The Department of State has completed its evaluation of your Federal Consistency.
Assessment Form and certification that the above proposed permit activity complies with
New York State's approved Coastal Management Progr, m and witl be conducted in a
manner cons/stent with this program.
Pursuant to 15 CFR Section 930.63, and based upon the project irtformation submitted, the
Depm tment of State concurs with your consistency certification. This concurrence is without
prejudice to, and does not obviate the need to obtain all other applicable licenses, permits,
and approvals required under existing State statutes.
The U.S. Army Corps of Eng/neers is being notified of this decision by copy of this letter.

Dear Ms. Long:
The Department of State received your Federal Consistency Assessment Form and
supporting information on June 7, 1995 and has determined that the submitted
documentation is adequate to commence our review of your proposed project. We will
comacr you if additional information may be necessary for consistency review purposes.
You and the Corps of Engineers will be notified of our decision when we have completed
our review of this project for its consistency with the New York State Coastal Managemem
Program. The Corps of Engineers cannot issue a permit for this project unless the
Department of State concurs with your consistency certification.

Dear Mr. Costello,
The following action was taken by the Board of Town Trustees
during its regular meeting held on June 29, 1995 regarding the
above matter:
WHEREAS, Costello Marine, on behalf of DORIS COSGROVE,
applied tothe Southold Town Trustees for a permit under the
provisions of the Wetland ordinance of the Town of Southold,
application dated April 18, 1995, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisor~ Council for their findings and
recommendations, and
WnkuREAS, a public Hearing was held by the Town Trustees with
respect to said application on June 29, 1995, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area;
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold To~-n Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the applica~ion of
DORIS COSGROVE to construct a 3' X 4Q' catwalk, a 3' X i8'
ramp and a 6' X 20' float an~ 2- 2-pile dolphins.
Permit to constr~ct project will expire two years from the date
it is signed. Fe-es must~be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law, State Environmental Quality Review and 6NYCRR Part 617,
Section 617.10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that the Southold Town Trustees, as Lead
Agency for the action described below, has determined that the
project will not have a significant effect on the environment.
Please take ~urther notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.
TYPE OF ACTION: Type I
DESCRIPTION OF ACTION: Applicant requests a Wetland Permit to
construct a 3' X 40' catwalk and 3' X 18~ ramp and a 6' X 20' float
with (2) 2-pile dolphins. Located Indian Neck Lane, Peconic.
LOCATION: SCTM ~1000-86-5-9.4.
REASONS SUPPORTING THIS DETERMINATION:
1. An on site inspection has been conducted by the Board of
Trustees.
2. An environmental assessment, submitted by the applicant and
reviewed and completed by the Board of Trustees, has i~dicated that
no significant adverse effects to the environment are likely to occur
should the project be implemented as planned.

WITH STIPEJLATIONS of the Wetland AppliCatlon of FRANK PASSARO ~-1-26
to construct 102 =/ I.f. of stone revet~nent against eroded bank and backfill
with 75 +/- c.y. of-clean sand to be trucked in from upland source. Construct
a ItE x 35' fixed walk and stairway for pedestrian access over revetment.
(Project with Clarke, Schlecht, and Wilcox)
The CAC recommends approval with the stipulation that the sand buried rocks
be planted with beachgrass and plant any backfill with non-turf buffer.

1. Construct deck 16 x 16 and 3' wide catwalk on south end of house.
2. Remove existing dolphins (approx. 25' from bulkhead|ng) and
construct a platform (~x~ and a ramp 3'x10' wide) to a floating dock 5j x 26'.
Floating dock to have 2 pilings.
3. Create an enclosure on the east side of the garage 30" wide for
garbage cans and storage.

information for this proposed project. During your review, if it is determined that a federal
permit (U.S. Army Corps of F.n~neers) is required for any portion of the proposed action,
please instruct the applicant to submit a completed Federal Consistency Assessment Form
(FCAF) and supporting information to the U.S. ACOE/NY with a copy of the information
to Ms. Diana Boos at the Department of State. Upon receipt, we will determine if the
