February 23, 1993
Recommendation of Wetland Applications
The following recommendations were passed by the Conservation Advisory
Council at-,its February meeting:
On a motion by John Holzapfel, seconded by Stephen Angell, it was
RESOLVED to recommend to the Southold Town Trustees disapproval
of Wetland Application No. 119-1-18 of Laurence and Diane Nieblin9
to construct a bulkhead and gazebo.
The CAC recommends disapproval of the bulkhead because no need
is shown. The house and bluff are not endangered, the bluff is following
the natural process.
The Council suggests the gazebo be located in a more landward site
or on pilings.

Motion carried.
On a motion by Bruce Loucka, seconded by Robert Keith, it was

Vote of Council:

The project is too close to the wetlands.
The project is too close to the beach.
The property is too small for a house, cesspools, etc.
The bulkhead' is too high.
The plan is not accurate. (As shown on the plan, at present
the retaining wall.would be in the water at high tide.
The CAC does not feel that bulkheads should be on the Sound.

On a motion by John Holzapfel, seconded by Bruce Loucka, it was
RESOLVED to recommend to the Southold Town Trustees approval with
stipulations of Wetland Application No. 35-5-17 of Joseph and Dorothea
Geraci to construct a 6' x 6' cantilever platform attached to existing
bulkhead with a 3' x 15' ramp leading to a new 6' x 50' floating dock,,
and to install three (3) 25' long pilings to secure float.
The Counci. I recommends approval provided the applicant leaves a third
(1/3) of the waterway reserved as "open water", that is, the float
and boat must not take up more than one-third (I/3) of the waterway.
This would leave the waterway open for navigation.

On a motion by Stephen Angell, seconded by Robert Keith, it was
RESOLVED to recommend to the Southold Town Trustees approval with
conditions of Wetland Application No. 114-7-13 of Leonard and Donna
Schie~lal to construct a 6' x 95' fixed dock elevated a minimum of 3.5'
over grade, a 3' x 20' ramp and a 6' x 60' float.
The Council recommends approval provided the catwalk (not fixed dock)
is reduced to 4' width.

Wetl'and Application No. 37-5-6 of Charles and Rosemary Luscher to

On a motion by Stephen Angell, seconded by Bruce Loucka, it was
RESOVLED to recommend to the Southold Town Trustees disapproval
of Wetland Application No. 56-5-28 of Robert Cockeril to instal a 6'
x 15' float with a 3' x 10' ramp.
The Council recommends disapproval of the project because of the policy
of only 4 boats to property, otherwise it creates a "marina". The property
is zoned "R" which does not permit marinas.

On a motion by Bruce Lot]cka, seconded by John Haggerty, it was
RESOLVED to recommend to the Southold Town Trustees disapproval
of Wetland Application No. 99-3-9.3 to construct a retaining; regrade
bluff; and replace or repair stairs.
The Council recommends disapproval of the" retaining wall because no
need is shown, the property is not in danger. The Council has no
objection to the stairs being rebuilt or the bluff restored.

Request for Additional Information
Dear Ms. Lachenmeyer:
Pursuant to 15 CFR 930.58, the following data and information is necessary
to enable the Department of State to adequately assess the coastal zone effects
of this proposed project.
The submitted Federal Consistency Assessment Form did not include a
~ignature. Please forward another form that has been signed and
dated.
The proposed float appears ~o lie (along its landward edge) in less
than one foot of water at mean low water as well as adjacent to the
fringe of SDartina alterniflora a~ the site. The float/ramp assembly
should be extended perhaps about five feet so that the likelihood of
disturbance revise the plan to show that the float has been placed
further waterward.
Pursuant to 15 CFR 930o60(a), the review of your consistency certification
will begin after we receive and determine that the necessary data and
information is adequate to assess coastal zone effects.
Any additional information which you believe will facilitate our
consistency review of this project would be appreciated.
Ms. Tanya Lachenmeyer
