Dear Mr. Haje : The following action was taken by the Board of Town Trustees during their regular meeting held on February 28, 1989 regarding the above matter: WHEREAS, En-Consultants on behalf of william Corwin applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated October 6, 1988, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on February 28, 1989 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and -WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED that Eh-Consultants ON BEHALF william Corwin BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: construct wooden deck on single family dwelling, install drywells and natural plantings between lawn and wetlands. This permit will expire two years from the date it is signed if work has not commenced by said date. Fees must be paid and permit issued within six months of the date of this notification. Two inspections are required and the Trustees are to be notified upon completion of said project. This application was first received in our office July 27, 1985. The proposed project was the construction of a deck t~ attach to an existing single family dwelling. This activity is on our State Environmental Quality Review, Act (SEQR) Type 2 list, and as such was not coordinated with the Town. The Department objected to the original proposal because it did not meet the standards and development restrictions of 6 NYCRR Part 661, Tidal Wetlands Land Use Regulations. The applicant was unwilling to modi£y the proposal to come closer to meeting the standards of Part 661, which eventually led to a public hearing. The hearing was scheduled for September 1, 1988, at the Southold Town Hall, A settlement was reached before the hearing that was acceptable to both the applicant and the Department. The permit was issued November 7, 1988. Enclosed is a copy of the permit and the approved ptRn for your review. Since our permit has already been issued, and because the project is a Type 2 action, the Department cannot participate in a coordinated SEQR review of this project. If granted under Article 36. this permit does not signify in any way that the prolect will be free from flooding. There shall be no disturbance to tidal wetlands resulting from this project. 3. The cinder block/brick wall located on the north edge of patio shall not be removed or disturbed. 4. Any mateiral excavated for deck footings shall be placed on permittee's upland a minimum of 15' from tidal wetlands. 5. No construction material or debris shall enter the tidal wetlands. If any of the permit conditions are unclear,the permittee shall con- tact the Division of Regulatory Affairs at the address and telephone noted below. A copy of this permit with supplementary conditions and approved plans shall be available at the project site whenever authorized work is in progress. The permit sign enclosed with the permit or a copy of letter of approval shall be protected from the weather and posted in a con- splcuous location at the work site until completion of authorized work. At least 48 hours prior to commencement of the project, the permittee shall complete and return the top portion of the enclosed receipt form certifying that he is fully aware of and understands all provisions and conditions of this permit. Within one week of completion of the permitted work, the bottom portion of that form shall also be com- pleted and returned. For projects involving activities to be accomplished over a period of more than one year, the permittee shall notify the Regional Permit Administrator in writing at least 48 hours prior to the commencement of resumption of work each year. Ge If project design modifications take place after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modi- fications. The permittee is advised that substantial modification may require submission of a new application for permit. Ail necessary precautions shall be taken to preclude contamination of any wetlands or waterway by suspended solids, sediment, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project work. Any failure to comply precisely with all of the ~erms and conditions of this permit, unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law. (Project shown on submitted plan was recommended by the NYSDEC.) The CAC approves with the recommendation that applicant install drywells and add naaturat plantings between the lawn and wetlands. Wetland Application No, 675 of Oyster Farm Associates to dredge, enlarge, and bulkhead existing marine basin was tabled by the Council. The Council has serious reservations concerning th~"-project. Also it would like to consider the pro3ect as a whole, not segmented, other Departments may have some influence on the project as a whole. On a motion by John Tutill, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Trustees disapproval of Wetlan¢ Application No. 676 of Gus Wade to install a 65' x 8' (clear) prefabricat( steel bridge to span former underwater (now filled upland) of Trustees. Bridge to be supported by concrete vertical members at each end. Approx- imately 175 c.y. of clean sand and loam fille to be trucked in and capped with 15 c.y. of gravel to create sloped "ramps" at each end. Purpose of the bridge is to allow access to proposed house of applicant for which permission is also being requested. House will be "pedestal" type and to' have associated sanitary system, blluestone driveway, etc. All work to be as submitted plans. The CAC disapproves as it feels it is an environmentally dangerous project The Council- d~sapproves of the proposed house in the location as propo~d, Since it disapproves of the house, there is no need for the access bridge. The Council also questions the segmenting of the SEQRA process. On a motion by Bruce Loucka, seconded by John Holzapfel, it was RESOLVED to recommend to the Southotd Town Trustees approval with stipula- tions Wetland Application NO. 677 of Village Marine to construct an 8' x 40' accessory building within existmng parking area for use in equipment storage and services. Building to be located adjacent to existing structure. The CAC recommends approval with the recommendation that applicant install a pumpout station and that stipulates that appli- cant install catch basins Since servicing will be done la the build- - ing provisions must be made to prevent any seepage or runoff into adjacen~ waters. 175 Bay Avenue, Mattituck.
