds thor nature of the

The decision whether to issue a permit will be based on an evaluation of
the probable impact [ncludipg cumulative impacts of the activity on the
public interest. That decision will reflect the national concern for both
protection and utilization of important resources. The benefit which
reasonably may be expected to accrue from the activity must be balanced
against its reasonably foreseeable detriments. ~11 factors which may be
relevant to the activity will be considered including the cumulative
effects thereof; among those are conservation, economics, aesthetics,
genera! environmental concerns, wetlands, cultural values, fish and
wlldiife values, flood hazards, flood plain values, land use, naviga=ion,
shoreline erosion and accretion, recreation, water supply and conservation,
water quality,.energy needs, safety, food production and, in general, the
needs and welfare of the people.

AlqD MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS NOTICE,
otherwise it will be presumed that there are no objections to the activity.
A~ty person may request, in writing to the district engineer, before this
public notic.~ expires, that a public hearing be held to collect information
necessary to consider this application. Requests for public hearings shall
state, with particularity, the reasons why a public hearing should be held.
It should be noted that information submitted by mail is considered just as
carefully in the permit decision process and bears the same weight as that
furnished at a public hearing.

Pursuant to Section 7 of the Endangered Species Act (16 U.S.Co 1531) and
based upon a reviev of the latest published version of the threatened and
endangered species listing, a preliminary determination is that the
activity under consideration will not affect those species listed or their
critical habitat.
Based upon a review of the latest published version of the National
Register of Historic Places, there are ac known sites eligible for or
included in the Register within the permit area. Presently unknown
archeological, scientific, prehistorical or historical data may be lost by
work accomplished under the required permit.
Reviews of activities pursuant to Section 404 of the Clean Water Act will
include 'application of the guidelines promulgated by the Administrator,
U.S. Environmental Protection Agency, under authority of Section 404(b) of
the Clean Water Act and the applicant will obtain a wa[er quality
certificate or waiver from the appropriate state agency in accordance with
~ection 401 of the Clean Water Act prior to a permit decision.
Pursuant to Section 307(c) of the Coastal Zone Management Act of 1972 as
amended (16 U.S.C. 1456(c)), for activities under consideration that are
located within the coastal zone of a sta:e which has a federally approved
coastal zone management program, the applicant has certified in the permi~
application that the activity complies with and will be conducted in a
manner that is consistent with the ap. proved state coastal zone management
program. By this pablic notice, we are requesting the state's concurremce
with, objection to, or waiver of the applicant's certification. No permit
decision will be made until one of these actions occur. For activities
within the coastal zone of New York State, the applicant's certification
and accompanying information is available from, and any commengs on, should
be addressed to the New York State Department of State, Division of Local

DESCRIPTION OF WORK
The applicant, Gaston Criblez, has requested Department of the Army
authorization to rep'lace a bulkhead, backfill, reconstruct a timber groin
and fill in Peconic Bay, Great Peconic Bay, Southold, Suffolk County, New
York.
The project involves the reconstruction, withi~ 18 inches of approximately
100 linear feet of timber bulkhead with twenty-five cubic yards of clean
backfill. The applicant also proposes to reconstruct (in-kind replacement)
a failing thirty-five foot single-sheathed timber groin. Approximately
360 cubic yards of clean material would be placed in the compartment between
the existing jetty to the east and the reconstructed jetty to the west.
This fill activity would be performed periodically to minimize adverse
downdrift effects by supplying sand to the littoral transport system.
The described purpose of the project is to replace the bulkhead and timber

