As per our conversation the other day, I have enclosed an amended survey of our property in Cutchogue showing the previously approved dock and walkway, permit number 4542. The dock and walkway have not yet been built. The new position of the dock and waikw_ay is located parallel to the original position and northerly about 45 feet so that the water is deep enough for my boat at low tide. The construction of the dock and walkway will be the same as previously submitted. Please contact me if you need further information or documentation. Thanks for your help. Ceady November 10, 1995 ATTACHMENT TO FEDERAL CONSISTENCY ASSESSMENT FORM Policy 7 The proposed activity has been designed to result in little or no impact on significant coastal fish and wildlife habitats, eg. the elevated timber walkway and floating dock. Policy 11 The proposed activity has been sited fo minimize damage fo property and the endangering of human lives caused by flooding and erosion, eg. the proposed first floor elevation of 12.0 of the house is above the required toot elevation. Policy 12 The proposed activity has been designed to minimize damage to natural resources and property from flooding and erosion by protecting natural protective features. The existing tidal wetlands will 1oe essentially undisturbed by maintaining a 50' buffer (no fill), 75' minimum setback to all structures, and construction of the elevated timber walkway and floating dock. Policy 17 Non-structural measures are proposed fo minimize damage to natural resources and property from flooding and erosion, eg. setbacks to structures and setting the first floor of the house above the base flood elevation, Policy 44 The proposed activity has been designed to preserve and protect the tidal wetlands and ta preserve the benefits dedved from these areas. A tidal wetlands permit has been obtained from the New York State Department of Environmental Conservation. A tidal wetlands permit is pending fram the Town of Southold Board of Trustees. To protect the values of the tidal wetlands, a permanent Vegetated buffer zone shall be established. Letter tO Albert Kraps~ November t, 1995 Page 2 Sanitam, Waste/Stormwater Runoff: We are concerned with the proposed sanitary system with respect to the shallow depth to groundWater which exists at the site, which may hinder the operation of a sanitary system. Dimi~ tremment of wastewater can result in increased, bacteriological, virological, and nitrogen (and Phosphorus) loading to groundwater and/or surface water. Our concerns with the proposed sanitary system are magnified by the shallow depth to groundwater and the proximity of the proposed project to surface waters. The mu'face waters of this area~are stressed by stormwater mnoff and septic system effluent pollution contribution created by past andpresent development pressure; In g.ene.ral, septic systems near surface waters can result not only irt increaSed bacteriological and virological conmmlnation, but also in elevated BOD, solids, and nutrient (nitrogen and phosphorus) loading to surface waters. Such loading could result in adverse effects on a surface water ecosystem and, ultimately, in the accelerated pollution and/or euttopbAcation of the system. In addition, a reduced leaching pool setback could result m an increaSed risk of channelling of septic system effluent flow into a surface water as well as a stormwater nmoff risk in the event of septic SYstem failure. Thus, any project which may have an adverse impact on these surface waters deserves close scrutiny to examine measures to mitigate the potential adverse impacts to the max/mum practicable extent. In the case of the proposed project, this scrutiny should extend to an evaluation of impacts of stormwater nmoff and septic system effluent on on-site and neighboa'ing wetlands and natural resources in addition to groundwater and surface water. The loss of vegetation, wildlife habitat. and open space should also be carefully assessed (, as should any available hydrogeologic and surface water quality data. NATURAL RESOI~RCES: The SCDHS fully supports all efforts to maximize protection of natural resources which may be impacted upon by construction and development activities. It is the position of the department that the SEQRA review process provides the greatest opportunity for comprehensive consideration of these resources, and that ail practicable planning measures should be employed to help ensure their protection. Of particular concern to depaxtment is the adequate protection of wetlands, surface waters, natural communities, contiguous natural habitats, and rare, threatened and endangered species. In addition, efforts to protect sensitive physical resources such as groundwater and shorelines are fully supported and encouraged by the SCDHS.
