BEGINNING at a point on the curved southeasterly line of Smith Drive South,
17.50 feet northeasterly along said southeasterly line from a stake set at
the northwesterly corner of Lot 43, as shown on a map entitled, Nap of Goose
Neck situate at Bayview, Town of Southold, Suffolk, N.Y., made by Otto W. van
Tuyl, February 27, 1948 and filed in the Suffolk County Clerk's Office as Nap
No. 1663, said point of beginning being the northeasterly corner of land
conveyed, or about to be conveyed by George W. Smith E Sons Inc. to Rispert,
from said point of beginning running northeasterly along said curved
southeasterly line of Smith Drive South on a curve to the left having a
radius of 150.0 feet, a distance of 40.0 feet to land conveyed or about to be
conveyed by George W. Smith S Sons, Inc. to Sprague;
RUNNING THENCE along said land conveyed or about to be conveyed to Sprague,
south 68 degrees 44 minutes 20 seconds east, a distance of 268.98 feet to the
shore of a proposed canal;
THENCE along said shore of said canal, south 47 degrees 00 minutes east a
distance of 127.50 feet to said land conveyed or about to be conveyed to
Rispert;
THENCE along said land conveyed or about to be conveyed to Rispert, north 49
degrees 25 minutes 20 seconds west, a distance of 226.63 feet to the point of
beginning according to survey of Otto W. Van Tuyl, Licensed Surveyor, dated
April 30, 1952.

roads abutting theabovedescribed premises to the center lines thereof; TOGETHER with the appurtenances and
all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as
I trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party” shall be constmed as if it read "parties' whenever the sense of this indenture so requires.