At this time we are requesting that the Board extend the above
noted permit due to the following:
The U.S.D.O.A. had misplaced the application that
they had on file and all corre~spondence that this
office had sent them· On September 9, 1985, the app-
lication had eot received any correspondence from
N.Y.S.D.O.S. The U.S.D.O.A. has since re-published
the appropriate Public Notice, which will expire
on January 17, 1986.
2·- N.Y.S.D.E.C. has issued their permit under 10-85-0700
(copy ~nclosed)
Since the initial applications were filed in May 1985,
we have experienced storm "Gloria". With this
I have enctosed photographs taken in May 1985, and
others taken on September 25, 1985. Please note the
original photographs that show the structure in
existence in M~y when we originally applied no
N.Y.S.D.E.C. and U.S.D.O.A. Also, please note the
shed which has since washed away. In the second
set of photographs taken September 25, 1985, please
note the amoun~ of property Mr. Criblez has lost,
including the shed, and the additional damage that
has occured to the bulkhead. I understand that
very recently the Board has inspected the adjoining
property owner's property, Mr. Bujnowski, and I'm
sure that during the course of that inspection they
noticed that now no structures at all remain on
Mr. Criblez's property and there has been an add-
itional loss of property.
It is also this office's opinion that the backwashing
that has occured to Mr. Bujnowski's bulkhead is partially
due to the water entering through the area where
Mr. Cribtez's bulkhead had been situated and hence
has started to undercut his bulkhead on the Criblez's side
of his property, this I'm sure was obvious to the
Board during their site inspection.
If the Board grants this request for extension,
this office shall then submit a wetlands application
to the Board requesting the reconstruction of the
timber jetty mentioned in both the N.Y.S.D.E.C. and
U.S.D.O.A~ applications, But the most important
factor at this tim~ would be for the Board to grant
this extension so that the bulkhead can be replaced
without any further loss of property on Mr. Criblez's
part or for any more damage to occur to Mr. Bujnowsk%'s
property.
Should you, the Board or any member of the C.A,C. have any
questions or comments with regards to this request, kindly
contact this office at your convenience. Should the Board

The mouth of Cedar Beach inlet Bas to be continuously dredged to
remove dl:ifting sand that continuously ~ll~ it ini impeding navigation.
It appears that much of this sand comes from the beach to the west cf
the inlet continuously creating the s~oal that extends into the inlet
f/om the west.
This beach already has many grdns and the sand build-up on the
western ~de of these groins seems to ~pport this theory.
Any additional sand placed upon this beach wi!l probably wind up in the
Cedar Beach i~ channel where the previously lost beach most likely
already is, clo~g the channel even further.
However, additioD~l groins along this beach will probably help in
~r~r~cting the in_let channel and preserving the e~g beach as
success~y as they have for many years at other locations (ie. The
Rockaways, etc.)
If this applicant is all~wed to const/uet h~ ~roins the natural atilt will
probably replen/sh h~s beach in between bis groins to the saturation
unforturmt~ly, the placing of additional sand or fill upon the beach
would probably only eventnally cause navigational problems in the inlet.

DESCRIPTION OF WORK
The ]applicant, Ga,ston Criblez, has requested Department of the Army
authonizat~on to~ replace a bulkhead, backfill, reconstruct a timber groin
and fiql- in Peconi~r~B~Y, ~Great Peconic Bay, Southold, Suffolk County, New
York.
The, project~ inv~l~be recopstruction, within 18 inches of approximately
100 qinea~' f~et Of-~%iimber bulkhead with twenty-five cubic yards of clean
backfill. The a~i~n't also ,proposes to reconstruct (in-kind replacement)
a fa~ling ~hi~t~V~ii foot ~ingle-sheathed timber groin. Approximately
360~c~b~c.~Ods,'o~!~n mate~al would be placed in the compartment between
the e~sting~'je~ty t6 the east and the reconstructed jetty to the west.
This fill activity would be performed periodically ~o m~nimize adverse
downdrift effects by supplying sand to the littoral transport system.
The described purpose of the projec~ is to replace the bulkhead and timber
groin due to storm damage.
This ~rooosal was originally reviewed by Letter of Coordination under
Application No. 85-484-L2 but is being re-public noticed b~cause of th6
addition of fill material between the groins, as per recommendation by
the New York State Department of State Coastal Managemen% Pr6gram.
