Dear Mr. Samuels,
The following action was taken by the Board of Town Trustees
during its regular meeting held on October 27, 1994 regarding
the above matter:
WPLEREAS, PREM C. CHATPAR applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
ordinance of the Town of Southold, application dated September
12, 1994.
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on October 27, 1994 at which time
all interested persons were given an opportunity to be heard,
and,
WI{EREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
PREM C. C~ATPAR to reconstruct 116' of bulkhead within 18"
of the existing bulkhead plus return on south side, construct
85'of retaining wall 245' above grade, repair 56' of bulkhead,
construct a 30' X 4' fixed dock, and approx. 100 c.y. of fill
from upland source. Located 680 Midway Road, Southold. SCT~
$90-2-9.1
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS the Wetland Application of PATRICK COLAQUlURI
12:3-3-22, 2:3, 2~t to replace within 18", 128 +/- I.f. of existing timber
bulkhead. Easterly 16' return will be removed and replaced and extended by
14' to 30,' inside of existing concrete return. Westerly 11' return will be
removed, replaced and extended by 25' to 36' overall. Approximately 65 c.y.
of clean fill will be trucked in from upland source for backfill.
The CAC recommends approval with the stipulation that the north side ~s
replaced "in kind and in place"; the boardwalk not exceed the current
dimensions (do not ~extend to 5'); and plant all exposed and backfilled areas
with spartina patens.

and obtain a recommendation of approval from the CAC. The CAC
recommends approval if there is no change to the system.

The CAC recommends approval of the 116' and 60' bulkhead. The
Council recommends disapproval of the 56' bulkhead. The 56' bulkhead is not

a bulkhead but a jetty and there is no need for a jetty. The CAC

recommends approval of the dock but suggests the apphcan place the dock
along the 60~ section, it would be a better configuration for the owner.

33-4-2 to cut back weeds and scrubs and cover with top-soil near the bluff
for reinforcing.
The Council recommends approval with the provision the applicant slope
the top away from the bluff to keep runoff from going over the top edge of the
bluff; the applicant plant a temporary cover of winter rye; and maintain a
buffer along the edge of the bluff.

Please find enclosed Southold Town Board of Trusuees application
for replacemen5 of bulkhead au 680 Midway Road, Southold, New
York. This property previously had a bulkhead permit with repairs
done previously under permit number: %~256 (Blair-1986).
As per my conversauion with Diane, various bulkhead contracuors
have looked au the projec5 and have indicate! 5o me thac the
enuire bulkhead section needs to be replaced. Placement of a new
- into Peconic Bay
bu~khe~ 1 in fronu of the existing bulkhead~
would be uhe mosu viable al%ernative. The but~khead needs to be
replaced au a length o~ 116' along Liuule ~econic Bay and 6~!

Inlet Which is a Wauerway which is completely closed. This needs
to be rep~i~ed as this is certainly in significant disrepair and

Additionally, it would be more prudent to add on a bulkhead
ouc clearly co minimize any environmental lmpac5 or backflow o~'
debris from any attempts made to replace 5he bulkhead in the same

As per my conversation with Diane, various bulkhead contracEors
have looked at the pro3ect and have indicated to me that the

bulkhead 18" in front of the existing bulkhead into Peconic Bay
would be the mosn viable alternative. The bulkhead needs to be
replaced at a length of 116' along Little Peconic Bay and:60!
along a return on~ the eastern border. Additionally, there ms a
pre-existing jetty along the propermy line along the old Midway
Inlet which is a waterway which is completely closed. This needs
to be-repaired as this is certainly in significant disrepair and
cer~tainly haz, ardous for anyone near the beach area.
AdditiQnally, it would be more prudent to add on a bulkhead 18"
ou~ clearly to minimize any environmental impact or backflow
debris from any attempns made to replace the bulkhead in the same
exacu position where it exists. The contracmors have stated to me

We have previously advised you that the Southold Trustees
are requiring the removal and replacement in place and
have accordingly requested au amendment of your per-
mit, to coincide with Trustees' req~re?~nts. In addi-
tion to this, we request that backfill be a~lowed to
be take~ fr~n the shoal in inlet to ~id~ay Bond which
lies directly east of the subject property. If you
will reea!l, appro~Lm~tely ~o years ago, I inquired
of the feasibility of dredging this ir~let by au
association. Although you stated you could not make
a definite opimion until an application was filed, it
was your 1repression that this would be feasibile. An
application, however, was never filed as the indivi~ml
responsible for getting the project under waY moved
awsy from the area. At the present time, Mr. Blair
would remove a maxin~m of apprexLmatety 500 cu. yds.
from g0ove the line of mean high water. ~is is a

mioiscule amount con,pared to the many thousands of ySlads
which would have to be removed frmm the entire inlet
to allow flushing to occur. It is not our intention
at this time to undertake that project, but simply to
utilize a convenient nearby source of backfill.

Southold Town Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated January 23, 1986,

WHEREAS, said application was referred to the Southold Town Conservation
Advisory Council for their findings and recommendations and
WHEREAS, a Public Hearing was held by the Town Trustees with respect
to said application on April 24, 1986 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar with
the premises in question and the surrounding area; and
WHEREAS, the Board considered all testimony and documentation submitted
concerning this application; and it is noted for the record that there
has been no public opposition; and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety, and general welfare of the people of
the Town,

An environmental assessment form in the short form has been
submitted which indicated that there would be no adverse effect
to the envzronment should the project be implemented as planned.
Because there has been no response in the allotted time from the
Southold Town Building Dept. and the N.Y.S.D.E.C.it is assumed
that there are no objections nor commen~s from those agencies.
The Southold Town Conservation Advisory Council has recommended
approval of the project as proposed.
As proposed the project will not adversely affect the health,
safety and general welfare of the people of the Town.

As per our conversation on Saturday I am submitting the
following prices and information for various options to repair
and/or replace your bulkhead.
I inspected your bulkhead yesterday at a good low tide and I
have found the following repairs are necessary just to maintain
the structure.
Ei~T RETURN SECTION~
We should install a lower 4" x 6" stringer to help hold the
bottom of the existing sheathin~oget~?~9~ a p~ice ~f .....

p~le next to the corner to reinforce the existing stringers which
are bowing. The cost to perform this work would be $550.00.
MAIN BULKHEAD SEOTION~
Upon my inspection of the m~in bulkhead section I have found
the following repairs necessary~
#1 Add a 4" x 6" bottom stringer to hold the bottom of the
sheathing together at a cost of $2,800.00.
#2 - Add a 4" x 6" top clamp approximately 40' at a cost of
$480.00.
#3 - Install a prefabbed corner section at a cost of
$1,100.00.
#4 Add extra bolts through the existing 4" x 6" top
stringer at a cost of $160.00.
