Gentlemen:
Referring to my istter of june ~ and your
reply of J~ly l~th referring me to the Town Police
er Highway Dept. may I again state that I am only
interested i~ ascertaiDd~ag where the hi~l~watermark
is on Bayview Ave. and whether or not the owner of
the property facing ~ttituck Creek at that point has
a~y legal right to erect a fence a~d sign prohibiting
access to la~d that for many years was %u~der water
until the Commty dredged the creek a~d built up the
shore so that the high water is around 125 feet from
where it was previously.
For many years a number of the residents
cf BhoreAcres moored their rwoboats in a lagoon that
was at the foot of Bayvie~ ~ve. and spread to the
properties en bots sides of the ~venue ~ud was about
125 feet from the present water line. This was la~d in
the public Domain and I assume ~hat notwithstandi~§ the
fact that the County filled it in th~ land is still
of that chs~acter and under the jurisdiction of some
governmental body and does no~ become the property
of the abutting property owner. So if you still feel
~kat this is not your concer~ wilt you Dlease advise
me as to who had ~urisdiction before dredging or wh~t
authority I can contact as i am not concerned with the
avenue or policing i~ ~ way but the right to %ravel
on what has always been, 5~ ~ mind~ public lands.
