Building and zoning ordinances and regulations of the municipality in which the premises are situate. b. Covenants, restrictions and easements, if any, of record which are now in force. c. All taxes and assessments, if any, becoming a lien after the date hereof. d. If situated in an incorporated village, such village taxes or assessments, if any, as the village may be able to establish thereon. e. Any state of facts an accurate survey may show. f. Any public easement or easement granted to any public utilities. g. Existing tenancies, if any. h. The trust fund provisions of Section 13 of the Lien Law. The party of the second port covenants and agrees that the party of the second part has made an independent investigation of the premises hereby conveyed and of the title and interest of the party of the first part therein,and agrees that no representations have been made by the party of the first part to induce this sale, and that the party of the second port relies solely upon the said independent investigation so made, and that all agreements are merged in this deed. The word "party"shall be construed as if it read "parties"whenever the sense of this inden- ture so requires.
