We would,like to offer the following comments: The Division of Coastal Resources has no objection to the Town of Southold acting as lead agent. The appl/cant states that the proposed project will have no effect on tidal wetlands because, "(a)lthough Spartina patens is present landward of the bulkhead, it is not "tidal wetlands" but more typical of a "dune" in that it does not receive regular tidal inundation." High marsh of salt marsh tidal wetlands constitute an extensive zone of the salt marshes that receives only occasional tidal flooding coincident with extreme lunar tides and occasional storms. The normal uppermost tidal wetland zone, high marsh, is usually dominated by salt meadow grass, Spartina patens. Therefore, it appears that the area to be filled does constitute tidal wetlands. From the photographs provided by the applicant in his application for coastal consistency concurrence, it appears that the bulkhead to be replaced is a non- functional bulkhead that has either never been backfilled or has-had the fill material washed away long ago. Therefore. the ordy apparent function of the bulkhead~is to provide access to navigable waters. Since there are alternative means of providing such access, it would be more consistent with the Coastal Management Program to remove the existing bulkhead, restore the wetlands to a state similar to the surrounding wetlands areas, and construct a walkway and floating dock to provide access to navigable waters.
