THIS CONVEYANCE is made subject to the following covenants and restrictions: 1. No buildings other than one private dwelling house for the use and occupancy of one family and one private garage shall be erected on said premises. Any dwelling house erected thereon shall be 1,200 square feet and any detached garage erected thereon shall cost not less than 11,500,00 LMY5738 PRCE324 2. No building shall be erected or placed on said premises, nor shall any erection or placement be commenced, nor shall any exterior alterations upon or additions to any existing building be undertaken, unless and until all plans, specifications, site plana and other information, including the name of the proposed builder or contractor, deemed necessary to determine the suitability and appro- priateness of the exterior architectural features and design and location of the proposed building or alterations upon or additions to an existing building have been first submitted to Flora S. Luce and George L. Penny, III, their successors or assigns, and approved by them in writing. After such approval has been given no building shall be erected or placed upon said premises, nor shall any erection or placement be commenced, except such as shall conform strictly to said approved plans, specifications and site plans, and the work shall be performed only by such approved builder or contractor. 3. The premises shall not be used for the manufacture or sale of merchandise or goods of any kind or for any trade or business what- soever or for the cPsplay of advertising or commercial signs, and no trade or business shall be carried on upon said premises nor shall any advertising or commercial signs be placed thereon. 4. No fences or hedges over three and one half (3-1/2) feet in height shall be erected on said premises and any fences or hedges erected on said premises shall be maintained and kept in good appearance. 5. No stables or outside toilets shall be erected on said premises; and no nuisances shall be created or allowed on same. 6. No fowl, poultry, animals or livestock, except domestic pets, not exceeding two (2) in number, shall be kept on said premises. 7. No dwelling house or garage shall be erected or maintained on any lot having a street frontage of less than one hundred (100) fast and no part of any dwelling house or garage, including stepsstoops and porches, shall be erected or maintained within forty (401t feet from the front sideline or within fifteen (15) feet from any other boundary of the lot. No part of any cesspool or septic tank shall be within ten (10) feet of any boundary line of said lot. S. No trailer shall be placed upon said premises, nor dull any trailer be maintained, parked or kept thereon for any period of time whatsoever. 9. If the parties of the second part at any time hereafter desire to sell the premises hereby conveyed, they shall prior to the making of any offer of sale or the acceptance of any offer of purchase give written notice to Flora S_ Luce and George L. Penny, III, of such offer, stating the name and address of the person by whom or to whom the offer was made, the price named, and the terms and conditions of said offer, and Flora S. Luce and George L. Penny. III, may at any time within five j5) days after receipt of such notice, elect to repurchase the property hereby conveyed upon the terms stated in such notice, and the parties of the second part agree III, convey on thetid ermsand property to Flora S. Luce and George L. Penny, upon conditions of said offer. This provision, however, shall not be con- strued to prevent the mortgaging of the premises without notice to Flora S. Luce and George L. Penny, III. 10. These covenants and restrictions shall be binding upon, and enure to the benefit of, and be enforceable by the grantors, their successors and assigns, and (subject to the right of the grantors, their su.cess ors and assigns, to alter, modify or annul any of these covenants and restrictions)any owner or owners of any part of the aforesaid land, their heirs, legal representatives, successors and assigns; and the failure by any of the foregoing to enforce any of such covenants and restrictions, shall in no event be deemed a waiver of the right to do so thereafter. Being and intended to be the same premises conveyed to this Grantor by Deed recorded in Liber 5681, Page 92 of conveyances, recorded in the Office of the Clerk of the County of Suffold, on the 7th day of January, 1965.
