The aermitted site or facility, including relevant recor(3s, is subject to insoection at reasonable hours and intervals by an authorized representative of the Deoartment of Environmental Conservation (the Departmenti to determine wnemer the permittee is complying with this permit and the ECL Such representative may order the Work suspende¢ pursuant to ECL 71-0301 and SAPA 401(3). A copy of this permit, including ell referenced "naps, drawings and special conditions, must be available for inspection by the Depactment az all times at the project site. Failure to produce a copy of the permit upon request by a Department reoresentative is a violation of this permit. Permit Changes and Renewals 2- The Department reserves the right zo modify, suspend or revoke this permit when: a) the scope of the permitted activity is exceeded or a violation of any condition of the permit or provisions of the ECL eno pertinent regulations is found: b) the permit was obtained by misrepresentation or failure to disclose relevant facts; c) new material information is discovered; or d) environmental conditions, relevant technology, or applicable law or regulation have materially changed since the permit was issued. 3. The permittee must submit a separate written application to the Department for renewal, modifica- tion or transfe ' of this permit. Such application mus[ include any forms, fees or supplemental infor- mation the Department requires. Any renewal, modification or transfer granted by the Doper[men[ must be in writing. 4. The permittee must submit a renewal application at least: a} 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPOES), Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC} and Solid Waste Management Facilities (SWMF); and b) 30 days before exairation of all other permit types. 5. Unless expressly provided for by the Deoartment, issuance of this oermit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, con- ditions or reouirements contained in such order or determination. Other Legal Obligations of Permittee 6. The permittee t~as accepted expressly, by the execution of the application, the fuji legal responsibili- ty for ail damages, direct or indirect, of whatever nature and by whomever suffered, arising out of the prolect described in this oermit and has agreed to indemnify and save harmless the State from suits, actions, damages and costs of even/ name and description resulting from this project. 7. This permit does not convey to tl3e permittee any right to Trespass upon the lands or interfere with the riparian rights of ott~ers in order to perform the permitted work nor does it authorize the impair- ment of any rights, title, or interest in real or personal proper~y held or vested in a person not a party to the permit. 8. The permittee is responsible for obtaining any other permit~, approvals, lands, easements and rights- of-way that may be reouired for this project. Such aggroved olans were 4 o SPECIAL CONDITIONS A copy of this permit with supplementary conditions and approved plans must be available at the project site whenever authorized work is in progress. The permit sign enclosed with the permit or a copy of letter of approval must be protected from the weather and posted in a conspicuous location at the work site until completion of authorized work. At least 48 hours prior to commencement of the project, the permi~tee must complete and return the top portion of the enclosed receipt form certifying that he is fully aware of and understands all provisions and conditions of this permit. Within one week of completion of the permitted work, the bottom portion of that form must also be completed and returned. If the permittee intends to undertake any project design modifications after permit issuance, the permittee must submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. SPECIAL CONDITIONS For Article 25 I' Tidal Wetlands Bulkhead must be constructed within 18" of the existing structure measured from the face of old sheathing to the face of new sheathing. Construction of bulkhead and completed prior to placement behind such structures. return walls must be of any fill material Use of timbers (wood) treated with pentachlorophenol is strictly prohibited. Ail fill must be from an approved source and consist of clean gravel and soil. Use of asphalt, slag, flyash, broken concrete or other demolition debris is prohibited. Ail fill must be graded to match the elevation of the land immediately adjacent to the bulkhead. Contamination of tidal wetlands and the waters of New York State by suspended solids, sediments, fuels, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the conduct of the permitted activity is prohibited. Any debris or excess material from construction of this project must be immediately and completely removed from the adjacent area and disposed of at an approved upland site. Disposal of debris in tidal wetlands is prohibited. Any bulkhead constructed directly adjacent to vegetated tidal wetlands is to be jetted in with minimal disturbance to the tidal wetland.
