Dear Mr. Magill:
wetland permit for the above captioned, please be advised that the
Trusnees have conducted an on site inspection of the premises and
it has been determined than this is a maintenance pro3ect and no
permit is required from the Board of Trustees.
The Trustees would, however, request that the cesspool be
located as far away from the Wetlands as possible, and there is
to be no disturbance of the marsh fringe.
If you have any questions, please contact this office. Thank
you for your continued cooperation in regard to this matter. We

Re: D.E.C. Notice of Complete Application
Wooden Deck - Grathwohl Road, New Suffolk
Dear Mr. Corwin:
The Trustees reviewed the above-referenced notice at their
regular meeting held on November 27, 1985. The following is
the Board's findings and determination recently rendered regarding
this matter.
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area; and
WHEREAS, The Board has considered all the documentation submitted
concerning this request; and
WHEREAS, The Board made the following findings of fact:
1. By this request, appellant requests permission to construct
a 22' x 26' wooden deck to the rear of the existing single-family
dwelling.
2. Chapter 97, Section 97-13 (A-3) all lands immediately
adjacent to a tidal wetland as defined in Section 97-13 A-3 and
lying within seventy-five (75') landward of the. most landward edge
of such a tidal wetland.
In considering this request, the Trustees find and determine:
(a) That relief requested is not substantial under the
circumstances.
(b) By allowing the request as conditionally noted below,
that there will not be any adverse affects to the wetlands.
(c) That the safety, health, welfare, comfort, convenience
and order of the Town will not be adversely affected by the
proposed request.
Accordingly, on motion made by Trustee Smith seconded by
Trustee B~edemeyer it was

Gentlemen:
Enclosed is an application for a replacement of the existing
small cesspool on the above mentioned property.
The present condition of this cesspool is deteriorating and
sinking and needs repair. We are proposing to put a modern-
type, precast 3 foot by 8 foot cesspool in the same spot.
The fill and the existing debris will be removed, except for
a small amount around the peripheral edge of the cesspool.

NOTICE OF PUBLIC HEARING
APPLICANT: WILLIAM CORWIN, 8 Randolph Avenue, Min~ Hill, Dover,
New Jersey 07801. (DEC Application No, 10-85-0870).
PROJ!ECT: The Applicant proposes to construct a 22 ft. by 26 ft.
~deck to the rear of an existing single-family dwelling. A
variance is requested from the 75 foot setback requirement, to
construct the deck within 18 ft. of tidal wetlands. The project
is located 200 ft. west of Grathwohl Road, approximately 200 ft.
north of New Suffolk Avenue~ in New Suffolk, Town of Southold,
Suffolk County.
PERMIT REQUIRED: Permit pursuant to Environmental Conservation
Law (,ECL") Article 25 (Tidal Wetlands) and Title 6 of the
Official Compilation of Codes, Rules and Regulations of the State
of New York ("6 NYCRR") Part 661 (Tidal Wetlands).
SEQR STATUS: Pursuant to the State Environmental Quality Review
Act ("SEQR", ECL Article 8) and 6 NYCRR Part 617 (SEQR), the
Department determined that the proposed Project will not have a
significant effect on the environment and accordingly no
environmental impact statement was required.
PUBLIC HEARING: An adjudicatory public hearing will be held on
SEPTEMBER 1, 1988 at 10:00 A.M. in the SOUTHOLD TOWN HALL, 53095
MAIN ROAD, SOUTHOLD, NEW YORK. The hearing will be conducted
pursuant to the procedures in 6 NYCRR Part 624 (Permit Hearing
Procedures). Written statements from persons who do not request
party status may be filed before or at the hearing and will be
made part of the official file. Persons who do not request party
status may present unsworn oral statements concerning the proposed
Progect at the beginning of the hearing.
FILING FOR PARTY STATUS: Party status to participate in the
adjudicatory public hearing will be accorded ONLY to those persons
who can provide a clear demonstration of social, economic or
environmental interests which are likely to be affected by the
proposed Project. All persons, groups, corporations or agencies
desiring party status must file a specifi~ statement in writing in
accordance with 6 NYCRR Section 624.4 containing precise grounds
~for opposition, support or interest in the Project, includin~-<~he
nature of arguments and evidence which the person intends to
present at the hearing and any other matters believed relevant.

During excavation the fill must be contained so that it
does not wash into the creek.
Care should be taken so as to preclude the entry of
any construction material into the adjacent waters.
Immediately following construction, all areas of
exposed soil shall be properly protected with suitable
erosion control devices and/or vegetated to prevent entry of
soil into the creek.
