In reference to your letter of December 21, 1992 this office has
conducted an inspection of permit #654-888-70-6-31 on January
15, 1993 and find that the aforementioned bulkhead construction
is in compliance with the permit.
Other than the New York State Department of Environmental
Conservation, we are unaware of any other governmental permits
required for this structure and would consider paragraph 9
automatically met by their approval.

A. This application to be completely filled in by typewriter or in ink:and submitted to fhe Town Trustees in dup-

B. Plot plan showing location of lot and buildings on premises, relation to adjoining premises, public streets,

C. The work covered by this application may not be commenced before the issuance of a permit.
D. Upon approval of this application, Town Trustees will_issue a permit to applicant. Such permit shall be kept
on the premises and available for inspection at all times.
E. Applicant shall notify the Board of Trustees upon completion of the work covered by permit.

SUPPLEMENTARY SPECIAL CONDITIONS
The following conditions apply to all permits :
A. If any of the permit conditions are unclear ,the permittee shall con-
tact the Division of Regulatory Affairs at the address and telephone
noted below.
B. A copy of this permit or approval and supplementary conditions shall
be •available at the project site whenever authorized work is in
Progress:

C. The permit sign enclosed with the permit or a copy of letter of
approval shall be protected from the weather and posted in a con-
spicuous location at the work site until completion of authorized work.
D. At least 48 hours prior to commencement of the project, the permittee
shall complete and return the top portion of the enclosed receipt form
certifying that he is fully aware of and understands all provisions and
conditions of this permit . Within one week of completion of the
permitted work, the bottom portion of that form shall also be com-
pleted and returned.
E. For projects involving, activities to be accomplished over a period of
more than one year, the permittee shall notify, the Regional Permit
Administrator in writing at least 48 hours prior to the comment
of resumption of work each year. ement
F. If project design modifications take place after permit issuance, the
permittee shall submit the appropriate plan changes for approval by
the Regional Permit Administrator prior to undertaking any such modi-
fications. The permittee is advised that substantial modification
may require submission of a new application for permit .
G. All necessary precautions shall be taken to preclude contamination of
any wetlands or waterway by suspended solids, sediment, fuels,
solvents, lubricants, epoxy coatings, paints, concrete, leachate or
any other environmentally deleterious materials associated with the
project work.
H. Any failure to comply precisely with all of the terms and conditions
Of this, permit, unless authorized in writing, shall be treated as a
violation of the Environmental Conservation Law.
I . The permittee is advised to obtain any permits or approvals that may
be required from the U.S. Department of Army Corps of Engineers, NY
District-, 26 Federal Plaza, New York , NY 10278, (Attention: Regulatory
Functions Branch) , prior to commencement of work' authorized herein.
J. The granting of this permit does riot relieve the permittee of the
responsibility of obtaining a grant, easement, or other necessary
approval from the Division of Land Utilization, Office of General
Services, Tower Building, Empire State Plaza, Albany, NY 12242, which
may be required for any encroachment upon State-owned lands underwater .

I am .writing this letter at the suggestion of Jill Doherty
of your office.
The Town Trustees issued Permit No. 654-8-88-70-6-31, dated
October 28, 1988 (a copy of which is enclosed) to the late
' Harold W. Conroy, for the construction of a new bulkhead at the
above premises.
Our client, Mrs. Ruth Conroy (the widow of Harold Conroy) ,
has entered into a contract to sell those premises. The
purchasers" lawyer is rather meticulous and has asked for
confirmation that the conditions set forth in paragraphs 4 and 9
of the Terms and Conditions of the permit have been satisfied.
Might I impose upon your office for a letter to that effect?
We received a similar statement from the New York State
Department of Environmental Conservation, who also had issued a
permit for the bulkhead, confirming that the bulkhead complied in
all respects with their permit.

