All obstructions which might in any manner interfere with the erecting of the fence or gates
shall be removed by the Purchaser, prior to the commencing of the work. The price quoted in
this estimate is based upon normal erecting conditions. If, however, it s necessary to drill
ledge rock for setting posts, or to make special provisions for setting fence in swampy or soft
ground, or to perform any additional work not covered by this contract, a reasonble charge
is to be made to the Purchaser for such work or special construction as an extra. Unless other-
wise provided, the fence is to follow the existing ground lines. If grading or filling of the

3. The Town Trustees will pay for and install a fence which will
be to Mrs. Cook's satisfaction. (Please discuss the details of

will not be conveyed to anyone. Therefore, if should not be shown

Gentlemen:
I represent Ruth Emerson Cooke and Ruth Emerson Wortis as well as
other property owners with land adjacent to the end of South
Harbor Road and running southerly and westerly along Richmond
Creek. Over a period of time discussions have been held with
reference to conveying part of the Emerson-Cook property to the
Town Trustees, ~n exchange for the conveying a strip of property
at the east end of Richmond Creek to Mrs. Wortis. The property
which would be conveyed to Mrs. Wortis as well as to the Town
Trustees is shown on the map of "South Harbor" dated May 6th, 1987
as prepared by Roderick Van Tuyl. A print of the map is
enclosed.
In connection with this excbange my clients understand:
1o That the Trustees will communicate in writing with Town
officials the need to contain storm water run off in catch basins
in order to protect the property being conveyed to the Trustees as
well as that being conveyed to my clients. We would appreciate
receiving copies of all correspondence with the Town an~ also
request that you confirm this matter will be actively pursued by
the TrUstees.
2. That from time to time the Trustees will petition for the
continuing dredging of Richmond Creek Inlet and in particular as
it effects the property being conveyed both to the Trustees and
Mrs. WOrtis.
It is our understanding that the Trustees, in conjunction With the
Southold Park District, will have a fence erected along the
westerly line of the Trustees property and thence running along

Richmond Creek, opposite the end of South Harbor Road, belonged to
Bayside Farm from 1912 (Liber 573, page 135)
--that it was wi%h permission of the owners of Bayside Farm
that s~nd-fill from the dredging of Rice, end Creek in 1959 was used
to connect the en~ of SouthHarbor Road with Mort Island, providing
access from the road to the bay and the main ch~.~el into Richmond
Creek, which h~s been available by permissiom of Bayside Farm for
twenty-five years
~that owners of land abutting the old North Channel have
been granted Qmit Claims hy the Town Trustees to the-end that these
owners gai~ed clear claim to the beach im front of their property
to the high tide mark
~that Bayside Farm owners are in the process of working out
an agreement with~euthold Park District whereby they will have title
to the beach in front of Terry, Clover, Griswold Park (So, th Harbor Head)
we now therefore Wish to request a Quit Claim from the Town Trustees to
that area of beach: which lies over the Eorth Channel the length of the
north shore of Mo~ Ista~d, for She purpose of clarifying ownership of
the two portions o~ beach - that which will belong to the Park District
and that which wiI1 continue to ~elong to Bayside Farm, which iS is
planned ~o lease t~ the Park District.
We hope that it will be possible for the Trustees to review the above
five points before your August 30 Trustee Meeting. We expect to bring
to that meeting a survey of the beach which is now being prepared.
