lowing:
1. Th~ the said Board of Tmsteas and the Town of Southold are released from any and
aH damages, or daims fo~ damages, of ~ arising directly or indirectly as a result of any oper-
ation performed pursuant m this permit, and the said Permit-tee will, at his o~ her own expeme,
defend any and all such suits initiated by third partier, and the said Permittee assumes full liability
with respec~ thereto, to the complete exclusion of the Board of Trustees of the Tow~ of Southold
2. That this Permit i~ valid for a period of 24 mo~. which is comidered co be the
estimated time required to complete the work involved, but should dro~m~unce~ warrant, request
for an extension may be made to the Board at a later date
5. That this Permit should be retained indefinitely, or as long as the said Permittee wi~hes
to maintain the structure or project involved, to provide evidence to anyone concerned that auth-
orizarion was originally obtained.
4. That the work involved will be subjec~ to the inspection and approval of the Board or
ks agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by re~olution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6, That there shall be no interference with the right of the public to pass and repass along
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or aitaration~
in the location of the work herelu authorized, or if, in the opinlan of the Board of Tea~ees, the
work shall cause unreasonable obstrucuon to free navigation, the said Permittee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
8. That the said Board will be notified by the Permittee or the completion of the work anth-
nrlzed.
9. That the Permittee will obtain all other permks and consents tt~t may I~ required
plemental to this permit which may be subject to revoke upon failure to obr*;- same.

Dear Sir:
The ZBA has approved a variance in this case which permits a
larger "envelope" for the deck than was applied for in the
waiver issued by the Trustees, and includes provision for a
hot tub within the deck area. A copy of the ZBA determination
is enclosed.
Please amend the waiver granted at the 3/26/92 Trustee meeting
to provide for a deck of up to 15' x 67' with a hot tub, as
shown on the enclosed "Project Plan" dated Rev 7/2/92.

Upon application of THOMAS E. COFFIN. Variance to the
Zoning Ordinance, Article XXIII, Section 100-239.4B for
permission to construct addition within 75 feet of the existing
bulkhead. This parcel contains a total lot area of 19,985 sq.
ft. and is located in the R-40 Zone District. Location of
Property: 305 Gull Pond Lane, Greenport, NY; County Tax Map
Parcel No. 1000-35-4-5 (now 28.25); also known as Lot 10, Map of
Fordham Acres, Section One.
WHEREAS, a public hearing was held on June 4, 1992, and at
said hearing, all those who desired to be heard were heard and
their testimony recorded;
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application;
WHEREAS, Board Members have personally viewed and are
familiar with the premises in question, its present zoning,
the surrounding areas; and
and
WHEREAS, the Board made the following findings of fact:
1. By this application, appellant seeks a variance under
Article XXIII, Section 100-239.4B for a 15' deep by 67' wide open
deck with hot tub as shown on the August 18, 1976 survey map
prepared by Roderick VanTuyl, P.C., amended May 11, 1992, to be
located at the rear (easterly) section of the existing
single-family dwelling. Inclusive of all step areas, the setback
of the addition is proposed to be 43 feet from the inside of the
existing bulkhead.
2. The subject premises in question is identified on the
Suffolk County Tax Maps as District 1000, Section 35, Block 4,
Lot 28.25 and is identified on the Map of Fordh~m Acres, Section
One, as Lot No. 10. This property has a frontage of 100 feet
along the easterly side of Gull Pond Lane and has a nonconforming
lot area shown on the survey map to be 19,955 sq. ft.
3. The setback distances of the dwelling as exist areshown
to be 58 feet from the existing bulkhead at ordinary high water

