The permitted site or facility, including relevant records, is subject to in-
spection at reasonable hours and intervals by an authorized representative of
the Deparl~ent of Env ro~.ental Conservation (the Deparb~ent) to determine
whether the permittee is cu~plying with this permit and the yr'J. Such represen-I

Changes and Pere~ls
The Depar~,~'ent reserves the right to rmdify, suspend or revoke this permit when:
a} the scope of the permitted activity is exceeded or a violation of any
condition of the permit or provisions of the ECL and pertinent regula-
tions is found;
b) the permit v~s obtained by misrepresentation or failure to disclose
relevant facts;
c) ne~vmaterial inforrration's discovered; or
d) enviro.~untal conditions, re event technology, or applicable la~v or
regular ion have material ly changed since the permit was issued.
The permittee rmst subnit a separate written application to the Department for
rene~l, rrodification or transfer of this permit. Such applicationrrust include
any fora's, fees or supplurental infornution the Deparb~unt requires. Any
renewal, rmdification or transfer granted by theDeparu~unt trust be inwriting.
The permittee n'ust sub'nit a renewal application at least:
a) 180 days before expiration of permits for State Poi utant Discharge
El iminet ion System (SR~ES), Hazardous V~ste Management Facilit les
(PCt.), rraior Air Poi ution Control (APC) and Solid W~ste ManagaT~nt
Facilities (EVl;~/F); and
b} 30 days before expiration of all other permit types.
Unless expressly provided for by the Depar~unt, issuance of this permit does
not rmdify, supersede or rescind any order or determination perviously issued by
the Departrr~nt or any of the tenTs, conditions or requirm'ents contained in such
order or determination.

Legal Cbligations of Permittee
The permittee has accepted expressly, by the execution of the application, the
full legal responsibi ity for all d~uges, direct or indirect, of v~atever
nature and by vJ-~rrever suffered, arising out of the project described in this
permit and has agreed to indumify and save harmless the State from suits.

SPECIAL CONDITIONS
Any debris or excess material from construction of this
project shall be completely removed from the. adjacent area
(upland) and removed to an approved upland area for
disposal. No debris is permitted in tidal wetlands and or
protected buffer areas..
Ail areas of soil disturbance resulting from this project
shall be stabilized immediately following project completion
or prior to permit expiration, whichever comes first. The
approved methodologies are as follows:
stabilization of the entire disturbed area with appropriate
vegetation Beach Grass on 12 inch centers.
Ce
Temporarily stabilized with straw or hay mulch or jute
matting or other similar natural fiber matting within 1 week
of final grading. Temporary stabilization shall be
maintained until a mature vegetative cover is established.
There shall be no discharge of runoff or other effluent on
in or down the bluff face or onto the beach.
No concrete is to be used as a result of this project
without Department approval.

Dear Albert:
Enclosed please find a portion of tax map 044, a copy of the current deed and
photographs of property I own on Long Island Sound. The property is identified on the
county tax map as number 1000-044-1-16. The structure on the property consists of a
shack used primarily for storage, the existing pile foundation was washed from under
the shack during the Christmas Eve storm.
Ldesire to reinstall the structure, on piles, in it's previous location. Will a town wetlands
permit be required to reinstall the structure? The property has been in my family since
1925 and there is no survey currently available for this property. Will a survey be
required if I am required to obtain a wetlands permit?
[ am tentatively planning to do any work on the su-ucture when the property owner to the
west undertakes repairs to his house.
Please contact me with instructions on how I will be allowed to proceed with repairs to
the existing shack.
