The validity of this oermit is or may be subject to the approval of other governmental or municipal
authorities, The Town accegts no responsibility in apslving for or obtaining such approval. In the
event that such app'oval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing, The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Trustees upon receipt Dy the
Trustees- of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceotance of this permit, assume all resoonsibitity for operations under-
taken pursuant to tt~i~ permit, and shall take ali precautions for the prevention of injuries to persons
and property resultin~ from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, ano its officers, agents and em 3loyees from any and all claims arising
from operations under this permit and any anc all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the oremises upon which the operations authorized by
~his permit are being conducted, do, by the aeceotance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being co?.ducted to
make such inspections as the Town may deem necessary to m~ure that-such operations are being con-
ducted in conformity with this permit.
This operation wil
not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the' fresh water resources of the town.
D. Adversely affect fish, shellfish' er other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

The following action was taken by the Board of Trustees at their
regular meeting held on April 24, 1986 regarding the application for
Dr. Vincent Claps.
Moved by Trustee Larsen seconded by Trustee Bredemeyer
WHEREAS, En-Consultants, Inc. on behalf of Dr. Vincent Claps applied
to the Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated
November 15, 1985, and
WHEREAS, said application was referred to the Southold Town Conservation
Advisory Council for their findings and recommendations and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect
to said application on April 24, 1986 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar with
the premises in question and the surrounding area; and
WHEREAS, the Board considered all testimony and documentation submitted
concerning this application; and it is noted for the record that there
has been no public opposition; and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety, and general welfare of the people of
the Town,
NOW, THEREFORE, BE IT
RESOLVED, that En-Consu!tants, Inc. on behalf of Dr. Vincent Claps be
and hereby is granted permission to construct a dock consisting of a
3' x 16' hinged ramp and 6' x 20' float secured by (2) 8" pilings. This
permit is granted under the provisions of the Wetland Ordinance of the
Town of Southold. This permit will expire on April 24, 1987 if work
has not commenced by same. There are two inspections required

Southold Town Building Dept. and the N.Y.S.D.E.C.it is assumed
that there are no objections nor commenus from those acencies.
The project as proposed will not adversely affect the ~ealth,
safety and general welfare of the people of the town.

I am in receipt of your February 1, 1986 letter ex-
pressing concern over the proposed dock in regards
to navigation.
It is our opinion that the proposed dock does not
extend excessively intothewaterway and will have
no adverse effect upon navigation. The U.S.
Arn~ Corps of Engineers which concerns itself with
navigationhas issued their permit for the project
and I enclose a copy herewith for your information.

Pursuant to Section 10 of the River and Harbor Act of 1899 (33 USC 403),
you are hereby authorized by the Secretary of the Army:

Construct a floating pier consisting of a 3 foot by 16 foot hingeo
ramp anchored by 4 inch by 4 inch piles and attached to a 6 foot Dy
20 foot float secured by ~wo 8 inch diameter piles.
WATERWAY: Budds Pond, Shel~er IslaNd Sound
LOCATION: Greenport, Town of Southold~ Suffolk County, New York
Kindly display the enclosed notice of authorization sign at the project
site.
The activity authorized herein must be completed within three years of
the date of this permit. This authorization is subject to the enclosed
conditions. Your attention is directed to condition "n". To aid you in
complying with this condition, please find enclosed two postage paid postcards
to be used to submit to this office the required dates of commencement and
completion for the authorized activity.
The authorized activity must be performed in accordance with the enclosed
plans. If any material changes in the location or plans of the subject work
are found necessary, revised plans should be submitted to the District
Engineer. These plans must receive the approval required by law before work
begins.

the Southold Town Conservation Advisory Council is concerned
about the con£ig~ration and length of the intended dock. We
believe-the land next to the existing docks extends further
ouz into the creek and if the proposed dock were built, it
would extend zoo far into the creek. As a result it would
interfere with navmgation and the right of zhe owners on the
opposite side of the creek to build a dock o£ their own in the
future.
Based on the existing proposal the Council would recommend
disapproval to the Southold Town TrusTees. We suggest that
you re~onflgure the proposed doc~, keeping the above mentioned
problems in mind, and either amend or resubmit the wetland
application.
