Dear Mr. Allan:
As Town Trustee and resident of Orient familiar with your project
my fellow Trustees have asked me to respond to your inquiry of November 7, 1986.
The Board of Trustees as a five member Board is specifically charged with
ofprotectingsouthoid.Freshwater and Saltwater Wetlands pursuant to Chapter 97 of the Code
The protection afforded Freshwater Wetlands in the Town Code is supported
by the plan~ species listed in Article 24 of the New York State Conservation
Law by direct reference. As the Town Code makes no attempt to distinguish
"Man Made" vs "Natural" Wetlands nor does it exclude areas less than 12.A acres
as does the New York State Department of Environmental Conservation, the Board
exercises jurisdiction based on plant species found in situ.
While it would be presumptious of me to predict wha~ course the Board would
chart should indicator plants be highlighted on your property, a glance at recent
Board actions would show that possibly time consuming discussions could take place
concerning vegetation, fish and wildlife, saltwater intrusion and public safety
values.
While your project remains extra-jurisdictional, the Southoid Trustees hope
your prompt project completion could avoid what you and the local commun%ty might
regard as unnecessary regulatory delays while a very hazardous excavation remains
unfinished.

by "becoming" marsh land, etc.
Just what will require a permit, why, and what has changed
other than a ,'growing concern"?
