The following action was taken by the Board of Town Trustees
during its regular meeting held on December 22, 1994 regarding
the above matter:
WHEREAS, En-Consultants Inc. on behalf of PATRICK COLAGUIRU
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated September 19, 1994, and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, Rnd
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on December 22, 1994 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members
familiar with the premises
and,
have personally viewed and are
in question and the surrounding area,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the

The Department of State has rewewed the material that you forwarded regarding the
proposed, project/activity referred to above.
We would,like to offer the following comments:
The Division of Coastal Resources has no objection to the Town of Southold
acting as lead agent.
The appl/cant states that the proposed project will have no effect on tidal
wetlands because, "(a)lthough Spartina patens is present landward of the
bulkhead, it is not "tidal wetlands" but more typical of a "dune" in that it does
not receive regular tidal inundation." High marsh of salt marsh tidal wetlands
constitute an extensive zone of the salt marshes that receives only occasional
tidal flooding coincident with extreme lunar tides and occasional storms. The
normal uppermost tidal wetland zone, high marsh, is usually dominated by salt
meadow grass, Spartina patens. Therefore, it appears that the area to be
filled does constitute tidal wetlands.
From the photographs provided by the applicant in his application for coastal
consistency concurrence, it appears that the bulkhead to be replaced is a non-
functional bulkhead that has either never been backfilled or has-had the fill
material washed away long ago. Therefore. the ordy apparent function of the
bulkhead~is to provide access to navigable waters. Since there are alternative
means of providing such access, it would be more consistent with the Coastal
Management Program to remove the existing bulkhead, restore the wetlands
to a state similar to the surrounding wetlands areas, and construct a walkway
and floating dock to provide access to navigable waters.

The Departmem of State has been informed by the U.S. Army Corps of Engineers that the
project has been authorized under an existing Nationwide Permit. Therefore, no further
review ~s required by this Department.

WITH STIPULATIONS of the Wetland Application of MICHAEL LEAHY
to construct an addition of 20' x 24.8'; 2 story addition to existing 2 1/2
story house; addition of rear dormer at upper floors of existing house;
addition of 15' x 42.7' deck at back of house; construction of dock.
The Council recommends approval with the following conditions:
1. Dock - The Council approves the original configuration on the plan
submitted 9/15/9L~ as ~t ~s a more appropriate configuration for the dock.
The CAC cannot support a 110' walkway.
2. Wood Deck - The CAC recommends approval
3. Conservatory or greenhouse - The CAC recommends approval

south side; construct 85' retaining wall 2~,5" above grade; repair 56' of
bulkhead; construct 30' x 4' fixed dock; use approximately 100 c.y. of fill
from an upland source.
The CAC recommends approval of the 116' and 60' bulkhead. The
Council recommends disapproval of the 56' bulkhead. The 56' bulkhead is not