mark, 14-1/2 feet to the northerly side property line, 15 feet to
the southerly property line, and 100 feet to the front property
line along Gull Pond Lane (all at their closest points). The
square footage of the house as exists per assessment records is
approximately 1460 sq. ft. of living floor area, plus 650 sq. ft.
of garage area.
4. Article XXIII, Section 100-239.4B of the Zoning Code
requires all buildings and structures located on lots upon which
a bulkhead, concrete wall, rip-rap or similar structure exists
and which is adjacent to tidal water bodies other than the Long
Island Sound to be set back not less than seve~ty-five (75) feet
from the bulkhead.
5. The amount of relief requested by this application is a
variance of 15 feet for all new construction in this project, or
20% from the established setback.
6. In viewing the area it is noted that at least one
neighbor has construction (accessory building) built very close
to the bulkhead. It is also noted that a deck is not made of a
substantial construction and will not be adverse To the immediate
land area or cause pollution to the waterway.
7. In considering this application, the Board finds:
(a) the relief as requested is not substantial in
relation to the setbacks which have existed previously to this
zoning requirement;
(b) the relief as requested is not the minimum
necessary to afford relief;
(c) the relief as alternatively granted will not alter
the essential character of the neighborhood;
(d) the practical difficulties are uniquely related to
the property and are not personal;
(e) the relief, as alternatively granted, will not an
turn be adverse to the safety, health, welfare, comfort,
convenience or order of the town, or be adverse to neighboring
properties;
(f) in view of all the abovet the interests of justice
will be served by granting the relief as alternatively and
conditionally noted below.

CONDITIONS:
1. No permanent cover or enclosure of the deck;
2. Lighting, if any, must be shielded to the property so as
to prevent disburbing glare to other properties.
2. That the deck, inclusive of step areas, shall not be
closer than 43 feet to the outside of the bulkhead;
3. In interpreting Section 100-239.4B of the current zoning
code, any structural enlargement or expansion within this reduced
setback from the bulkhead, or other nonconforming yard areas,
will require further application to and approval by this Board
{unless legislative approval is enacted to exempt same).

during its regular meeting held on Marck 22, 1990 regarding the
above matter:
WHEREAS, Glen Just on behalf of Thomas Coffin applied to the Southold
Town TrusEees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated January 22, 1990
and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on March 22, 1990 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT GLEN JUST ON BEHALF OF THOMAS COFFIN BE AND HEREBY IS
GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
Install 4 X 40' floating dock along an existing timber bulkhead, and
to maintenance dredge a 10' X 60' area of dredged canal to 4' at
MLW. Approximately 90 c.y. of spoil to be trucked to an upland
disposal site.
This permit will expire two years from the date it is signed if
work has not comz~enced by said date. Fees must be paid, if
applicable, and permit issued within six months of the date of'this
notification. Two inspections are required and the Trustees are to
be notified upon completion of said project.
Please return to the Building Department for a determination on
the need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for

The decision whether to issue a permit will be based on an evaluation
of the probable impact, including cumulative impacts, of the activity
on the public interest. That decision will reflect the national
concern for both protection and utilization of important resources.
The benefits which reasonably may be expected to accrue from the
activity must be balanced against its reasonably foreseeable
detriments. All factors which may be relevant to the activity will be
considered including the cumulative effects thereof; among those are
conservation, economics, aesthetics, general environmental concerns,
wetlands, cultural values, land use, navigation, shoreline erosion and
accretion, recreation, water supply and conservation, water quality,
energy needs, safety, food production and, in general, the needs and
welfare of the people.
The Corps of Engineers is soliciting comments from the public; Federal,
state, and local agencies~ ~nd officials; Indian Tribes; and other
interested parties in order GO consider and evaluate the impacts of
this proposed activity. Any comments received will be considered by
the Corps of Engineers'.to determine whether to issue, modify, condition

~' x 16' hinged ramp secured to drest of bank by two 4" posts; and a 6' x 20'
float secured by two 8" diameter pilings.
The CAC disapproves the construction of 215 I.f. of timber retaining wall at or
above the line of MHW. The Council feels this is actually bulkheading and
suggest the applicant plant native vegetation to stabilize the beach and bluff.
Regarding the construction of the single family dwelling with garage, deck, drive-
way, well and sanitary system the CAC feels the applicant move the house back
so there will be no disturbance within 75', i.e. trucks clearing the area for work.
All work should be at least 75' away.