PROJECT DESCRIPTION
JOCKEY CREEK SPOIL AREA
LOCATION AND DESCRIPTION OF HABITAT:
The Jockey Creek Spoil Area is located at the- mouth`of jockey
Creek .just north of the Great Hog Neck on Shelter Island Sound in
the Town of Southold , Suffolk County (7.5 ' Quadrangle: Southold'
NY) . The fish and wildlife habitat is an approximately 10' acre
sand spit and dredge spoil island in the mouth of a' tidal creek .
There is heavy residential and marina development in the creek and
consequent pollution, mostly from runoff.
FISH AND WILDLIFE VALUES:
The sand spit and dredge -spoil island is not a rare ecosystem type
but the area has served for the last three years as a nesting site
for least terns (E) and piping plover' (T) Small numbers ofthese
birds nested here in 1983 and 1984 . An estimated 15 pairs of
. least terns and two pairs of piping plover nested in 1985.- There
are no significant human use activities associated w' th the fish
and wildlife resources at. the jockey .Creek Spoil Area.
IMPAC^l ASSESSNENL:
Nesting shorebird species are highly vulnerable to disturbance by
humans from mid-April through July. Significant recreational use
(e .g . boat landing , hiking, picnick4ng, 'four wheel drive vehicle
use) in or near bird nesting areas should be minimized during this
period . Fencing and/or annual posting of the area should be
provided to help protect the nesting bird species. Unregulated
dredge spoil disposal in this area would be detrimental , but such
activities may be, designed to maintain or improve the habitat, by
setting back vegetative succession. Introduction or attraction of
mamalian predators to ,the area would also be detrimental to the
populations of nesting birds.

Dear Sirs:
On behalfof my client, Mr. Harold W. Conroy of Lighthouse Lane, Southold,I
am filing an application to construct a timber bulkhead within 18" in front
of the existing bulkhead which has deteriorated to a point where it is not
repairable.
The new bulkhead will be on the property of Mr. Conroy and will be set back
approximately 27' 6" on the east side and 18' on the west side from the ad-
joining bulkheads.
By constructing the new bulkhead in front of the existing:bulkhead it will
prevent further erosion of the bank into Jockey Creek while the construction
is in process. The new bulkhead will utilize the existing deadman system.
The existing bulkhead is registered with the Town of Southold under Permit #216.
It is respectfully requested that a waiver be granted to the existing town law
Chapter 97 to permit us to proceed as outlined in this letter, the application,
the drawings and maps included.
If any further information is required I will endeavor to supply it or I will be
glad to appear before the Board of Town Trustees to discuss this request.

We received your request (Application No. 88-1445-L2) to replace
within 18 inches 156 linear feet of timber bulkhead with attendant
backfill in Jockey Creek, Shelter Island Sound at Town of Southold,
Suffolk County, New York.
Our review indicates an individual project-specific permit is not
required. Based upon the material and information you,have submitted
it appears the activities within our jurisdiction could be accomplished
under an existing Department of the Army nationwide general permit. The
-nationwide general permit is prescribed at Title 33 of the Code of
Federal Regulations.- A Copy of this part Of the Federal Regulations -
,Part 330.5 (a) (3) is enclosed with the appropriate section marked for
your convenience. The work may be performed without further contact
with our office, provided the enclosed permit conditions are adhered
to.
Your attention is specifically directed to the conditions of the
nationwide general permit and the recommended construction management
practices. These items are highlighted on the enclosed copy of the
Federal Regulations. The management practices are to be followed to
the maximum extent practicable. Care should be taken so that
construction materials, including debris, do not enter any waterway to
become a drift or pollution hazard.
You are to contact appropriate State and local government
officials to ensure that the subject work is performed in compliance
with their requirements. In order for this nationwide permit to be in
effect for your proposal, it is required that you obtain a Water
Quality Certification from the New York State Department of
Environmental Conservation if your proposal contains any fill
activities, as well as any other required permits. Failure to do so
may subject you to enforcement action under State and/or Federal Law.

face of old sheathing to face of new sheathing ( 18" maximum) .
